1. Premises & Availability
The Premises, located at 326 Farm Place Court, Woodstock, GA 30188, shall be available for occupancy beginning October 1, 2025.
2. Lease Term
Tenant agrees to lease the Premises for a term of either one (1) year or two (2) years, commencing on October 1, 2025 and ending on 9/30/26 or 9/30/27 depending on the chosen term, unless sooner terminated in accordance with this Lease.
If no renewal agreement is signed prior to expiration, tenancy shall automatically convert to a month-to-month tenancy at the then-current monthly rental rate, subject to all other terms and conditions, unless terminated by either party with at least 30 days' written notice.
3. Rent & Payment
Tenant shall pay Landlord rent in the amount of $2,200.00 per month, payable in advance on or before the 1st day of each month.
All payments shall be made exclusively through Zillow's payment system.
If rent is not received within 5 after the due date, a late fee of $200 shall apply. Returned or dishonored payments will incur a fee of $200.
4. Security Deposit
Tenant shall pay a security deposit of $2,200.00 upon execution of this Lease. The deposit will be held by Landlord as security for the performance of Tenant's obligations.
Landlord may apply all or part of the deposit to unpaid rent, damages beyond normal wear and tear, or other costs resulting from Tenant's breach.
Within 30 after Tenant vacates and surrenders possession, the deposit (less any lawful deductions) will be returned to Tenant along with an itemized statement of any deductions.
The deposit shall not be used by Tenant as rent.
5. Maintenance & Repairs
Tenant shall maintain the Premises in clean, safe, and sanitary condition.
Tenant Responsibilities: replacing lightbulbs, smoke detector batteries, air filters, and maintaining cleanliness. Tenant is also responsible for lawn care and landscaping in the fenced in backyard. Tenant must promptly notify Landlord in writing of any condition requiring repair.
Landlord Responsibilities: maintenance and repair of major systems and structural components (HVAC, plumbing, electrical, roof, foundation). Landlord is also responsible for upkeep of the front yard landscaping and ensuring the appliances provided are in working order at move-in.
Negligence: Tenant shall be liable for any damage caused by negligence, misuse, or failure to report issues promptly.
6. Utilities & Services
Tenant shall be responsible for payment of all utilities and services to the Premises, including but not limited to: electricity, gas, water, sewer, internet, and cable.
Trash collection is included in this Lease at no additional charge.
7. Use & Occupancy
The Premises shall be occupied solely as a private residence by Tenant(s) listed on this Lease and no other persons. Subletting or assignment is prohibited without prior written consent of Landlord.
8. Smoking Policy
Smoking is strictly prohibited inside the Premises, including all interior rooms, garages, and enclosed areas.
9. Right of Entry
Landlord may enter the Premises with at least 48 hours' prior notice for purposes of inspection, maintenance, or to show the Premises to prospective tenants or buyers.
In case of emergency, Landlord may enter the Premises without notice.
