Tenant shall pay the monthly rent ("Rent") of $2,900.00, which amount is due in advance and is due and payable on the first day of each month. Water, cable T.V., and internet service are included in the Rent. Tenant will not be charged for gas and electric so long as the total monthly charge for gas and electric is $100.00 per month or less. If the monthly amount for gas and electric is greater than $100.00 per month, the amount of the bill that exceeds $100.00 will be billed to Tenant, and such amount will be due and payable to Landlord by Tenant within __5_ days of the date of Landlord's invoice to Tenant. If Tenant abandons the Property before the end of the Lease Term, Tenant's right to use and occupy the Property shall immediately and automatically terminate. Tenant understands and agrees that there are no refunds due to unused portion of the Lease Term. This lease can be extended at the same price with a 30 with day advance notice.
A minimum of a 30-day advance written notice is required for Tenant to request an extension of the Lease Term. The granting or denial of a Lease extension is within the sole discretion of Landlord. Tenant is responsible for Rent through the end of any given month, even if Tenant has abandoned the Property.
Time is of the essence as to all of Tenant's obligations under this Lease. The following dates and times must be strictly performed by Tenant: Tenant must fully vacate the Property on or before 11:00 am on the last day of Tenant's Lease in order to allow Landlord ample time to have the Property cleaned and otherwise prepared for the next tenant. Move in time 3:00 p.m. on the first day of the Lease Term.
In order to guaranty the Property for Tenant for the Lease Term, Tenant must pay to Landlord the amounts set forth below:

Total due now to guarantee this Lease: $5,800
occupancy of the Property. If Tenant owes money to Landlord, as set forth in that accounting, that amount will be due and payable in full within ten days of Landlord's invoice to Tenant. If such amount is not timely paid by Tenant to Landlord, Landlord shall have the right to sue Tenant for the amount owed, without further notice to Tenant.
Any amount that is owed by Tenant to Landlord that is not timely paid shall accrue interest at the rate of twelve percent (12%) per annum, which interest shall be owed from the date the amount was first owed through the date the amount owed is paid in full.
4. INSPECTION
Tenant shall allow Landlord access to the Property upon 24-hours written or verbal notice for the purpose of inspection, making necessary repairs, maintenance, or the showing of the Property to prospective tenants. the event of an emergency, Landlord shall not be required to give 24-hours written or verbal notice prior to entering the Property.

6. EVICTIONS AND ABANDONMENT
Eviction may occur as a result of the Tenant's violation of any of the obligation of Tenant as set forth in this Lease. Tenant shall continue to be liable for payment of Rent and be bound by all other provisions of this Lease during the eviction process. Susan Keeney and/or an authorized representation of Susan Keeney, will have the right to enter the Property and remove any and all personal belongings owned by Susan Keeney once an eviction process begins. Tenant shall have no claim against Susan Keeney or Owner if personal property is removed under this paragraph, and Tenant no longer has the ability to make use of that personal property. In the case of non-payment of any amounts owed on this Lease or any other breach of this Lease, Landlord shall have the right to turn this matter over to a collection agency and/or an attorney to collect any monies due, to collect an amount needed to repair any damage to the Property, to reimburse Landlord for advertising costs to place a new tenant, and to recover any other losses or damages incurred by Landlord. In any lawsuit that arises from or relates to this Agreement, the prevailing party shall be entitled to an award of his/her/its reasonable attorney fees and costs.
7.HOMEOWNERS ASSOCIATION
Tenant shall abide by the rules, covenants, and regulations of the ___________________ Homeowner's Association (HOA) (collectively the "Rules"). Tenant acknowledges receipt of the Rules. Any fines, penalties or other charges by any homeowner's association will be promptly paid for by Tenant, upon receipt of an invoice from Landlord. Tenant shall strictly comply with all federal, state and local laws, ordinances, and statutes.
7. HOME OWNERS ASSOCIATION

