No recreational vehicles, trailer, or semi-tractors will be permitted on the Premises without the prior written consent of the Lessor. "Operable" means the vehicle must have air in the tires, have all major components intact, including windows, windshield and be reasonably clean. Vehicles not in an operable condition after seventy-two hours may be towed away at the vehicle owner's expense. Lessor shall bear no responsibility for any damages incurred while the vehicle is being towed or for storage thereof. CARE OF PREMISES. Lessee shall keep the improvements thereon in such repair as same are at the commencement of the term hereof, and at the end of the term of this Agreement shall deliver up the Premises in as good condition as at commencement of Lessee's occupancy, normal wear and tear excepted. Further, Lessee shall not suffer nor commit any waste in and about said Premises and shall keep the said Premises, together with the fixtures therein and appurtenances, in a clean, orderly, and sanitary condition and in good repair and free from vermin and rodents, all at Lessee's own expense. Lessee acknowledges that he/she has inspected the Premises and the improvements thereon and accepts the condition as is. Lessor will make necessary repairs to the Premises and improvements thereon with reasonable promptness after notice from Lessee of any deficiencies, which create unsafe or untenable conditions. NO SMOKING. Due to the known health risks of exposure to second-hand smoke, increased risk of fire and increased maintenance, cleaning and redecorating costs, all forms of smoking shall be prohibited inside the Leased Premises, including the attached garage. The term "smoking" means inhaling, exhaling, breathing, vaping or carrying any lighted cigar, cigarette, e-cigarette, hookah, vaporizer, pipe and other tobacco or tobacco-type product in any manner or in any form. Resident is responsible for all costs associated with any damage to Leased Premises for repair, replacement or cleaning due to smoking or smoke related damaged caused by Resident, members of Resident's household, visitors, guests, or any other person and all costs associated with any type of legal action brought against Lessor is a direct or proximate result of Resident's breach of this term of the Lease by Resident, including but not limited to court costs and attorney's fees incurred by Lessor to defend any such action. Resident will be charged $100 for the first offense, $200 for the second offense and $500 for three or more offenses for violating the terms outlined in this No Smoking paragraph. Any violation of this No Smoking paragraph shall be considered a material breach of the lease and may subject the Resident to an eviction action. ADDITIONAL.
