Payment must be received or postmarked before the 1st day of the month it is due.
If rent is not received prior to the 4th of the month, tenant agrees to pay a fee equal to 5% of the total due, plus an additional 1% per day for every day thereafter until the rent is paid. Neither ill health, loss of job, financial emergency, or other excuses will be accepted for late payment.
If the tenant's check is dishonored and returned to the Lessor unpaid for any reason, Lessee agrees to pay a returned check charge of 2% of the total due and accepts whatever consequences there might be in making a late payment. If for any reason a check is returned or dishonored, all future rent payments will be in cash or money order.
Rental payment for the first month shall be prorated if the above-described property is not available for occupancy by the date of the lease. The rental payment will be reduced by 3% for each day that the property was not available.
Tenant hereby agrees to accept property in its present state of cleanliness. They agree to return the property in the same condition or pay a cleaning fee of at least 15% of monthly rent value if the Lessor must have the property professionally cleaned.
1.) Use of Premises:
Lessee shall have the full and unrestricted use of the residence for the term of this lease or and renewals thereof, for personal residence. Out buildings are not included in this lease. Lessee is prohibited from engaging in the following activities on this premises:
a.) Any illegal activity including illicit drug use or underage consumption of tobacco or alcohol
b.) Smoking within the house including under any porch, awning or other structure. All tobacco products such as cigarette buts and chew spit must be immediately disposed of in a closed container in the trash. Remnants of tobacco left on the premises will not be tolerated.
c.) Installing or using a trampoline or swimming pool
d.) Subletting of the premises or housing any person or business not reported on the Lessee's rental application.
e.) Destruction or removal of property
Lessee shall maintain the lawn and interior in accordance with local statutes and ordinance including lawn and weed control and general health, cleanliness, safety and wellness standards. Any assessed fees will be charged to the lessee.
Lessee agrees to keep a maximum of 2 vehicles on premises. These vehicles must be both operable and currently licensed. Lessee agrees to park their vehicles in assigned spaces and to keep those spaces clean of oil drippings. Lessee agrees not to park boats, recreational vehicles, trailers, utility trailers, and the like on the premises without first obtaining Lessors written permission.
2.) Utilities:
All utilities will remain in the Lessor's name. The rental payment for this lease includes credits for utility use including those listed below. Additional costs will be billed with the next month's rent payment or removed from the security deposit for the final month if not paid before vacating.
a.) $108.00 each month for trash collection
b.) $50.00 monthly for water and sewer connection and use
c.) $100.00 monthly for internet connection and use
d.) $2,100.00 annual for electric and gas service and use. This will be prorated for terms shorter than 1 year by reducing the credit amount by 9% for each month less than 12 in the duration of the lease.
3.) Additional services:
Additional services can be furnished and paid for by the lessee. These will be charged monthly with rent statements.
a.) Lawn care $60.00 monthly
b.) Snow removal $600.00 annually
c.) Custodial service $450.00 monthly
4.) Repair of Premises
Lessee agrees to notify Lessor immediately if the roof leaks, water spots appear on the ceiling, or at the first sign of termite activity. Lessee also agrees to notify the Lessor immediately upon first discovering any signs of serious building problems such as standing water or leaking appliances. If the Lessee does not notify Lessor in a prompt manner, the Lessee may be held financially responsible.
Lessor will pay the costs and maintenance of walls, windows, floor coverings, shell, structure, stairs, roof, grounds, sidewalks and off-street parking areas of the leased facility. Such items shall be maintained at a condition not less than the condition of the said items at initial lease signing. Lessor will be responsible for repairs and/or replacements to heating/ventilation and air conditioning (HAVC), plumbing, electrical, mechanical and related fixtures and appliances. The Lessor is responsible for meeting all applicable local and state building codes, ordinances, standards and regulations.
HVAC specifications: Residence is supplied with at least 50 kBTUh of heating and 35 kBTUh of cooling. Recommended set back temperatures are 68 F during the heating season and 78 F during the cooling season. Heating system at time of installation is 80% at steady state. Air conditioning equipment is no less than 14 SEER.
Repairs of damage caused by Lessee shall be paid for by the Lessee. Lessee will submit written requests for decoration and other remodeling items to the Lessor for approval. Approved decoration or remodeling will be provided by Lessor and upon receipt of invoices, Lessee will reimburse Lessor for said decoration or remodeling costs.
5.) Removal of Lessor's Property
If anyone removes any property belonging to the Lessor without the express written consent of the Landlord, this will constitute abandonment and surrender of the premises by the Lessee and termination by them of this lease agreement. Lessor may also take further legal action.
6.) Untenantable Premises
If premises shall be damaged by fire, casualty, natural disaster or other cause to be untenantable, the rental payments shall abate from the date of such damage and shall not resume until the premises are restored to tenantable condition. If the damage renders restoration impossible within sixty days of the time of damage, Lessee may elect to void this lease and obligation to pay any unpaid balance of rental payments shall cease from the date of said damage. Any prepaid rent shall be returned to Lessee for the period the premises are untenantable.
Should, at any time during the term of this lease, hazardous substances, chemicals or odors be discovered in the lease building in amounts determined by the appropriate state agency to be unacceptable, the Lessor will have sixty days from date of written notice by the Lessee to satisfactorily dispose of the hazardous substances, chemicals or odors or the Lessee may terminate the lease after sixty days with no penalty to the Lessee.
7.) Termination for Unforeseen Circumstances
The Lessee can terminate this Lease without penalty for the following circumstances:
a.) Military deployment or reclassification training lasting greater than 3 months if orders are provided by the Lessee.
b.) Loss of employment or employment relocation. Lessee must provide sixty days notice and evidence of termination or relocation provided by the company to the Lessor prior to release from the lease terms.
c.) Relocation due to long-term family medical necessity. Lessee must provide sixty days notice and evidence of medical condition and patient relation, to the Lessor prior to release from the lease terms.
8.) Automatic Hold Over
This lease agreement shall expire at the end of the term specified. However, Lessee shall be allowed to hold over after the end of the term and Lessee shall be a tenant at the same terms and conditions as contained herein. This hold over tenancy shall expire after a maximum of one month. Rent must be paid prior to the beginning of the hold over period. A refund will be issued to the Lessee at a rate of 3% for each day of the hold over period remaining after the property is vacated and inspected.
9.) This lease agreement shall be subject to, governed by, and construed according to the laws of the State of Kansas.
10.) Binding Effect
The terms and conditions of this lease shall be binding upon the parties, their heirs, agents, administrators, executors or legal successors.
11.) Liability
The Lessor shall not be responsible for any damages caused by nature or the public.
