Policies and Responsibilities Material Breach Clause: Any violation of the Pet Policy, Smoking Policy, Parking Policy, HOA Compliance clause, or Renter's Insurance Requirement shall constitute a Material Breach of this Lease, for which the Landlord may pursue all remedies, including termination of the tenancy. Sprinkler System Maintenance: Tenant is responsible for the full maintenance of the in-ground sprinkler system, including the cost and execution of professional winterization (blow-out) by October 31st and spring start-up by May 1st each year. Tenant must provide Landlord with a receipt from a licensed service provider as proof of winterization by November 5th. Any damage to the sprinkler system resulting from the Tenant's failure to winterize is the Tenant's sole financial responsibility. Email and text messages do not constitute legal written notice for any purpose. Landlord Entry: Landlord shall provide reasonable advance notice prior to entry. Tenant agrees that "emergency" situations allowing immediate entry without notice include, but are not limited to: fire, burst water pipes, gas leaks, discovery of an active water leak, or situations reasonably believed by the Landlord to pose an imminent threat to life or property. Maintenance Responsibilities: Tenant: Tenants handle day-to-day upkeep, including lawn mowing, snow removal (sidewalks/driveway), and cleaning. Tenant is responsible for air filter changes at least once every 60 days or more frequently as needed/required by the manufacturer. Tenant is responsible for all non-structural, non-systemic repairs up to $100 per incident. Landlord: Landlord covers major repairs (e.g., HVAC, plumbing, electrical, roof) due to normal wear and tear. For repair of landlord-provided appliances, the Landlord covers the cost of repair due to wear and tear, but the Tenant is responsible for the first $75 of the service call/repair cost. Tenant is responsible for all costs resulting from misuse or neglect. Move-In Condition: Tenant acknowledges receipt of a Move-In Condition Checklist and agrees that the Premises and all included appliances are in good working order as of the move-in date, save for any noted exceptions. Renter's Insurance Requirement 1. Mandatory Coverage: Tenant shall obtain and maintain a Renters Insurance Policy throughout the entire term of this Lease, including: Personal Liability Coverage (min. $300,000), Personal Property Coverage (min. $50,000), and Pet Liability Coverage (min. $100,000 and must cover approved pet(s)). 2. Landlord Notification: The Landlord, [Venkata Chaitanya K Pothuri], must be named as an "Additional Interested Party" or "Parties in Interest" on the policy. 3. Proof of Insurance: Proof of insurance must be provided prior to key collection and upon renewal. Failure to maintain continuous coverage is a material breach of this Lease. Lease Termination Clauses (Fixed-Term Lease) Tenant Early Termination (Breach of Lease): Lease Break Option (Liquidated Damages): If the Tenant vacates the Premises before the Lease end date for an unprotected reason (non-statutory), they may be released from further rent obligations by providing 60 days written notice and paying a non-refundable Early Termination Fee equal to Two (2) months of the Monthly Rent ($5,700.00) as liquidated damages. Mitigation of Damages (MN Law): If the tenant does not choose the Lease Break Option, the Landlord will make reasonable efforts to re-rent the unit (per Minn. Stat. 504B.154). Reasonable efforts shall be defined as listing the property on major rental platforms at or near the current market rate within five (5) business days of receiving the Tenant's move-out date. Landlord Termination/Non-Renewal: In the event of a material breach of the Lease by the Tenant, the Landlord may pursue termination and eviction in accordance with all applicable Minnesota statutes. Should the Landlord choose not to renew the Lease upon its fixed expiration date, the Landlord agrees to provide the Tenant with at least 60 days written notice prior to the Lease end date.
