Lease Duration, Rent, and Fees
Lease Term: This is a flexible month-to-month tenancy, meaning it does not have a set end date.
Termination Notice: Either the landlord or the tenant may terminate the tenancy by providing a 30-day written notice. The Landlord may be required to give 60 days' notice under certain California Civil Code sections (e.g., if you've lived there for a year or more, per 1946.1).
Monthly Rent: $1,950.00, due on the 1st of each month.
Security Deposit: $1,950.00 (due at signing). Tenants may not use the security deposit for the last month's rent.
Late Fee: Rent is late if not paid in full within 4 days after the due date. The late fee is a flat $50.00.
Returned Check Fee: A $35.00 fee will be charged for any returned check (NSF, stop payment, etc.).
Payment Methods: Accepted forms of payment include: cash, personal check, certified funds/money order, Venmo, or any other mutually agreed upon electronic method.
Cancellation Clause: If a tenant cancels the agreement before paying the first month's rent, the Landlord has the right to withhold the security deposit as compensation for losses.
Utility & Other Policies
Utilities: Tenant is responsible for all utility charges. The landlord pays for none of the utilities.
Smoking Policy: Smoking is strictly prohibited on the premises (inside and out).
Guest Policy: Guests may not stay for more than ten days in any six-month period without the Landlord's prior written consent.
Pets: No animal, bird, or other pet may be kept on the premises without the Landlord's prior written consent. This excludes properly trained service animals.
Tenant Maintenance and Responsibilities
Renters must understand their obligations regarding the condition and maintenance of the property:
General Maintenance: Tenants must keep the premises clean and sanitary and in good repair.
Reporting Issues: Tenants must immediately notify the Landlord of any defects or dangerous conditions they become aware of.
Damage Responsibility: Tenants must reimburse the Landlord for the cost of any repairs to the premises or Landlord's personal property that is damaged by Tenants or their guests/invitees through misuse or neglect.
Alterations: Tenants may not make any repairs, alterations, or rekey any locks without the Landlord's prior written consent.
Move-Out Condition: Upon termination, the premises must be returned to the Landlord in a condition identical to the move-in state, except for ordinary wear and tear.
Renter's Insurance: The Landlord recommends that Tenants obtain a renters' insurance policy to cover personal property damage, liability, and damage to the premises. The Landlord assumes no liability for loss or damage to the Tenant's or guests' personal property.
