Also, no need to worry about the storm; the shutters on the patio provide excellent protection. :) Hawaii Lease Agreement This Lease Agreement (the "Agreement") is entered into by and between the Landlord and the Tenant(s) as identified below. 1. Parties: Landlord: [Name ] Tenant 1: [Name ____ ] Tenant 2: [Name ____ ] 2. Premises: The Landlord hereby leases to the Tenant(s) the residential premises located at 2240 Kuhio Avenue, #1307, Honolulu, Hawaii. 3. Term: The lease term shall commence on [Start Date] and terminate on [End Date], unless earlier terminated in accordance with this Agreement. 4. Rent: The Tenant(s) agrees to pay monthly rent of $2480 plus 4.712% GE tax ($116.85), for a total of $[2596.86], due on the First day of each month for that month's occupancy, without demand, deduction, or setoff, and payable to the Landlord's designated account. If rent is not received within three (3) days after the due date, the Tenant(s) shall incur a late fee as described in Section 5 below. 5. Late Fee and Interest: a. Late Fee: If the Tenant(s) fail to pay the full rent by the due date, the Tenant(s) shall pay a late charge of $198, which is deemed reasonable under Hawaii law. b. Interest: In addition to the late fee, any portion of the rent (including late fee) that remains unpaid more than five (5) days after the due date shall accrue interest at the rate of 12% per annum (i.e., 0.0329% per day, which is 12% 365) until paid in full. 6. Utilities and Services: The Landlord pays Parking, Water, Hot Water, TV cable, and Internet. The tenant(s) pays electricity. 7. Security Deposit: The Tenant(s) shall pay a security deposit of $2480 upon execution of this Agreement. The deposit shall secure the Tenant(s)' full performance of obligations hereunder. The deposit may be applied by the Landlord to unpaid rent, damages, cleaning, or other costs due to the Tenant(s)' default. Any balance shall be returned within the period required by Hawaii law after Tenant(s) vacates, provided the Tenant(s) have fully complied with this Agreement. No interest shall accrue or be payable on the security deposit. 8. Use and Occupancy: The Premises shall be used solely for private residential purposes by the Tenant(s) and occupants approved in writing by the Landlord. No unlawful, disruptive, or hazardous activities are permitted. The Tenant(s) shall comply with the House Rules of Royal Kuhio. 9. Maintenance and Repairs: The Tenant(s) shall keep the Premises clean, sanitary, and in good condition. The Tenant(s) shall promptly notify the Landlord of any damage or needed repairs. The Tenant(s) shall be liable for all costs to repair damages caused by the Tenant(s), occupants, or guests. 10. Alterations: The Tenant(s) shall not make alterations, additions, or improvements to the Premises without the Landlord's prior written consent. 11. Pets: Only one small dog under 15 pounds is permitted, subject to the Landlord's prior written approval. A $150 pet fee will be charged in addition to the monthly rent. The Tenant(s) must carry the dog in arms while in common areas and elevators; walking pets in shared spaces is strictly prohibited. No other pets are permitted. 12. Insurance: The Tenant(s) shall obtain and maintain during the entire term of this Lease a renter's insurance policy covering Tenant(s)' personal property and providing a minimum of $100,000 in liability coverage for injury or damage occurring within the Premises. The Tenant(s) shall provide the Landlord with a Certificate of Insurance, naming the Landlord as an additional interested party, prior to the commencement of the Lease. Failure to provide and maintain such insurance shall constitute a material breach of this Lease. 13. Entry: The Landlord may enter the Premises upon reasonable notice for inspection, maintenance, or to show the unit to prospective tenants or buyers, or immediately in case of emergency. 14. Default: Failure by the Tenant(s) to pay rent or otherwise comply with this Agreement constitutes default. Upon default, the Landlord may terminate this Agreement, regain possession, and pursue all remedies available. 15. Joint and Several Liability: If more than one Tenant signs this Lease, each Tenant is jointly and severally liable for the full performance of all obligations under this Lease, including but not limited to the full payment of rent. This means that if one Tenant vacates the Premises or fails to pay his or her share of the rent, the remaining Tenant(s) shall still be fully responsible for the entire monthly rent and all other obligations under this Lease. The Landlord may seek the full amount due from any one Tenant without first demanding payment from the other Tenant(s). 16. Notice of Potential ACM: The Tenant(s) acknowledges that the leased premises were constructed prior to 1980 and may contain building materials that are known or presumed to contain asbestos. These materials are generally considered safe and do not pose a health risk as long as they remain in good condition and are not damaged, disturbed, or removed. 17. Move-Out Obligations: Upon termination of this Lease, the Tenant(s) agree to restore the Premises to its original condition, reasonable wear and tear excepted. The Tenant(s) must ensure that all cleaning and pest control are properly completed prior to vacating the Premises. Failure to comply will result in deductions from the Security Deposit. When and if the Landlord rents to a new Tenant or sells the property, the Landlord and the Tenant(s) will work out a schedule for showing the property, provided that the Landlord gives the Tenant(s) at least twenty-four (24) hours' prior notice before any showing. 18. Governing Law: This Agreement shall be governed by and construed under the laws of the State of Hawaii. 19. Entire Agreement: This Agreement constitutes the entire understanding between the parties and may not be modified except in writing signed by both the Landlord and the Tenant(s).
