CLEANING FEES: Nonrefundable move-in cleaning fee of $300.00 is due on date of move in. __ LATE FEE: Rent is considered late if not submitted by the 5th of each month and is subject to a 10% late fee. __ Partial rent is not acceptable and subject to the 10% late fee. __ Rent, deposits and fees will be paid by mutually agreed upon electronic method. __ If rent is late three times, rent automatically increases 10%, without affecting any other terms of this agreement. __ Tenant must give 30 days' notice prior to moving out, or risks losing all or part of the security deposit. __ Tenant agrees to the length of lease terms and risks losing all or part of the security deposit if he/she decides to break terms. __ Tenant agrees that only persons listed on this rental agreement shall reside on Premises. Any guests staying longer than 21 days in 52 weeks must be authorized by the Owner and/or the Marina. __ Tenant is responsible for their own proper conduct and the conduct of their guests, including the responsibility for understanding and observing all policies and rules. __ Tenant shall reimburse the Owner immediately upon demand in the amount of any loss, property damage, cost of repair or service caused by negligent or improper use by Resident or their guests or invitees. __ Tenant is responsible for gas and electric utilities, and agrees to establish use, maintain and/or pay for all utilities without delinquency used in or charged against the Premises. __ Landlord will be responsible for all water, sewer and garbage utility expenses. __ Tenant agrees to only use Columbia Crossing's assigned parking spot for personal parking of own vehicle or guest. __ Tenant will be issues two copies of each house key and key card. Tenant is responsible for all issued keys and key cards, and will pay to replace any lost or missing keys or key cards. __ Tenant agrees NEVER, under any circumstances, SMOKING allowed inside the unit. Tenant understands that smoking must take place in designated outside areas and cigarette butts are to be disposed of appropriately, NOT left on the ground. __ Tenant agrees to NEVER put holes in wood moldings or frames inside or outside of the home, and to use appropriate picture hangers when hanging items on the walls. __ Tenant agrees to abide by the rules and regulations of Jantzen Bay/Columbia Crossing. __ Tenant is responsible to notify Landlord immediately of any needed repairs, such as leaks, stopped pipes, frozen pipes, bathroom caulking, etc. __ Tenant is responsible to keep working batteries in smoke detectors, and at no time will tamper with said detectors except to replace batteries. Tenant will not leave any said detector without a battery for longer than 15 minutes. __ Landlord and Tenant will perform a walkthrough inspection of the home upon move in and move out notating any pre or post existing damage, or maintenance issues. __ Landlord and Tenant agree to all obligations as outlined in Oregon Revised Statutes, summarized briefly: Tenant agrees to operate all electrical, plumbing and other appliances in a safe manner. Tenant agrees to keep property safeguarded against damage, destruction, loss, removal and theft. __ No locks will be changed on any door without written permission from Landlord. __ In case of condemnation or purchase of all or any substantial part of the premises by any public or private corporation with the power of condemnation, this agreement may be terminated, effective on the date passion is taken, by either party hereto on written notice to the other and in that case the Tenant shall not be liable for any rent after the termination date. Tenant shall not be entitled to and herby expressly waives any right to any part of condemnation award or purchase price and Tenant shall have no claim against Landlord or otherwise for the value of any unexpired term on this rental agreement. __ This agreement may be terminated by the Landlord for any reason at any time with a 90 day notice to vacate from the Landlord. __ It is the intention and agreement of the Landlord and the Tenant that the rental reserved by this agreement have been fixed in contemplation that both parties shall fully provide their own insurance protection at their own expense, and that both parties shall look to their respective carriers for the reimbursement of any such loss, and further, that the insurance carriers involved shall not be entitled to subrogation under any circumstances against any party to this agreement. Neither the Landlord nor Tenant shall have any interest or claim in the other's insurance policy or policies, or the proceeds thereof, unless specifically covered therein as a join assured.
