(No deposits needed with utility companies.) Bills for unit's electric and gas usage to be paid within one week after presentation by Owner. First month's rent to be paid before move into unit (prorated if not on first). Security deposit of $2850 can be paid in two installments: 1st when move into unit and 2nd with second's month's rent. Rent is due on the first of each month, and if not received by then, an additional charge of 10% of the monthly rental rate may be added. Small dogs and cats allowed. Any violation of lease, including the following incidents, may result in termination of the lease. Once lease is terminated, the Tenant must vacate unit within two weeks if requested by Owner and unless Owner approves alternate timeline. Incidents that may cause termination of lease: 1) Lease of ADU is for 1 year with possibility of renewal, but no subleasing of unit or extended stay visitors, unless approved by Owner. No sharing of unit with others who are not listed as tenants in this lease agreement, unless prior approval by Owner. 2) Rent and/or late charge remains unpaid by the 20th of the month. If lease is terminated, Tenant is expected to vacate unit within two weeks, unless Owner approves alternate timeline. Tenant must still pay the past-due rent and late charge, as well as any prorated rent for additional time in unit for which rent has not already been paid. All electric and gas charges must also be paid through date of departure. 3) Failure to pay unit's electric and/or gas charges within 21 days after presented by Owner. If lease terminated, Tenant must still pay the past-due electric and gas charges, as well as pay for additional utility usage up to time when unit is vacated. 4) Failure to pay $2850 security deposit in full by the end of the second month after move-in. 5) No smoking inside ADU, nor outside of unit less than 30 yards from main house and ADU,. 6) No illegal drug possession or usage anywhere on property. No use of recreational marijuana anywhere on property. Medicinal marijuana may be used outside unit, if at least 30 yards from main house and ADU. All parties and other gatherings must be approved by Owner at least 1 week before event. Maximum number of tenants and guests is 10, unless exception granted by Owner. Gathering must not be excessively noisy, as determined by Owner, and disband by 11 pm. Tenant responsible for removal of trash and any clean-up related to gathering. If damage occurs to rental unit, main house, or any part of entire property because of actions or negligence of Tenant or his/her guests, repairs must be made within two weeks and payment made by Tenant. Quality of work will be inspected by Owner and must receive his approval, or additional repairs may be scheduled by Owner at Tenant's expense. Non-violation Requests by Owner: Park on main property where designated by Owner. Inform Owner if your vehicle leaks oil or other fluids and do not park on cement driveway at any time. Vehicle maintenance and repairs must have Owner's approval to be done on property, and must be done where Owner designates. Separate trash items for landfill and items for recycling, and place in designated containers after proper preparation, as outlined by waste management company of San Diego county. No fee for trash and recycling pick-up (done weekly).
