Landlord covers Heat LEASE AGREEMENT By this agreement, made and entered into on May 1st, 2025, between Nate Peisch , referred to as "Lessor," and , referred to as "Lessee," Lessor demises and lets to Lessee, and Lessee hires and takes as tenant of Lessor, the premises described as 2813.5 North Main St Davenport, Iowa 52803, to be used and occupied by Lessee as residence and for no other use or purpose whatever, for a term of one month beginning on May 1st, 2024, and ending on May 31st, 2024, at a rental of $950.00 per month, payable monthly, and sent to Nate Peisch Venmo @Nathan-Peisch in advance on the 1st day of each month during the term of this Lease, in consideration of the following covenants and agreements made by the Lessee to be by him kept and performed: 1. The leased apartment shall be occupied by no more than 2 people(s), consisting of adult(s) and child(ren) without the prior, express, and written consent of Lessor. Lessor hereby expressly reserves his legal right to increase the monthly rental amount should the number of residents increase. 2. Without the prior, express, and written consent of Lessor or his agent, Lessee shall not assign this Lease or sublet the premises or any part of the premises. A consent by Lessor to one assignment or subletting shall not be deemed to be a consent to any subsequent assignment or subletting. 3. At the end of the Lease period, Lessee is required to provide written 30 (thirty) days' notice in advance of the actual move out, and no later than the day rent becomes due. In lieu of said 30 (thirty) day notice, all remaining terms of the Lease shall remain in effect and tenancy shall continue a month-to-month basis at expiration of the specified Lease period. 4. Lessee grants permission to Lessor to show the apartment to new rental applicants at reasonable hours of the day, within 30 (thirty) days of the expiration of the term of this Lease. During this time, Lessee agrees to keep the apartment in a clean and presentable condition. 5. Illegal trafficking or illegal use of drugs will constitute a breach of this Lease and tenant will be subject to immediate termination of the Lease all applicable penalties. 6. Not to permit DOGS, CATS, REPTILES, OR OTHER PETS ON PREMISES without the prior, express, and written consent of Lessor or his agent. 7. No permit or permit the premises to be damaged, or to depreciate by any act or negligence of Lessee or members of his/her family and to at once repair or replace any parts of premises, fixtures, or appliances therein, broken or damaged. No alterations or improvements shall be made by Lessee in or upon said premises without the prior, express, and written consent of Lessor. Lessee agrees not to drive nails or screws into the woodwork, walls or floor. Fixtures attached to doors, windows or woodwork, and all alterations, additions or improvements made by Lessor or Lessee shall be the property of Lessor and remain upon and be surrendered with premises at termination of Lease. 8. To dispose of garbage and trash by properly placing some in the approved container provided by Lessee. Garbage, trash and recyclables are collected each Tuesday morning during non-holiday weeks. 9. To prevent freezing or bursting of water pipes, and to keep the faucets closed to prevent waste or flooding of said premises by water, and to be responsible to Lessor for all damages done by neglecting to do so, and to repair all damages caused by neglect as provided above. To not allow anything to enter waste pipes leading from sinks, toilets and/or floor drains which would clog them and to be responsible for the unblocking of some. 10. It is expressly understood and agreed that neither Lessor nor his agents shall be liable for damages or injury to Lessee, his/her family, property and/or employees or their property from whatever cause arising, unless the direct result of Lessor or his agents' culpable neglect or gross carelessness. 11. At the expiration of this Lease, to surrender the possession of said premises to Lessor without further notice to quit, and in as good repair and cleanliness (including appliances) as the same are now. (Unavoidable wear or damage caused without the fault of Lessee excepted). The following is expected to be performed by Lessee upon expiration of this Lease: Clean appliances, fixtures, baseboards, windows, windows, windowsills, woodwork, cupboards, floor coverings, wall markings, closets, entry way, porch and designated laundry area (if basement facilities were used). line Lessee hereby agrees that said rents, whether due or to become due, shall be a perpetual lien on any or all furniture or other property kept or used on said premises at any time during Lessee's occupancy of said premises, whether the same be exempt from execution or not. 13. It is mutually agreed that if any rents herein specified shall not be paid when due, or upon breach of any of the covenants herein contained, it shall be optional with Lessor at any time to declare this Lease void, and upon giving Lessee 3 (three) days' notice to quit, as provided by Iowa law or 5 (five) days' notice to quit, as provided by Illinois law, re-enter upon said premises. Should it be necessary for Lessor to initiate legal action against Lessee to recover rents and/or other amounts accrued but not paid during tenancy, Lessee hereby agrees to reimburse Lessor in full all amounts expended including but not limited to: court filing fees, process serving fees, attorney fees, recovery fees and sheriff fees in addition to all unpaid rents. 15. As security for the performance by Lessee of all the terms, conditions, covenants and agreements in this Lease to be kept and performed by Lessee, and as security to assure that Lessee duly takes possession of the described premises on the commencement of their term, Lessee does hereby deposit with Lessor the sum of $1000.00 as security deposit. It is mutually agreed that this security deposit is automatically forfeited if the Lessee chooses not to continue to reside for the period of this Lease, or is evicted for non-payment of rents, late charges and/or damages due during the period of this Lease. Otherwise, said security deposit shall be returned by Lessor to Lessee without interest at the end of the Lease term if Lessee has fully performed and kept to said date all of the said terms, conditions, covenants and agreements in this Lease to be kept and performed by Lessee, Lessor may retain and apply the security deposit toward the actual damage sustained by Lessee without in any way affecting Lessor's right to such other remedies against Lessee as the law permits. Said security deposit shall never be applied to rent or any other amounts owed Lessor by Lessee. 16. The attached Rules and Regulations become a part of this Lease when both documents are signed and dated by Lessee. 17. Lessee agrees to have carpet professionally shampooed by a pre-approved company, upon move-out $200.00 will be deducted from security deposit. "Best Carpet Cleaning" 18. Only locks provided by Lessor, or his agent are to be installed on the apartment door. 19. Periodic inspections may be made by Lessor or his agent at any time following a 24 (twenty-four) hour written notice to Lessee. 20. All utilities are paid for by Lessee. Mid-American Energy Heat bill is covered by lessor. 21. Rent is due and payable on the first of each month. If said rent is not received or postmarked by the first of the month, there will be a late charge assessed of $10.00 per day for each of 4 (four) days. Lessee additionally agrees to pay a $25.00 fee for each dishonored bank check. This policy is not to be used as an excuse to pay late, furthermore, if rent payment is not received by day 3 (three) of the month, Lessor has and will enforce his legal right to serve a 3 (three) day notice as provided by Iowa law or a 5 (five) day notice as provided by Illinois law and start eviction proceedings.
