Tenant Terms and Conditions
1. Rent Payment
Tenant shall pay all rent, fees, and other charges in the full amount and by the due date specified in this Lease.
Payment shall be made in the form(s) approved by Landlord.
Rent is considered received only when actually collected by Landlord.
Any fees owed by the tenant (e.g., HOA fines, repair charges, lockout fees) must be paid before rent is applied. Rent payments will first cover outstanding fees. If full rent is not received after fees are applied, it may result in a late fee or non-payment notice.
2. Use of Premises
Premises shall be used exclusively for residential purposes and only by the persons listed as occupants on this Lease.
Guests may stay no more than 7 consecutive days or 14 total days in any 12-month period without written consent.
Guests exceeding these limits may be considered unauthorized occupants.
Subletting, assignment, or renting the Premises, in whole or in part, is prohibited without Landlord's written approval.
3. Compliance with Laws and Rules
Tenant shall comply with all federal, state, and local laws, ordinances, regulations, and any community rules.
Tenant shall not engage in illegal, hazardous, or nuisance activities, including drug use, harassment, or unlicensed business operations.
4. Maintenance and Care of Premises
Tenant shall keep the Premises (including appliances, fixtures, and landscaping) clean, sanitary, and in good repair.
Tenant must promptly notify Landlord in writing of any condition requiring repair or maintenance.
Tenant is responsible for repair costs due to damage caused by Tenant, occupants, guests, pets, or invitees (excluding normal wear and tear).
Any approved alterations become the property of the Landlord unless otherwise agreed in writing.
Tenant shall not place holes in the walls, including for hanging pictures, shelving, or fixtures, without Landlord's prior written consent. 1" finishing nails are allowed. No Adhesive. Tenant shall not paint, wallpaper, or otherwise alter the color, finish, or surface of any walls or ceilings. Any unauthorized alterations will be repaired or restored at Tenant's expense.
Specific Maintenance Responsibilities:
Air Filters Tenant must replace or clean air filters monthly. If HVAC repairs result from filter neglect, tenant agrees to cover the full cost with the next rent payment.
Garbage Disposal No fibrous foods, grease, bones, or non-food materials may be disposed of. Tenant covers repair costs due to misuse.
Light Bulbs & Batteries Tenant is responsible for replacing interior light bulbs and smoke detector batteries.
5. Pets and Animals
A $300 non-refundable per pet deposit is required.
An additional monthly pet fee of $35 applies per pet
Maximum of two (2) dogs permitted. No weight limit and no breed restrictions apply.
No puppies, Dog must be 1+ year old.
Dogs must have no history of aggressive or destructive behavior and must not be trained for protection or guard purposes.
Cats and other animals are not permitted.
Damage Responsibility Tenant is liable for all pet-related damage (scratches, stains, chewing, odor, etc.).
6. Parking and Vehicles
Vehicles may only be parked in designated spaces.
No parking in fire lanes, blocking driveways, or in spaces assigned to others.
Inoperable or unregistered vehicles are prohibited.
7. Safety and Security
Tenant shall not tamper with or disable smoke detectors, CO detectors, fire extinguishers, or safety devices.
Lockout Assistance $50 fee applies if the Landlord is required to provide access.
8. Property Inspections
Landlord may conduct walk-throughs per year with 48-hour notice. Inspections will check for unauthorized pets, smoking, property damage, unapproved modifications, air filter condition, carpet wear, leaks, landscape upkeep, and overall lease compliance.
In emergencies, Landlord may enter without prior notice.
9. Smoking & Marijuana Policy
No smoking or marijuana use inside the home or garage.
Tenant is responsible for all smoke-related damage or odor removal.
Tenant may not grow, cultivate, or manufacture marijuana on the Premises for any purpose.
10. Notice of Renewal
Tenant is required to provide a minimum of 60 days' written notice prior to the lease end date if they do not intend to renew the lease. Failure to provide proper notice may result in continued rent responsibility or forfeiture of part of the security deposit, as outlined in the lease agreement.
11. Showings During Final 30 Days
Tenant agrees to accommodate property showings to prospective tenants or buyers during the final 30 days of the lease term. Landlord will provide at least 24 hours' notice prior to each showing. Showings will be scheduled at reasonable times and coordinated with the tenant when possible.
12. Lease Break / Buyout
If tenant breaks the lease, a $500 lease buyout fee is due. Tenant remains responsible for rent until a new tenant moves in.
13. End of Tenancy
Upon termination, Tenant shall: Vacate the Premises by the agreed date. Return all keys, remotes, and access devices. Remove all personal property. Leave the Premises clean and in good repair (normal wear and tear excepted). Pay for repair of any damage beyond normal wear and tear.
