Tenant shall be liable for any harm proximately caused by the Tenants unreasonable refusal to allow access in accordance with Section 5312 of the Delaware Landlord Tenant Code. 10) EXTENDED ABSENCE AND ABANDONMENT. Tenant shall notify Landlord in writing of any anticipated extended absence from the property no later than the first day of such absence. Extended absence, as defined in Section 514l(g) of the Delaware Residential Landlord Tenant Code, shall mean any absence of more than seven (7) days. 11) REPAIRS. Landlord is responsible for repairs to the interior and exterior of the property. However, repairs made necessary by negligence, abuse, or misuse of the property by the Tenant or their guest(s) will be charged to the Tenant. Any plumbing stoppage will be the responsibility of the Tenant unless they are caused by faulty construction, such as mortar, stones or by tree roots. Tenant agrees not to make any alterations, additions, improvements, or changes in the premises, interior or exterior, or to the equipment and fixtures provided by the Landlord or to install any major appliances without written consent of the Landlord. All alterations, changes and improvements built, constructed, or placed in the leased property with the exception of fixtures, removable without damage to the property and movable personal property will, unless otherwise provided by written agreement between the Landlord and Tenant, remain in the leased property at the expiration of the lease. Landlord may require Tenant to restore the premises to its original condition, less normal wear and tear. 12) EMERGENCY REPAIRS. All routine repair requests must be reported to Landlord between 9:00 a.m. to 4:30 p.m. ET, in a timely manner as to prevent further damage. All routine repairs will be performed between 9:00a.m. to 4:30 p.m. ET, Monday through Friday. Emergency service calls should be reported immediately. If tenant requests emergency service and Landlord determines that the service requested was not an emergency, Tenant will be responsible for the full amount of any charge for such service. 13) DAMAGES: Landlord is not liable to Tenant for any loss to tenant's personal property. It is Tenant's responsibility to insure personal property and Tenant agrees to hold Landlord harmless for any damage occurring as a result of negligence, fire, lightning, wind, water, or other causes. Owner/Landlord will provide insurance coverage on the structure only. It is recommended that Tenant obtain a renter's insurance policy covering damage to contents and liability. 14) APPLIANCES. Tenant agrees to use such equipment as furnished by the Landlord in accordance with manufacturer's specifications, regulations of Landlord and the Residential Landlord-Tenant Code of Delaware. Tenant is fully responsible for damage to appliances caused by Tenant's misuse or negligence. Any appliances noted in the "Special Clauses" as being for the Tenant's "use and enjoyment" are not included as part of the property or Rental Agreement. Such appliances are for Tenant's use and enjoyment only and are not warranted or represented to be in any condition other than "as is". Such appliances may not function at all. Landlord is not responsible for maintaining, repairing, replacing, or removing any such appliances when noted as such in "Special Clauses". 15) Any lease agreement addendum sent to the tenant post the initial lease agreement must be signed and returned within 30 days.
