TERMS AND CONDITIONS:
Form of Payment. Paid through Platform prior to arrival. Or Electronic payment through Apple Pay, Pop money, Cash App, Pay Pal or Zelle. If there are any fees these are to be paid by Lessee. Cash accepted at check in.
Occupants. The said premises shall be occupied by no more than 1 adult (may permit more for additional fee who must sign the Hold Harmless Waiver and sign liability paperwork and do a walkthrough of apartment & property.
Pets. No Pets. (May make exceptions with additional deposit). Dogs must be walked on leash & pet insurance required. If a pet bites anyone or other animal that was not provoked this is grounds for the lease to be terminated. Any damage caused by a pet of Lessee is the financial responsibility of the Lessee. Pet should be well behaved and not bark excessively. Pet should not be left unattended in unit in case of power outages as it can get extremely hot in unit.
Ordinances and Statutes. Lessee shall comply with all statutes, ordinances, and requirements of all municipal, state, & federal authorities now in force, or which may hereafter by in force, pertaining to the use of the premises.
Rules and Regulations. Lessee shall comply with all rules and regulations of the Lessor's which are as follows: Guest/Lessee must sign hold harmless liability waiver, have their own medical coverage, provide license/passport, proof of auto insurance for the 1 allowed auto that has bodily injury & property injury liability. Any guest of Lessee must sign a Hold Harmless for themselves and any minors accompanying them, park outside of gate or if parking on property provide insurance and drivers license prior to arriving or at arrival (we can provide waiver if needed) text to _________ pool can be used during day light hours and in the evening at the invite of the Lessor's (children must be accompanied by an adult), coasters must be used on all furniture, toilet, sink and shower must be scrubbed weekly due to well water stains, no grease or food put down sinks or toilets, only septic safe toilet paper to be used in toilet, air filter should be changed/washed monthly for anybody staying over a month, There is to be no smoking in the unit or anywhere near the main residence and all cigarette butts must be discarded in a trash can. There is to be no trash thrown on the ground only in a garbage can. Lessee will take their designated garbage can to the road for dumping early Tuesday mornings and Friday mornings. When home we ask that you set the air conditioner to no less the 72 degrees and if leaving for a long period, we ask that you put it up to 78. No additional air conditioners or high-powered appliances are to be installed or used.
Parking. Lessee can park outside of gates or on property but not blocking garages or any other vehicles or trailers. It is further agreed that Lessee will keep at least Florida State minimum insurance requirements of $10,000 for both bodily injury and property damage while parking vehicle on the property and will supply a copy of the insurance to Lessor. Any guest can park outside of gate or also provide insurance, I.D. and sign hold harmless prior to arrival. It is agreed that if any property damage or bodily injury is caused by lessor's vehicle that a timely claim will be filed with Lessee's insurance company or through booking platform. If parking under tree's limbs can fall and damage vehicle. Lessor is not responsible for damage caused by falling trees/limbs.
Keys. Lessee will be given code or 1front door key & 1 remote for the gate. If any keys or remote are lost or not returned there will be a Twenty Dollar ($20.00) charge per key and ($40.00) charge for gate remote.
Locks. Lessee agrees not to change locks on any doors. Lessee also agrees to keep the door locked when not occupying the unit. If theft were to occur due to the unit not being locked the Lessee agrees to pay to replace anything that is stolen with like furnishings of the same value.
Upkeep of the Premises & Furnishings. Lessee shall always keep & maintain the premises in a clean & sanitary condition, & upon the termination of the tenancy shall surrender the premises to Lessor in as good condition as when received, ordinary wear and damage by the elements excepted. If damage to furnishings occur the Lessor shall be responsible for repairing or replacing. Due to well water on property toilets, shower and sinks need to be cleaned weekly. No grease/food in sinks or toilet and only septic safe toilet paper in toilet.
Repairs or Alterations. Lessee shall be responsible for damages caused by his negligence and that of his family or invitees and guest or by inside or outside pets. Lessee shall not paint, paper, or otherwise redecorate or make alterations to the premises without the prior written consent of Lessor. All alterations, additions, or improvements made to the premises with the consent Lessor shall become the property of Lessor and shall remain upon the surrender of the premises.
Assignment and Subletting. Lessee shall not assign this Agreement or sublet any portion of the premises.
Utilities. Included.
Deposit. The deposit can be used for cleaning fees, damage, discounted rent if tenant leaves before agreed time and rent was discounted or ordered movies/tv shows by Lessee on Lessor's account.
Right of Entry. Lessor reserves the right to enter the demised premises at all reasonable hours for the purpose of inspection, and whenever necessary to make repairs, alterations or to maintain the demised premises. Lessee hereby grants permission to Lessor to show the demised premises to prospective purchasers, mortgagees, tenants, workmen, or contractors at reasonable hours of the day.
Deposit of Refunds. The balance of all deposits shall be refunded within Three (3) weeks from date possession is delivered to Lessor, together with a statement showing any charges made against such deposits by Lessor. Lessor shall return the keys to Lessor in person or by a prearranged agreement. Lessor shall also let Lessee know where to send the refund to.
Termination. This agreement will terminate on ______________ by 11:00 am.
