Residential Lease Agreement
Property Address: 3833 The Great Drive, Atlanta, GA 30349
Monthly Rent: $4,100
Security Deposit: $8,200 (equivalent to 2 months' rent)
Lease Term Options: 18 or 24 months
Income Requirement: Tenant(s) must provide proof of gross monthly income equal to or greater than 3x the monthly rent ($12,300).
1. Lease Term
Initial lease term shall be 18 or 24 months as agreed upon in writing by both parties.
Lease will automatically convert to a month-to-month agreement upon expiration unless either party provides written notice 60 days prior to the lease end date.
If converted to month-to-month, monthly rent will be 2x the current monthly rent ($8,200).
Rent is subject to increase by 5% to 10% at lease renewal, based on market conditions and tenant history.
2. Rent & Payments
Monthly rent of $4,100 is due on the 1st day of each month.
A late fee of $50 will be charged if rent is not received by the 5th, plus $5 per additional day late.
Accepted payment methods include Zelle, check, or other mutually agreed-upon digital options.
3. Security Deposit
A security deposit of $8,200 is required at signing. The deposit may be used to cover damages beyond normal wear and tear.
A move-in and move-out inspection will be conducted with a checklist, per Georgia law.
4. Utilities
Tenant is responsible for all utilities, including electricity, gas, water, and sewer.
5. Renter's Insurance
Tenant must carry renter's insurance for the duration of the lease. Proof of coverage must be provided before move-in and maintained throughout.
A minimum of $100,000 liability coverage is recommended.
Subrogation Waiver: Tenant and landlord waive subrogation rights; renter's insurance must not permit the insurer to pursue claims against the other party.
6. Smoking Policy
Smoking outdoors is preferred. Tenant is responsible for properly disposing of smoking materials.
7. Pet Policy
Pets are considered on a case-by-case basis and require written approval.
Monthly pet rent: $50 per pet.
Non-refundable pet fee: $300 per pet.
No aggressive breeds permitted.
Pets must be house-trained and up-to-date on vaccinations.
Pets must be leashed when outside, per Fulton County ordinance. Owners must clean up after pets.
8. Parking Policy (HOA-Enforced)
All vehicles must be parked in the driveway or garage.
Street parking is prohibited for residents. Guests may park temporarily on the street without obstructing driveways, walkways, or mailboxes.
Parking on the grass is prohibited.
Motorbikes, dirt bikes, and all-terrain vehicles (ATVs) are not allowed in the community.
The speed limit within the subdivision is 25 MPH.
9. Lawn & Exterior Maintenance (HOA-Compliant)
Professional lawn care is included in the rent. However, the tenant must:
Keep the yard free of trash, clutter, and pet waste
Ensure bushes, trees, and shrubs are trimmed
Maintain flower beds with fresh mulch or pine straw in spring and fall
Avoid artificial flowers or lawn ornaments
Not dump any debris, clippings, or furniture on the property or in common areas
Keep garbage cans, toys, yard tools, and sports equipment out of view when not in use
Place garbage cans behind the home or in the garage, only bringing them out the night before pickup
10. Pest Control
Pest control service is included at your convenience.
11. Repairs & Maintenance
Tenant must report maintenance issues or damage within 24 to 48 hours. Landlord is responsible for major repairs (HVAC, plumbing, electrical, roof, and includes kitchen [Fridge, Cooktop, Microwave, Dishwasher] & laundry appliances [Dryer & Washer] only).
Tenant is responsible for minor repairs under $100 (light bulbs, filters, clogs not caused by structural fault).
Emergency repairs must be reported immediately. Tenant may act to protect the property in true emergencies.
Landlord will provide 24 hours' notice for non-emergency entry for repairs or inspections.
12. Alterations & Exterior Modifications (HOA Compliance)
No alterations (painting, shelving, wall mounting, satellite dishes) may be made without written consent from the landlord.
All exterior modifications including landscaping, fencing, roofing, or painting must be approved by the HOA's ADL Committee.
Seasonal flowers (e.g., petunias, begonias, vincas) may be planted in existing beds without approval.
Sunflowers taller than 2 feet are not permitted.
13. Occupancy Limits
Only individuals listed in the lease may occupy the home. Subleasing or short-term rentals (e.g., Airbnb) are strictly prohibited and will result in immediate lease termination and forfeiture of the security deposit.
14. Renewal Notice Timeline
Landlord will initiate lease renewal discussions no later than 90 days before lease end.
Tenant must respond to renewal offers within 15 days.
If tenant chooses not to renew, written notice must be provided 60 days before lease expiration.
15. Noise Policy
Tenant and any guests shall not cause or permit any noise or activity that disturbs the peace and quiet enjoyment of neighbors.
Loud music, parties, or disturbances are not permitted, especially between 10:00 PM and 8:00 AM.
Violations may result in written warnings or early lease termination.
16. Eviction & Holdover Protections
Tenant acknowledges that under Georgia law, the landlord must provide a three-day notice for unpaid rent prior to filing for eviction.
If Tenant remains in possession of the property after lease expiration without written landlord consent, Tenant shall be considered a holdover tenant and will owe double the current monthly rent.
Only a court-ordered dispossessory action may remove a tenant; landlord will not engage in illegal lockouts or utility shut-offs.
17. Landlord Entry & Privacy
Landlord will provide at least 24 hours' notice for non-emergency entry, except in cases of emergency.
Tenant may not deny reasonable access for inspections, repairs, or showings to prospective tenants/buyers.
No cameras or surveillance devices shall be placed in private areas such as bathrooms or bedrooms.
18. Attorney Fees & Legal Costs
If landlord prevails in any legal action arising from this lease, tenant shall be responsible for all reasonable attorney fees, court costs, and collection expenses.
19. Indemnification
Tenant shall indemnify and hold harmless landlord from any claims, damages, or expenses arising from the negligence, actions, or omissions of tenant, tenant's guests, or pets.
20. No Waiver Clause
Failure of landlord to enforce any provision promptly shall not be deemed a waiver of landlord's rights.
21. Severability
If any provision of this lease is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
22. Governing Law & Venue
This lease shall be governed by the laws of the State of Georgia. Any disputes shall be resolved in a court of competent jurisdiction in Fulton County, Georgia.
23. Assignment, Subletting, & Short-Term Rentals
Tenant may not assign, sublet, or transfer any interest in this lease without prior written consent from the landlord.
The use of the property for short-term rentals, including but not limited to Airbnb, VRBO, or any other similar platform or arrangement, is strictly prohibited.
Any violation of this provision will result in:
Immediate forfeiture of the entire security deposit
Immediate lease termination
Potential legal action for damages, attorney fees, and other costs incurred by the landlord due to such violation
