Maintenance & Repairs
1. General Responsibilities
The Landlord shall maintain the premises in a habitable condition as required by California Civil Code 1941.1, including structural components, roofing, plumbing, electrical, heating, and other major systems.
The Tenant shall maintain the premises in a clean, sanitary, and orderly condition at all times, and shall promptly notify the Landlord in writing of any condition requiring repair.
2. Tenant Maintenance Obligations
The Tenant is responsible for routine upkeep, including but not limited to:
Replacing light bulbs, air filters, and smoke/CO detector batteries.
Keeping all plumbing fixtures clean and free of blockage.
Maintaining cleanliness to avoid pests, mold, or mildew buildup.
Disposing of trash properly and keeping outdoor areas tidy.
The Tenant shall not damage, misuse, or neglect the premises or any fixtures or appliances. Any repair resulting from Tenant negligence or misuse will be completed at the Tenant's expense.
3. Repairs & Cost Threshold
The Landlord will handle necessary repairs exceeding $150, unless the damage was caused by the Tenant or their guests.
Tenants are responsible for repairs costing less than $150 that result from regular use or minor issues.
4. Appliances & Fixtures
If the premises are provided with appliances (such as laundry machines, refrigerator, stove, or air conditioning), Tenant agrees to use them properly and report malfunctions immediately. Damage from improper use is the Tenant's responsibility.
5. Landscaping & Exterior
Tenant shall maintain any exclusive outdoor areas in a clean condition, free of debris. The Landlord will handle major landscaping, tree trimming, or exterior maintenance unless otherwise agreed.
6. Pest Control
Landlord certifies the property is pest-free at the beginning of tenancy. Tenant agrees to maintain cleanliness to prevent infestations. Ongoing pest control needed due to Tenant negligence may be charged to the Tenant.
7. Alterations & Improvements
Tenant may not paint, alter, or make improvements to the property without written permission from the Landlord. Any approved improvements become property of the Landlord upon installation unless otherwise agreed.
8. Emergency Repairs
In an emergency affecting health or safety (e.g., fire, burst pipe, electrical hazard), Tenant must contact the Landlord immediately. If the Landlord cannot be reached, Tenant may arrange for reasonable emergency repairs and provide receipts for reimbursement.
9. Landlord Access
Landlord may enter the property with at least 24 hours' written notice for inspections, maintenance, or repairs, per California Civil Code 1954.
10. Tenant Negligence
Repairs required due to Tenant negligence, misuse, or failure to report an issue promptly will be charged to the Tenant.
11. Renter's Insurance required
Tenant is to maintain renter's insurance covering personal property and liability for accidental damage to the premises. Proof of insurance may be required before move-in.