Attorney's Fees. The prevailing party in an action brought for the recovery or rent or other moneys due or to become due under this lease or by reason of a breach of any covenant herein contained or for the recovery of the possession of said premises, or to compel the performance of anything agreed to be done herein, or to recover for damages to said property, or to enjoin any act contrary to the provisions hereof, shall be awarded all of the costs in connection therewith, including, but not by way of limitation, reasonable attorney's fees.
Additional Terms and Conditions. Unit is being supplied with appliances and furnishings which include king size bamboo bed & bedding set, refrigerator, oven, microwave oven, 2 large streaming tv's, coffee pot, toaster, pots & pans, utensils, cups/mugs, linens for beds, towels, fans, heater. If anything is missing or damaged lessee agrees to replace with same item.
Smoking. This unit is not to be smoked in by Lessee any of Lessee's invitees.
If Leaving the Unit for More Than A Few Days. It is agreed that Lessors will be notified.

Hold Harmless Blanket Waiver & Release for Dawn & Robert Pittard & Dalton Jewett
In consideration of being a renter/guest of Rob & Dawn Pittard & Dalton Jewett, it is agreed that for any date & time as follows:
I understand & acknowledge there are risks & dangers by my families or my presence at or on any property, vehicle, all-terrain vehicle, watercraft, campers/trailers, owned by Dalton Jewett & Dawn & Robert Pittard & my/our participation at any of the above may result in injury or illness & these risks & dangers may be caused by the negligence of others, accidents, breaches of contract, the forces of nature or other causes. These risks & dangers may arise from foreseeable or unforeseeable causes; & by my attendance or any of my family member's attendance including minors, I hereby assume all risks & dangers & all responsibility for any losses or damages, whether caused in whole or in part by the negligence or conduct of its owners, or by any other person or guest. I have been advised that I should have my own rental insurance and health insurance for myself and family members.
It is understand that if myself or my family members ride in/on any vehicle, all-terrain vehicle/atv, watercraft, or recreational vehicle/camper/trailer owned by Dalton Jewett & Dawn & Robert Pittard that insurance may not exist that provides for medical benefits for uninsured motorist at fault or may be very little & that I/We will not hold Dalton Jewett, Dawn & Robert Pittard liable for any medical bills or any damages if an at fault uninsured motorist where to strike any of the above.
It is understood there may be alcohol present & it is incumbent on me to drink responsibly & not drive while drinking.
I release Dalton Jewett, Dawn & Robert Pittard or any insurer of Dalton Jewett, Dawn & Robert Pittard, from any liability associated with any acts directly or indirectly that could occur at or on any property/premises owned by Dawn & or Robert Pittard even if alcohol is present from any costs, damages, & medical bills.
It is agreed I will not serve or help facilitate any minor in obtaining alcohol/drugs while at/on any property owned by Dalton Jewett, Dawn & Robert Pittard.
It is understood that if owners feel that too much alcohol has been consumed, I may be asked to surrender keys to vehicle and that if a renter I/we may not be permitted to pull off with a rented vehicle/trailer.
I/We understand that I/We cannot hold Dawn Pittard & Robert Pittard liable if any lawsuit is brought about due to bodily injury or property damage by anybody else. I also understand that Dawn Pittard & Robert Pittard cannot be held liable for my/our or other persons/guest alcohol consumption.
I hold harmless Dawn & Robert Pittard if myself or a family member were to be hurt by anybody, any animal/creature/insect, or anything that may be located on their property or anywhere in a rented trailer may be kept. I understand guest I bring onto their property are also bound by this waiver & it is my responsibility to provide this waiver to said person's & I will notify them of their hold harmless waiver of rights.
If my family member or I or child of mine stay in a trailer/camper owned by Dawn Pittard & Robert Pittard whether it is on or off any property owned by Dawn Pittard & or Robert Pittard, I/we hold them harmless for any injury or illness that could be caused by negligence or foreseeable or unforeseeable causes or forces of nature. It is noted that pest control is used inside & outside of residences & campers owned by Dawn & Robert Pittard & it is my/our responsibility to make sure any children I/we bring do not ingest pest control. It is also noted that there may be nails, glass & holes on the property due to dogs digging, construction & auto accidents & that flashlights should be used & shoes if walking in the yard
I also hold harmless Dawn & Robert Pittard and any of their insurers if my child where to be hurt at any or on any of the properties owned by Dawn & Robert Pittard or while on or in any vehicles, marine watercraft, canoe, campers/trailers, trampolines, pools, ponds or all-terrain (atv) vehicle owned by Dawn & Robert Pittard.
I hold harmless Dawn & Robert Pittard for any vehicle/trailer that I may leave at their property that may be stolen or damaged.
I on behalf of myself, representatives, heirs, & assigns hereby voluntarily agree to release, waive, discharge, hold harmless defend & indemnify Dalton Jewett, Dawn Pittard & Robert Pittard & all insurer, owners, agents, officers, & employees from any & all claims, actions or losses for injury, property damage, death, costs or loss or services or otherwise which may arise out of my presence & I specifically understand that I am releasing, discharging & waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct by the owners, agents, officers & employees of Dalton Jewett, Dawn Pittard & or Robert Pittard.
Dalton Jewett, Dawn & Robert Pittard reserve the right to refuse admission onto any property titled to them or to expel me from any property titled or owned by them & to a reasonable examination to ensure compliance of facility rules.
I acknowledge I am signing this waiver while not under the influence of any alcohol or drugs.
