Tenant Terms and Conditions
1. Rent Payment: Tenant shall pay all rent, fees, and other charges in the full amount and by the due date specified in this Lease. Payment shall be made in the form(s) approved by the Landlord. Rent is considered received only when actually collected by the Landlord.
2. Fee Payment Policy: Any fees owed by the tenant (e.g., repair charges, late fee, and or lockout fees) must be paid before rent is applied. Rent payments will first cover outstanding fees. If full rent is not received after fees are applied, it may result in a late fee or non-payment notice
3. Use of Premises: Tenants shall use the Premises exclusively for residential purposes and only by the persons listed as occupants on this Lease. No other individuals may reside at the Premises without prior written consent from the Landlord. Tenants shall not sublet (eg, Airbnb), assign, or rent the Premises, in whole or in part, without Landlord's prior written approval.
4. Maintenance and Care of Premises: Tenants shall keep the Premises, including all appliances, fixtures, and landscaping (if applicable), clean, sanitary, and in good repair at all times. Tenants shall immediately notify the Landlord in writing of any condition that requires repair or maintenance. Tenants shall be responsible for the cost of repairs caused by Tenant, occupants, guests, pets, or invitees, excluding normal wear and tear.
5. Air Filter Maintenance: Tenants must replace or clean air filters monthly. If HVAC repairs result from filter neglect, the tenant agrees to cover the full cost with the next rent payment.
6. Garbage Disposal Use: No fibrous foods, grease, bones, or non-food materials may be disposed of in the garbage disposal. Damage caused by misuse is the tenant's responsibility.
7. Light Bulbs & Batteries: Tenant is responsible for replacing interior light bulbs and smoke detector batteries during the lease term.
8. Alterations and Improvements: Tenant shall not make any alterations, additions, painting, or improvements to the Premises, including hanging things on the wall, installation of locks, alarm systems, satellite dishes, or fixtures, without prior written consent from the Landlord. Any approved alterations shall become the property of the Landlord upon installation unless otherwise agreed in writing.
9. Pets and Animals: No pets or animals shall be kept on the Premises without Landlord's prior written consent and payment of any required pet deposit or fee. Approved pets shall be maintained in accordance with all applicable laws, vaccinated as required, and shall not cause damage, nuisance, or disturbance. Tenants shall promptly remove and properly dispose of pet waste.
10. Pet Damage Responsibility: Tenant is fully responsible for any damage to the property caused by the pet, including scratches, stains, chewing, or odor removal.
11. Pet Limit: No more than one or two dogs allowed.
12. Guests and Visitors: Tenants may have guests on the Premises for a period not to exceed seven (7) consecutive days or fourteen (14) days in any twelve (12) month period without Landlord's written consent. Any guest exceeding these limits may be deemed an unauthorized occupant and subject to removal or lease violation.
13. If the tenant is locked out and requires landlord assistance, a $50 lockout fee will apply.
14. Entry by Landlord: Tenant shall permit Landlord or Landlord's agents to enter the Premises at reasonable times and with proper notice (48 hours) for inspections, repairs, maintenance, or to show the property to prospective tenants, buyers, or contractors. In emergencies, the Landlord may enter without prior notice.
15. Prohibited Activities: Tenants shall not engage in any illegal, hazardous, or nuisance activities, including marijuana usage/growing, excessive noise, harassment, or operation of unlicensed businesses from the Premises.
16. Smoking Policy -Smoking is strictly prohibited inside the home and garage. Tenant is responsible for any smoke-related damage or odor removal, including the use of marijuana.
17. End of Tenancy: Upon termination of the Lease, Tenant shall: (a) Vacate the Premises by the agreed date; (b) Return all keys, garage remotes, and access devices to Landlord; (c) Remove all personal property; (d) Leave the Premises in a clean, broom-swept condition and in good repair, normal wear and tear excepted; (e) Pay for the repair of any damage caused during the tenancy beyond normal wear and tear.
18. Notice of Renewal: Tenant is required to provide a minimum of 60 days' written notice prior to the lease end date if they do not intend to renew the lease. Failure to provide proper notice may result in continued rent responsibility or forfeiture of part of the security deposit, as outlined in the lease agreement.
19. Lease Break / Buyout: If the tenant breaks the lease, a $500 lease buyout fee is due. Tenant remains responsible for rent until a new tenant moves in.
20. Showings During Final 30 Days: Tenant agrees to accommodate property showings to prospective tenants or buyers during the final 30 days of the lease term. The landlord will provide at least 24 hours' notice prior to each showing. Showings will be scheduled at reasonable times and coordinated with the tenant when possible.
