Utility, Maintenance & Property Use Terms
1. Utilities
The Landlord shall pay for water service to the property.
The Tenant is responsible for all other utilities, including gas, heating, and electricity.
Electric service is currently shared between the upper and lower units, and usage is to be divided as follows:
Tenant may choose to pay a fixed electric fee of $200 per month. If 60% of the actual electric bill exceeds $200, Tenant agrees to pay the excess amount within 7 days of notification from the Landlord.
The electric meters are expected to be separated approximately three (3) months after June 2025. Once separated, the Tenant will be responsible for establishing and maintaining their own electric account and paying their individual usage directly.
Tenant must establish and maintain their own gas utility account for heating, hot water, and cooking.
2. Maintenance & Repairs
Tenant is responsible for routine and minor repairs under $200 per incident, including but not limited to: clogged drains, basic fixture replacements, air filter changes, and blown fuses.
Repairs over $200 must be reported in writing to the Landlord. The Landlord reserves the right to determine the necessity and method of repair.
Tenant shall not perform any unauthorized repairs, alterations, or improvements to the premises or outdoor spaces without written approval from the Landlord.
3. Backyard Use & Responsibilities
The backyard is a shared common space between tenants of both units.
All tenants are permitted to use the backyard for reasonable and lawful recreational use, provided it remains clean and undamaged.
Tenants are required to clean up after themselves and maintain the backyard in a neat and orderly condition.
No trash, furniture, debris, or abandoned personal items may be left in the backyard.
If the backyard is found to be excessively dirty, damaged, or littered with trash, the Tenant shall be charged a $200 cleaning fee at the Landlord's discretion.
No construction, storage of flammable or hazardous materials, or unauthorized gatherings of more than 10 people are allowed in the backyard.
4. Appliances & Fixtures
The Landlord will provide three (3) portable air conditioning units for Tenant's use as a courtesy.
Tenant is responsible for the care, cleaning, and maintenance of these units and will be charged for any damage or misuse.
The Landlord is not obligated to repair or replace these units and assumes no liability for malfunction.
5. Liability & Insurance
Tenant assumes all responsibility for the safety and conduct of themselves, household members, and guests while on the premises.
Landlord is not liable for injuries, losses, or damages sustained on or around the property, including in the backyard, driveway, or common areas.
Tenant shall carry and maintain renter's insurance with a minimum of $100,000 liability coverage, and provide proof upon request.
Tenant is responsible for securing their own personal property. The Landlord shall not be liable for theft, loss, or damage to personal belongings.
6. General Property Rules & Protections
Smoking is strictly prohibited inside the unit and common areas.
No illegal activities of any kind shall be conducted on the premises.
No subletting or assignment of the lease is permitted without prior written consent from the Landlord.
Pets are not allowed unless expressly approved in writing by the Landlord and subject to an additional pet deposit or monthly fee.
Tenant shall allow reasonable access to the Landlord or their agents with 24-hour notice for inspections, repairs, or maintenance, except in emergencies.
Tenant agrees to promptly report any damages, safety concerns, or code violations to the Landlord.
Landlord reserves the right to terminate tenancy for repeated lease violations, misuse of property, or damage beyond normal wear and tear.
