If the Lessor agreed that the Tenant perform any Physical changes or modifications, the Tenant agrees not to undo and/or destroy them upon moving out. 3- LAWN AND OUSIDE CLEANING: Occasional Lawn Service for the front lawn, is provided by the owner and the tenant must keep the inside and outside of the property clean of Trash, Junks, Weeds, Leaves, All Debris, Oil Leaks, Etc. 4- UPDATES AND STRUCTURAL REMODELING: Other than necessary repairs if any, the Tenant may perform, updating, such as structural remodeling and/or changes to this unit. with the prior written permission of the Lessor. 5- INSURANCE: Tenant must have own insurance for his, Health, well Being, Property, any and all accidents, losses and/or natural disasters, including Floods, Storms, Hurricanes, etc. Owners Insurance only covers the structural damages to the property and will not be accountable to any personal Injuries, physical loss or damages and/or financial harm to the Tenant. 6- UTILITIES: The Tenant must pay for all his portion of the Utilities such as Electricity, Water, Internet, Telephone and TV Services. When owner is not staying in the front home and for the period that there are no persons other than the Tenant living in the Property, the Tenant shall pay for 100% of the Utilities since he or she will be using them. There is a separate Septic Tank for this Property, therefore there are no sewer charges. For electricity and water, Owner will pay his share when he is living in the house. In case there were other Tenant/s in the Property, the charges will be pro-rated. After many years of Renting and the Billing History, the Usage of each party is very clear. There is only one Meter for the purpose of Electricity and the Water usage for the entire property. 7- PETS: Pets are negotiable according to the type and the number. Any Dogs, If accepted by the Lessor, must at all-times be enclosed in the proper designated, fenced area. No Snakes and/or Exotic Pets, including any dangerous or vicious animals are not allowed on the premises at any time. 8- RENT PAYMENT: The Rent must be direct deposited and in the Lessor's account in Chase or any other Bank designated by the Lessor, by 12.00 PM on the Due Date, each and every month by Pr-arranged Auto-Deposits from the Tenant's Bank. In the event such day falls on a Sunday and/or any legal Holidays, it is the Tenant's responsibility to deposit the rent, prior to Sunday or such Holidays. The Lessor is a Retired Senior Person in Fragile Health Conditions. He uses the Income of this Unit to pay his Mortgage every month. It is of extreme importance that each and every month's Rent is paid in Full and On Time. Late or returned payments are assessed $50.00 penalty per day . After 15 days of Partial or non-payment, the tenant is deemed with non-compliance with the Lease Agreement, which will result in the default of the Lease agreement and the Loss of Deposit. The tenant is required to give a 60 Days, written notice, before the end of each Lease Period, if he or she intents to move out. The Tenant will still remain Liable for all damages to the Property, the late payments and the unpaid amount of the period of occupancy without paying the rent. Including the 60 days' notice period. Application for Credit Report must be filled out by all prospective Tenants. There is a $50.00 Non-Refundable Fee for Credit and background Check. Only those mentioned on the Lease are authorized to live in the leased unit. No permanent and/or temporary stay or move in of other individuals without the written consent of the Lessor are accepted. All members of the Tenants living and/or visiting this Premises, must be Citizens and/or Lawful Permanent Green Card Holders of the United States Of America. Those with Undetermined Residency and/or Having any Criminal Backgrounds, Please do not apply. You will not be approved for this Lease. Tenant must show proof of Employment and/or Income to be able to pay the Rent for the Duration of the Lease. Car repairs or any commercial practices at the premises are not allowed. Breaking any of the above rules will cause noncompliance with the lease agreement and will result in eviction, legal liabilities and the loss of security deposit. 9- THE DEPOSIT: In absolutely no event may the Deposit money, be substituted for the Monthly rent including the last 2 months of any Lease Periods, or any portion thereof, without the written consent of the Lessor. Within 15 Business Days after the Tenant Vacated the Premises in good standing and the property is surrendered with all copies of keys and without any damages to the property and the appliances, including return of any items that the owner may have trusted or loaned to the Tenants and the entire property was left clean inside and outside, the total deposit amount minus the amount withheld for the unpaid utility Bills that continue coming after the Tenant has left the Premises, shall be sent via Bank Check to the Tenant. In the event of Repairs needed to the Property, Appliances and all other Items that was used by the Tenant, the estimated cost of these items shall be deducted from the Deposit and the rest if any, returned to the Tenant. 10- Lease Agreement: All the above conditions will be part of any signed Agreement/s with The Prospect new Tenant, constitute The Lease Agreement. The Tenant acknowledges the acceptance of all the conditions mentioned here, as advertised in many Internet Sites, by paying the first month and the Deposit, or any portion there of. For the Legal purpose all conditions above will be the true and correct agreement in the event of any contradiction. Digital Lease agreement and digital signatures or any accepted initial payment by the prospective Tenant for the premises will be considered the same as paper signed Lease agreement and shall have the same Legal validity as a paper sighed Lease. The entire Lease agreement has been available to any prospective Tenants online in advance of showing the premises. Any printed version will be provided only upon request. No changes to the above is allowed or accepted, unless it was in writing and signed by the Lessor or his Agent. In the event of the Owner's incapacitation, death and or sale of the house, if the closing date, occurred sooner that the termination date of the agreed Lease, The Owner or the Owners Estate or Agents, may terminate the lease agreement, prior to its set termination date, by giving the Tenants a 60 days, written notice and return the Deposit according to the above terms and conditions. Only in such event, the Tenant may enjoy the last month, rent free.
