Hendel Management LLC Innkeeper Occupancy License Agreement Effective Upon Signing Signing this Occupancy License Agreement constitutes full acceptance of the terms and conditions outlined herein. These terms are legally binding and non-negotiable. Violations may result in immediate termination of occupancy, removal from the property, financial penalties, and/or legal action. 1. Parties & Property Landlord/Owner: Hendel Management LLC Occupant (Licensee): The individual(s) signing this Agreement as the paying guest(s) Property: The residence located at [insert property address] By signing, the Occupant acknowledges: This Agreement applies to all occupants and visitors. The Occupant is responsible for compliance by all such parties. The Occupant maintains a separate primary residence outside of the licensed property and does not acquire any permanent residency rights here. This Agreement grants a limited, revocable license to occupy the property for residential purposes only. It is not a tenancy, does not create landlord tenant rights, and conveys no legal interest in the property. 2. Term & Occupancy Occupancy Term: The license term is month-to-month or a fixed term of up to 12 months as specified in writing. Renewal is not automatic and must be expressly agreed in writing by the Landlord. At expiration of the license term, Occupant must immediately vacate the Property unless a new written agreement is signed. Occupancy Limits: Maximum of 4 occupants unless approved in writing. Unauthorized occupants are trespassers and grounds for termination. Guests: Overnight guests require prior approval from the Landlord. Guests staying more than 3 consecutive nights or more than 7 nights in a month are considered unauthorized occupants unless written approval is granted. Unauthorized or extended-stay guests may result in immediate termination, fees, and legal removal. 3. Payments License fee ("rent") is due on the first day of each month unless otherwise specified. A late fee of $150 applies after the 2nd day of each month. Returned checks or declined payments incur an additional $200 charge. Security deposit is refundable in accordance with this Agreement and applicable law, provided no violations, damages, or unauthorized occupancy occur. 4. Security & Safety Exterior security cameras may be present; no cameras are installed inside. Tampering with or disabling security devices is strictly prohibited. 5. Use, Conduct, and Quiet Enjoyment Property is for residential use only. Quiet hours: 10:00 PM 8:00 AM. No parties, events, or commercial activities without prior written approval. Occupant must comply with all local, state, and federal laws. 6. Smoking & Vaping Smoking, vaping, and e-cigarettes are prohibited indoors. Outdoor smoking allowed only at least 10 feet from doors/windows. No smoking on the premises (including backyard) unless expressly permitted. All waste (cigarette butts, ash, etc.) must be properly disposed of. 7. Pets No pets allowed unless explicitly approved in writing by Hendel Management LLC. If approved, pets must be supervised and may not damage property. Service animals permitted as required by law. Emotional Support Animals (ESAs): Under federal law, Emotional Support Animals (ESAs) are not considered service animals under the Americans with Disabilities Act (ADA) and do not have public access rights. However, ESAs are protected under the Fair Housing Act (FHA). Tenants requesting to keep an ESA on the premises must provide a valid letter from a licensed healthcare professional verifying the need for the animal. Landlord reserves the right to request and verify such documentation before approval. 8. Maintenance & Cleanliness Occupant must maintain the property in clean and sanitary condition. Shoes should be removed indoors to prevent damage. Occupant is responsible for damage caused by themselves, guests, or pets. Excessive cleaning or repair costs may be charged. 9. Parking Park only in designated spaces. Unauthorized parking may result in towing at Occupant's expense. 10. Termination & Remedies Month-to-month licenses require 30 days' written notice from the Occupant to terminate. Fixed-term licenses end on the stated date unless renewed in writing. Violations may result in: Immediate termination and removal Financial penalties, including unpaid license fees, cleaning, or repair costs Legal action, including recovery of attorney's fees 11. Unlawful Holdover Occupant acknowledges that this Agreement grants only a limited, revocable license to occupy the Property and does not create a tenancy of any kind. At the expiration or termination of this Agreement, Occupant must immediately vacate the Property. Any stay beyond expiration or termination is considered trespassing and unlawful detainer. Occupant agrees to pay a fee equal to double the daily license fee for each day of unlawful occupancy. However, payment of such fee does not grant permission to remain on the Property. Occupant expressly acknowledges that the Landlord may require immediate removal at any time after expiration or termination, with or without cause, regardless of whether such fee is paid. Occupant further acknowledges that they maintain another primary residence and that the Property is not, and will never become, their primary residence.
