Residential Lease Terms
1. Rent, Term, and Security Deposit
1.1 Rent Amount and Due Date
Monthly rent is $3,000.00 ("Rent"). Rent is due on the 1st day of each month. If the Lease does not begin on the 1st, Rent will be due each month on the calendar day corresponding to the move-in date.
1.2 Method of Payment
Rent shall be paid in lawful U.S. currency. Zelle is the preferred method of payment, or another method approved by Landlord in writing.
1.3 Late Fees
If Rent is not received within 10 days after the due date, a late fee will be charged in the maximum amount and manner permitted under New York State law. Late fees are in addition to, and not in lieu of, Rent.
1.4 Returned Payment / NSF Fee
Tenant shall pay a $35.00 fee for any check or payment that is returned, declined, or otherwise not honored by the financial institution, in addition to any applicable late fees.
1.5 Security Deposit
Tenant shall pay a security deposit equal to one (1) month's rent, in the amount of $3,000.00, to be held by Landlord in a separate account as required by New York State law. The security deposit may be applied by Landlord to unpaid Rent, unpaid utilities, and the cost of repairing damage beyond ordinary wear and tear, cleaning, and any other charges permitted by law.
Within the time period required by New York State law after Tenant vacates and returns possession, Landlord will provide an itemized statement of any lawful deductions and return any remaining balance of the security deposit to Tenant.
1.6 Lease Term and Renewal
The Lease term shall be for 5 - 6 months, commencing on November 2025 and ending on May 15, 2026.
At least 60 days (2 months) before the end of the Lease term, Landlord and Tenant will communicate (in writing, text, or email) to discuss:
Whether the Lease will be renewed or terminated, and
Any proposed increase or change in Rent or other terms.
There is no automatic renewal; any extension shall be in writing and agreed upon by both parties.
2. Utilities, Lawn Care, Snow Removal, and Pool
2.1 Utilities
All utilities are the responsibility of Tenant. Tenant shall place all applicable utility accounts in Tenant's name and keep them current throughout the Lease term.
2.2 Lawn Care and Snow Removal
Owner is responsible for routine lawn care, including mowing and general yard maintenance, and for snow and ice removal from driveways
3. Use and Occupancy
3.1 Maximum Occupancy
Occupancy of the premises is limited to no more than ten (10) residing there on a full-time basis, as approved by Landlord.
3.2 Guests
Guests are permitted for normal social visits. However, any person staying more than thirty (30) consecutive days, or who repeatedly stays for extended periods such that they effectively reside at the premises, shall be considered a Tenant and must be approved in writing by Landlord and added to the Lease.
3.3 Quiet Enjoyment and Nuisance
Tenant shall not engage in, permit, or tolerate any excessive noise, nuisance, or disturbance that interferes with the peaceful enjoyment of neighbors or other residents. Tenant shall not use the premises for any illegal activity or in any manner that violates applicable laws, ordinances, or regulations.
3.4 Alterations
Tenant shall not paint, make structural changes, or install fixtures (including mounting TVs in a way that damages walls) without Landlord's prior written consent. No painting is allowed without Landlord's written approval.
4. Maintenance, Repairs, and Access
4.1 Landlord Responsibilities
Landlord is responsible for repairs related to the structure and major systems of the property and for items that fail due to ordinary wear and tear, consistent with New York State law.
4.2 Tenant Responsibilities
Tenant is responsible for:
Replacing light bulbs, smoke detector batteries (unless prohibited by law), and other minor consumables.
Keeping the premises clean and sanitary and using all fixtures, appliances, and systems in a reasonable manner.
Repairing or paying for any damage caused by Tenant's negligence, misuse, or the actions of Tenant's guests or pets, beyond ordinary wear and tear.
4.3 Reporting Problems
Tenant shall promptly report any maintenance issues, leaks, or damage to Landlord. Texting is preferred for routine communication; however, Tenant shall use a reasonably prompt method for emergencies.
4.4 Landlord's Right of Entry
Landlord may enter the premises at reasonable times for inspections, repairs, maintenance, and to show the property to prospective tenants or buyers. Except in emergencies, Landlord will provide at least 24 hours' notice, typically via text, and will make reasonable efforts to coordinate with Tenant.
