1. PROPERTY AND LEASE PERIOD
The Landlord hereby leases to the Tenant the above-described residential property for a period of one (1) year, commencing on _____________, 2025, and ending on _____________, 2026, at 11:59 PM.
2. RENT AND PAYMENT TERMS
Monthly Rent: $1,960. Due Date: 1st of each month. Late Fee: $100 if rent is more than 3 days late. Security Deposit: $2,460. Payment shall be made to: EMBROWN LLC.
3. SECURITY DEPOSIT
Tenant agrees to pay a security deposit of $2,460 prior to occupancy. This deposit will be held to cover any damages beyond normal wear and tear, unpaid rent, or other charges as specified in this lease.
4. PET POLICY
NO PETS ALLOWED. Tenant agrees that no animals, birds, fish, reptiles, or pets of any kind shall be brought onto or kept on the premises without prior written consent of the Landlord. Violation of this clause shall constitute grounds for immediate termination of this lease.
5. PROPERTY CONDITION AND DAMAGES
Tenant acknowledges that they have inspected the property and accepts it in its current condition. Tenant agrees to maintain the property in good condition, be responsible for any damages beyond normal wear and tear, report any maintenance issues promptly to the Landlord, and return the property in the same condition as received, excluding normal wear and tear. Normal wear and tear includes minor scuffs on walls, worn carpet from normal use, and minor nail holes. It does NOT include large holes in walls, broken fixtures, damaged flooring, or any alterations to the property.
6. PERSONAL PROPERTY AND FURNISHINGS
Tenant agrees that all items, furnishings, appliances, fixtures, and personal property present in the home at the commencement of the lease belong to the Landlord and shall remain on the premises. Tenant may not remove, relocate outside the property, sell, or dispose of any items that were present at move-in.
7. UTILITIES AND FEES
Tenant is responsible for payment of ALL utilities and services, including electricity, gas, water and sewer, trash and recycling, internet and cable, and any HOA violation fees or fines incurred during the lease period. Failure to pay utilities may result in service disconnection and shall constitute a breach of this lease agreement.
8. PROPERTY INSPECTIONS
Landlord reserves the right to inspect the property periodically during the lease term with reasonable notice (typically 24-48 hours) to ensure compliance with lease terms and to assess property condition. Inspections will be conducted at reasonable hours and will not unreasonably interfere with Tenant's quiet enjoyment of the property.
9. USE OF PREMISES
The premises shall be used solely as a private residence. No business activities, illegal activities, or activities that may disturb neighbors are permitted. NO SMOKING is permitted anywhere on the premises, including inside the home, garage, patio, balcony, or any other area of the property. Tenant shall comply with all applicable laws, ordinances, and HOA rules and regulations.
10. MAINTENANCE AND REPAIRS
Tenant agrees to keep the property clean and sanitary, not make any alterations to the home without written consent, replace burned-out light bulbs, keep plumbing fixtures clean and unclogged, and test smoke detectors monthly and replace batteries as needed. Landlord will be responsible for major repairs not caused by Tenant negligence or misuse.
11. TERMINATION
This lease may be terminated by natural expiration of the lease term, agreement of both parties, breach of lease terms by either party, non-payment of rent (after proper notice), or violation of any lease provisions.
12. DEFAULT AND REMEDIES
If Tenant defaults on any provision of this lease, Landlord may terminate the lease with proper notice, pursue eviction proceedings, seek monetary damages, or retain all or part of the security deposit.
13. GENERAL PROVISIONS
This lease constitutes the entire agreement between the parties. Any modifications must be in writing and signed by both parties. If any provision is deemed invalid, the remainder of the lease remains in effect. This lease is binding upon heirs, successors, and assigns. Governing law: Arizona law applies to this agreement.
