SUBLET: The premises shall not be sublet or this Agreement assigned without the written consent of the LANDLORD.
SHORT TERM LEASING (ie: Air BnB, VRBO): is prohibited
INSPECTION: With prior notice LANDLORD or its agent shall be permitted to enter the premises during reasonable hours for inspection, maintenance and showing to prospective tenants or purchasers. TENANT shall not alter existing locks or install other locks without the written consent of the LANDLORD.
CONDITION: The premise is leased as shown with no other verbal commitments by the LANDLORD or its agent.
DAMAGE: The LANDLORD is not responsible for any injuries to persons or damage and loss of property caused by the negligence, omission or willful act of TENANT or TENANT'S guests while on the leased premises or on the LANDLORD'S property of which leased premise are a part. TENANT accepts this condition as part of this agreement. TENANT is required to carry Renter's Insurance. LANDLORD shall repair those appliances owned by LANDLORD that need repairing under normal usage.
NO PETS: Tenant recognizes that pets are not permitted to live at the property.
BREACH OF AGREEMENT: If TENANT shall fail to pay rent within 15 days of the due date, LANDLORD may charge a late fee of 4% of the monthly rental amount. If TENANT fails to comply with any of the terms of this Agreement, LANDLORD may terminate this Agreement and the TENANT'S rights hereunder. LANDLORD may declare forfeiture. Re-enter the premises, sue for rent or other legal remedy. Unfavorable credit history will be reported to the appropriate credit agencies.
IMPROPER USE: Premises shall only be used as the private residence of those who are listed as TENANT'S above.
RENTAL PAYMENT: Payment of rent can be paid through Venmo to Chandler Thayer or a check can be made to Chandler Thayer and sent to __________. Rent not received by the first of each month shall be considered late.
HOLD OVER: The TENANT agrees that his/her occupancy of the premises beyond the term of this Agreement shall not be deemed as a renewal of this Agreement. If rent is collected and accepted it shall be a renewal on a month to month basis only, with all other provisions of this Agreement to continue except for term.
SEPARABILITY: If any portion of this Lease is held invalid, the remainder of the Agreement shall not be affected.
The TENANT agrees to abide by the RULES and regulations of the property as attached hereto, or amended during the rental term including NO SMOKING in the condo or on the balcony.
TERMINATION: Upon the expiration or termination of this Agreement, TENANT agrees to deliver the premises and equipment in good, clean, tenantable condition, reasonable wear and tear expected.
MAINTENANCE: Lawn, yard care and snow removal on the driveway and deck are the responsibility of the TENANT.
EARLY TERMINATION: 60 days notice is expected in order to terminate the contract prematurely and the TENANT risks forfeiting their security deposit if a replacement is not found. Should the LANDLORD decide to sell the property 60 days notice will be issued to the TENANT.
QUIET ENJOYMENT: It is agreed that in consideration of others, any complaints due to loud noises (i.e. parties, music, etc) or disturbances to the peace of the neighbors, shall be sufficient cause for termination of this Lease.
NO SMOKING: Tenant recognizes that this is a non-smoking unit and ensures guests abide by this policy.
TENANT acknowledges that Broker may be representing said property owner and information furnished to the applicant is from sources deemed reliable but no warranty is made to the accuracy thereof. Furthermore, TENANT recognizes that information and representations (including but not limited to) heating systems, electrical systems, appliances, air conditioning, and conditions of said property has been provided by owner and TENANT is encouraged to seek information from professionals regarding any specific issue of concerns involving said information.
SPECIAL PROVISIONS: TENANT agrees to abide by all current and forthcoming City, County, or State ordinances and codes. This shall include current regulations or changes or regarding the bagging, removal or disposal of trash and recyclables. All costs shall be at the TENANT'S expense. Failure to comply with the regulations may result in a lien being placed against LANDLORD'S property, should this result the LANDLORD reserves the right to take legal action and/or retain TENANT'S security deposit to cover lien release costs.
