All capitalized terms used in this Addendum have the meanings given such terms in the Lease. ACTIONS OF RESIDENTS - Tenant will dispose of trash only in designated areas. - Tenant will promptly report any repair or maintenance problems to Landlord or Managing Agent (if any). KEYS N/A USE OF PREMISES AND COMMON AREAS - Tenant may not, without written consent of Landlord, drill holes or use nails, hooks, and screws on the property. - Tenant may not fasten anything to the fixtures, appliances, or to the interior or exterior of the property. - Any balcony or porch included in Property, or adjacent to Property, may not be altered by Tenant or used to store their personal belongings. - Tenant will comply with all weight restrictions on balconies and porches and will not overload them. - No laundry or other items will be hung from any window, balcony, or porch. - Tenant may not bring anything onto the property or grounds which could increase the risk of fire (e.g., flammable chemicals). - No wax candles will be used on the property. - Tenant may not cook or barbecue on any porch or balcony or within 15 feet of any building. - Tenant won't place any sign, advertisement, or notice so that it's visible outside the property. - Tenant won't add or change any locks without prior written consent of Landlord. - Waterbeds and other water furniture are prohibited. Also, unusually heavy items like pianos and safes are only allowed if Landlord agrees that the weight is reasonable for the property's floor. OTHERS Rules 1. No parties or events allowed. 2. No smoking allowed. 3. No pets allowed. 4. No unregistered guests allowed. 5. Respect the noise level. Quiet time between 9 pm -7 am. 6. Enjoy your meal in the dining area. 7. Respect check-in (4:00 pm) and check-out (11:00 am) times. 8. Report any damages and/or breakages in a reasonably timely manner. Damages exceeding the security deposit amount must be paid by guests. 9. Guests will be charged for stained towels or linens. 10. Wash the dishes, and throw out the garbage before checkout. Lease Addendum Purpose: The purpose of this addendum is to give you, the Tenant, specific examples of things you are responsible for maintaining during the term of your lease so that you will have a better understanding of your obligations under the lease. It does not list everything you are responsible for maintaining. Depending on what type of residence you are leasing (apartment, single-family house, duplex, condominium, etc.) and what kind of improvements it contains, some items on the following list may not apply to you. GOOD HOUSEKEEPING IS EXPECTED OF EVERYONE. VEHICLES You and your guest may park only in designated areas and not on the grass Keep driveways free of oil and grease Do not keep inoperable or unlicensed vehicles on the property You and your guest may not work on motor vehicles in the parking lot of the complex LIGHTS, FILTERS, FUSES, ETC Replace burned-out electric light bulbs and blown fuses Reset tripped circuit breakers and oven timers Leave working light bulbs in all electrical sockets at end of tenancy Replace heating/air conditioning filters at least every three months Leave new filter in the air return at end of tenancy FIRE SAFETY Do not store ashes in trash cans Do not use kerosene heaters or space heaters Do not use grills within 10 feet (horizontally or vertically) of anything that will burn Maintain batteries with smoke detectors Notify management of faulty smoke detectors Keep a fire extinguisher within the unit PEST EXTERMINATION Keep the premises free from visible infestations of roaches, ants, hornets, bess, ices and other pests Immediately notify management of an infestations of insects or rodents Keep food contained within containers or enclosures that are pest proof Maintain a clean space free of crumbs, scraps that could attract pests Make unit available for regular (typically monthly) pest treatments and inspections LOCKS Do not change or remove any existing locks or add any additional locks without Agent's written permission MOLD AND MILDEW To help prevent mold and mildew from accumulating in the Premises Clean and dust the premises on a regular basis Remove moisture on windows, walls, and other surfaces as soon as possible Immediately notify management of any evidence of a water leak or excessive moisture or standing water Immediately notify management of the presence of mold, mildew or similar growth in the premises after you have attempted to remove it using common household cleaning solutions or anti-microbial products Immediately notify management of any malfunction of any part of the heating, ventilation, air conditioning, plumbing or laundry systems Immediately notify management of any inoperable doors or windows EXTERIOR MAINTENANCE Keep the porches, patios, balconies and front and back yards free of clutter, unsightly items and other personal articles REPAIRS If you do not keep an appointment to be home for maintenance or repair work, the worker's time will be charged to you If you request repairs and the worker is unable to enter due to extra locks or chains on the door not being removed, the worker's time will be charged to you You will be charged for any service calls to repair items that you are responsible for maintaining You may not authorize any maintenance or repairs at Landlord's expense You will not be reimbursed for any unauthorized repairs that Landlord is responsible for MILITARY STATUS ADDENDUM NOTE: This form may be used to confirm that a prospective tenant is NOT currently in military service. If a prospective tenant is in military service, consideration may be given to having him or her sign a "Waiver of Rights" form (standard form 435-T). This Addendum is attached to and made a part of the Residential Rental Contract ("Contract") between Landlord and Tenant for the Premises. RECITALS 1. The Servicemembers Civil Relief Act (50 U.S.C. Section 3911 et seq) ("SCRA") provides for the temporary suspension of any civil action or proceeding against a servicemember during his or her military service under certain circumstances. 2. In the event Landlord is required to file an eviction proceeding against Tenant for breach of the Rental Contract (called "summary ejectment"), Landlord will be required to file a Servicemembers Civil Relief Act Affidavit stating whether or not the defendant is in military service and showing necessary facts to support the affidavit. 3. Tenant desires to confirm that Tenant is not currently in military service and to agree to notify Landlord in the event Tenant enters into military service after this Addendum is signed. AGREEMENT 1. Tenant Representation. Tenant represents that Tenant is not currently in military service with the Army, Navy, Air Force, Marines, Coast Guard or National Guard as defined in the SCRA and is not a commissioned officer of the Public Health Service or the National Oceanic and Atmospheric Administration. 2. Tenant Agreement. Tenant agrees to promptly notify Landlord in writing if Tenant enters into military service as defined in paragraph 1 above after the date this Addendum is signed. 3. Tenant Understanding. Tenant acknowledges and understands that in the event Landlord files an eviction action against Tenant for breach of the Rental Contract and Tenant has not notified Landlord that Tenant has entered into military service, Landlord may use Tenant's representation that he or she is not in military service as of the date of this Addendum and has not subsequently notified Landlord after the date of this Addendum that he or she has entered into military service as evidence that Tenant is not in military service for purposes of completing a Servicemembers Civil Relief Act Affidavit. IN WITNESS WHEREOF, Tenant and Landlord hereby agree to this Rules Addendum.
