RESIDENTIAL LEASE AGREEMENT
Property Address: 3814 Walnut Street, Anderson, Indiana 46013 Premises: One-bedroom, one-bathroom apartment (half of a duplex), including one garage bay and access to washer and dryer unit.
Landlord: Elijah David Spurlock ("Landlord") Tenant: __________________________ ("Tenant") Lease Term: 12 months, commencing _____________ and ending _____________ Monthly Rent: $875.00 Security Deposit: $875.00 (refundable subject to terms below) Pet Rent / Deposit: $75 per month for one pet; $25 additional per month for a second pet; additional pet deposit $875.00.
1. RENT AND PAYMENT
1.1 Due Date: Rent is due on the 1st day of each month. 1.2 Grace Period & Late Fee: Tenant has a 15-day grace period. After the 15th day of the month, rent is considered late, and a $50 late fee will be assessed. 1.3 Payment Method: Rent may be paid by personal check, money order, or electronic transfer (such as Zelle, Cash App, or another mutually agreed-upon method). 1.4 Returned Payments: Any returned payment may incur a $35 fee plus any bank charges.
2. SECURITY DEPOSIT
2.1 Deposit Held: Landlord acknowledges receipt of $875 as a security deposit. 2.2 Refund: Within 45 days after Tenant vacates and returns keys, Landlord shall return the deposit minus reasonable charges for: (a) repairs beyond normal wear and tear; (b) unpaid rent or fees; and (c) cleaning costs if the premises are not left clean. 2.3 Statement of Deductions: Landlord shall provide an itemized statement of any deductions as required by Indiana law.
3. UTILITIES AND SERVICES
3.1 Landlord-Paid Utilities: Landlord shall pay for electricity, water, gas, trash, and sewer services. 3.2 Tenant-Paid Utilities: Tenant shall pay for internet or any optional services they choose. 3.3 Appliances Provided: Refrigerator and stove are provided and maintained by Landlord. Washer and dryer are provided for Tenant use but are not maintained or repaired by Landlord.
4. USE AND OCCUPANCY
4.1 Premises shall be used solely as a residential dwelling for Tenant and approved occupants. 4.2 Smoking: Permitted outside only; no smoking inside the dwelling unit. 4.3 Guests: Reasonable overnight guests are allowed provided they do not cause disturbance or damage. 4.4 Subleasing: Subleasing or short-term rentals (Airbnb etc.) are not permitted without written consent. 4.5 Parking / Driveway: Tenant may use one garage bay and the driveway in a manner that does not block the other tenant's access. Garage may be used for parking or storage at Tenant's discretion. 4.6 Occupant limit : A maximum of two (2) occupants are permitted to reside in the premises at any time unless otherwise approved in writing by the Landlord.
5. PETS
5.1 Up to two domestic pets are permitted (subject to Landlord approval). 5.2 No aggressive dog breeds are allowed. 5.3 Additional pet rent and deposit apply as stated above. 5.4 Tenant is responsible for all pet damage and waste removal.
6. MAINTENANCE AND REPAIRS
6.1 Landlord will maintain the structure, plumbing, electrical systems, and major appliances provided. 6.2 Landlord will perform lawn care (grass mowing); Tenant is responsible for snow removal. 6.3 Tenant will handle minor repairs costing under $100 (subject to negotiation with Landlord). 6.4 Tenant shall promptly notify Landlord of any issues requiring repair to prevent further damage.
7. ENTRY BY LANDLORD
Landlord may enter the premises for repairs, inspection, or showings with at least 24 hours' notice, except in cases of emergency as allowed by Indiana law.
8. DEFAULT AND TERMINATION
8.1 If Tenant fails to pay rent or otherwise breaches this lease, Landlord may terminate the tenancy as per Indiana Code 32-31-1 et seq. 8.2 No early termination is allowed unless agreed in writing. 8.3 At lease end, Tenant must vacate and return the premises in clean condition with keys returned to Landlord.
9. RENEWAL AND NOTICE
Lease does not automatically renew. Landlord or Tenant may offer renewal by written notice prior to the expiration date.
10. LEGAL AND MISCELLANEOUS
10.1 Tenant shall not engage in illegal activity or disturb the peace and quiet of other tenants or neighbors. 10.2 This agreement is governed by the laws of the State of Indiana. 10.3 If any part of this lease is found invalid, the rest remains enforceable. 10.4 All communications and notices shall be in writing and delivered personally or by email/text if mutually agreed.
