Please note: Any real estate commission due with regards to this transaction shall be payable one hundred percent (100%) upon (i) Tenant opening for business in the Premises and (ii) Landlord's receipt of Tenant's first month's rent. Notwithstanding the foregoing, if Tenant's lease contains contingency language that ultimately proves to be unattainable or cannot be waived and the lease is terminated, this Agreement shall be null and void and no commission shall be due.
