1. Property. Landlord rents to Tenants, and Tenants lease from Landlord, the Property located at 19921 E 46TH ST S, Broken Arrow, Oklahoma 74014 (the "Property").
2. Term. The term of this Agreement shall commence on May 1, 2024, and shall continue for a period of one year (12 months), unless sooner terminated as provided herein.
3. Rent. Tenants shall pay to Landlord a monthly rent of Two Thousand Two Hundred Dollars ($2.200.00) for the Property. The first month's rent shall be due on May 1, 2024, and the remaining months' rent shall be due on the 5th day of each month thereafter. Rent shall be paid by wire transfer, check, or cash.
4. Security Deposit. Tenants shall deposit with Landlord a security deposit in the amount of Two Thousand Five Hundred Dollars ($2,500.00). The security deposit shall be returned to Tenants within thirty (30) days after the termination of this Agreement, less any amounts due to Landlord for unpaid rent, damages to the Property, or other charges permitted under this Agreement.
5. Utilities. Tenants shall be responsible for all utilities (including, but not limited to, water, sewer, gas, electricity, and trash removal) for the Property.
6. Maintenance. Tenant shall be responsible for all routine maintenance including, but not limited to, stoppage or sewer because of misuse, broken water pipes/fixtures due to neglect or carelessness of Tenant, and replacement of any burned-out light bulbs. Tenant understands that they, at their expense, shall keep sinks, lavatories, and commodes open unless stoppage is due to defective sewer systems. Tenant shall report any water leaks to Landlord immediately.
Tenant is responsible for changing HVAC filters regularly (at least every six months), and shall be responsible for HVAC servicing fees if excessively dirty filters are present at any time. Tenant shall also be liable for damage to HVAC systems caused by dirty or missing filters and damages resulting from unreported problems.
Tenant agrees to notify Landlord promptly in the event of needed repairs.
7. Yard Maintenance. Tenant shall be responsible for the maintenance and care of the yard, including mowing, watering, trimming of shrubbery, and keeping the yard free from debris. Shrubbery trimming should be done regularly to maintain the aesthetic appearance of the Property.
8. Pets. Tenants are allowed to have one (1) dog on the Property. No cats are allowed. Tenant shall be responsible for any damages caused by pets and shall keep the Property clean and free from pet-related odors.
9. Smoking. Smoking is prohibited inside the Property. Smoking outdoors is permitted.
10. Assignment and Subletting. Tenants may not assign this Agreement or sublet the Property without the prior written consent of Landlord.
11. Termination. This Agreement may be terminated by either party upon ninety (90) days' written notice to the other party. If Landlord terminates this Agreement, Landlord shall have the right to schedule tours of the Property to prospective tenants upon providing Tenants with twenty-four (24) hours' notice.
12. Inspections: Landlord or their authorized agents shall have the right to enter the Property at reasonable times for the purpose of conducting inspections, making repairs, or showing the Property to prospective tenants or buyers, with reasonable advance notice to Tenant. The Landlord shall provide at least 24 hours' notice, except in case of emergency.
13. Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
14. Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma.
15. Severability. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from this Agreement and the remaining provisions shall remain in full force and effect.
16. Waiver. No waiver of any provision of this Agreement shall be effective unless in writing and signed by both parties.
17. Notices. All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered in person, upon the first business day following deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed as follows:
