Reverse mortgages shall be limited to 25% of the certified appraised value of the property. Any shareholder seeking a mortgage shall obtain the approval of the Board of Directors by providing documentation which demonstrates that the proposed mortgage meets this rule. In addition, the shareholder shall reimburse the Agate Harbor Land Pool for any out-of-pocket costs it incurs related to the mortgage approval process. The Agate Harbor Land Pool Board of Directors may grant exceptions to these limitations only by majority vote of the Board and only prior to the imposition of any lien, mortgage, encumbrance or trust. No transfer to any Trust shall be permitted unless:1) The Trustee (and all Successor Trustees) is an individual lot owner or the spouse or child of a lot owner; 2) the sole trust beneficiary(s) entitled to reside on the property are the spouse or child(ren) of the Trustee; and 3) the Trustee and Successor Trustees acknowledge, in writing, the transfer and use restrictions applicable to the property.