In the event of an emergency (such as fire, active leak, or other situation endangering persons or property), Landlord may enter without prior notice as reasonably necessary to protect the premises and occupants.
5. Appliances, Furnishings, and Partially Furnished Items
5.1 Included Appliances and Furnishings
The premises are partially furnished. The following appliances and/or furnishings are included for Tenant's use:

5.2 Repair and Maintenance of Included Items
Landlord will be responsible for the repair or replacement of included appliances and furnishings when failure is due to normal wear and tear. If damage or failure is caused by Tenant's misuse, negligence, or that of Tenant's guests or pets, Tenant will be responsible for the cost of repair or replacement.
6. Pets, Smoking, and Behavior
6.1 Pets
Pets are allowed only with Landlord's prior written approval. If approved:
An additional monthly pet fee will be charged per pet, as specified in this Lease or in a separate pet addendum.
No more than two (2) dogs are allowed.
No dogs over thirty (40) pounds are permitted.
Tenant must keep the yard free of dog feces, picking up after pets promptly and disposing of waste properly.
Tenant is responsible for any damage, odors, stains, or extra cleaning caused by pets, including damage to floors, doors, walls, lawn, or landscaping.
6.2 Smoking
Smoking of any kind is strictly prohibited inside the dwelling unit and in any indoor common areas. This includes, but is not limited to, cigarettes, cigars, pipes, vaping devices, and electronic cigarettes. Tenant is responsible for any costs associated with smoke or vapor damage, including cleaning, repainting, and deodorizing, if this provision is violated.
6.3 Prohibited Conduct
Tenant shall not engage in illegal activity on or near the premises. Any illegal activity, serious nuisance, or dangerous conduct is a material breach of this Lease and may be grounds for termination, consistent with New York State law.
7. Parking and Storage
7.1 Parking
Tenant is permitted to park in the following location(s):
Driveway spaces for up to 3 vehicles; no parking on lawn
No inoperable, unregistered, or unauthorized vehicles may be stored on the property. Landlord reserves the right to have unauthorized vehicles towed at the vehicle owner's expense in accordance with applicable law and posted notices.
7.2 Storage Areas
If Tenant is allowed use of any basement, garage, shed, or other storage area, such use is at Tenant's own risk. Landlord is not responsible for loss, damage, or theft of any personal property stored in these areas, except as required by law.
8. Insurance and Risk
8.1 Renter's Insurance
Tenant is required to maintain renter's insurance at Tenant's own expense, with coverage limits sufficient to protect Tenant's personal property and liability. Proof of such insurance shall be provided to Landlord upon request.
8.2 Landlord's Insurance
Tenant understands that Landlord's insurance does not cover Tenant's personal belongings. Tenant's property is stored at the premises at Tenant's own risk.
9. Early Termination, Default, and Remedies
9.1 Early Termination by Tenant
If Tenant terminates the Lease before the end of the Lease term without Landlord's written consent, Tenant may forfeit the security deposit, to the extent permitted by New York State law, and remains responsible for:
Leaving the property in excellent, clean condition in accordance with the move-out requirements of this Lease.
Any unpaid Rent and charges due under this Lease, and potentially Rent until the premises are re-rented, as allowed by law.
9.2 Non-Payment of Rent
If Tenant fails to pay Rent when due, Landlord may pursue all remedies available under New York State law, including but not limited to:
Charging applicable late fees and returned payment fees;
Applying the security deposit toward unpaid amounts and damages, to the extent permitted by law; and
Initiating legal proceedings for non-payment of Rent and/or eviction.
9.3 Other Defaults
Any substantial breach of the Lease (including illegal activity, serious damage, unauthorized occupants or pets, or other material violations) may constitute a default. Landlord may exercise all rights and remedies provided in the Lease and under New York State law.
10. Governing Law and Disclosures
10.1 Governing Law
This Lease shall be governed by and construed in accordance with the laws of the State of New York.
10.2 Required Disclosures
If applicable, Landlord shall provide any required lead-based paint disclosures (for properties built before 1978) and any other state- or locally-required disclosures, including but not limited to mold, radon, or other environmental disclosures.