Tenant shall abide by the Home Owners Association Rules and regulations.
Tenant shall not use any other parking spaces or additional visitor spaces without a parking pass from the HOA. Tenant's car may be towed if there is any violation of the Rules pertaining to parking. Street parking is available.
Tenant shall have use of Mailbox #____at the mail kiosk at the south end of the complex. It is advisable to notify the Post Office at Alameda that Tenant is residing at this address so that mail will be delivered to Tenant's mailbox. Landlord has no liability to Tenant in regard to any mail that is not delivered or not timely delivered by the U.S. Post Office or any other mail carriers.
9. DAMAGES/REPAIRS/ALTERATIONS
Tenant agrees to keep the Property in good order and condition, and in a clean and sanitary condition. Tenant agrees to pay for all damages to the Property or common grounds done by the Tenant, as well as Tenant's family, guests, or invitees that result from neglect, misuse, abuse, or willful acts. Tenant agrees not to paint, paper, alter or redecorate, or make repairs to the Property, without first obtaining the Landlord's specific written permission, which can be denied in Landlord's sole discretion.
Tenant shall immediately notify the owner of any problem that may occur with or at the Property, or any damage that is caused to any part of the Property or the common grounds.
Landlord and Tenant shall comply with the statutory warranty of habitability.
It is mutually agreed that the Tenant is responsible to reimburse Landlord for any items in, on or about the Property or the common grounds that are damaged or broken, or lost subsequent to Tenant's occupancy of the Property, whether such damage, breakage, or loss is caused by Tenant, Tenant's family members, guests, invitees, or unknown persons. Such items include, but are not limited to, windows, screens, cabinets, trim, hardware, doors, carpets, flooring, mirrors, all furnishings in the Property, etc. Repairs or replacements will be of the same quality and/or kind as the original. If Tenant is unwilling or unable to make such repairs or replace broken, damaged, or lost items within thirty days of the date of demand by Landlord, Landlord may make such repairs or replacements and charge the Tenant for the cost, plus labor at $65.00 per hour. Excessive or repeated damage, loss, or neglect of the premises by the Tenant, Tenant's family members, guests, or invitees shall be a breach of this Lease by Tenant, and shall be grounds for the Landlord to evict tenant, and Tenant waives any claims against owner of the Property and Landlord for any injury or problems that may occur during the lease of the Property, other than a situation that is the result of the willful and wanton conduct of Landlord. At the time of occupancy, Landlord warrants that all plumbing drainage is in good working condition. After Tenant takes possession of the Property, Tenant agrees to pay for removing all plumbing stoppages. Tenant is responsible for any pest control needed during the term of the Lease.
10. LOCKS
Locks on the premises may not be changed or installed on any interior or exterior door by Tenant without written permission from the Landlord. Any expenses incurred because of unauthorized lock changes will be charged to the Tenant. The Lock Box that is on the front door of the Property must remain on the front door at all times with a spare front door key inside.
11. USE
The premises are to be used for residential purposes only. No commercial use is allowed.
12. KEYS
Tenant shall be responsible for returning all keys including the mailbox key at the end of the Lease Term, or upon termination of this Lease, whichever is earlier.
13. UTILITIES
All utility charges that are the responsibility of Tenant as set forth in this Lease shall be due and payable by Tenant with the monthly rent, i.e., on the first day of each month.
14. INSURANCE
Landlord, provides fire and hazard insurance for the Property structure and Landlord owned personal property only. Tenant is advised to carry renter's insurance, which insurance will be at Tenant's sole expense.
15. SUBLETTING
Tenant shall not sublet, assign, or transfer all or part of the Property. Any attempted sublet, assignment, or transfer by Tenant shall be null and void, and shall be a breach of this Lease.
16. CRIMINAL ACTIVITY
Tenant, household members, guests, or another person under the Tenant's invitation shall not engage in any illegal or criminal activities in the Property or the common grounds. Any criminal activity by said parties in or on the Property or the common grounds shall be a breach of this Lease. Any personal property left behind as a result of criminal activity shall be deemed to be forfeited, and can be disposed of by Landlord without liability to Tenant or any other party. Any criminal activity resulting in damage to the premises and to the owner's personal property shall be at the expense of the Tenant, and the costs of any repairs shall be paid to Tenant by Landlord upon presentation of a bill to Tenant for such damage.
17. JOINT OR SEVERAL LIABILTY
All those persons who sign this Lease as Tenant are jointly and severally (together and separately) liable for all damages, costs, liabilities, and other amounts owed by Tenant to Landlord.
18. ADVERTISING
Landlord has the right to advertise the Property for rent while Tenant is still leasing the Property. Landlord also has the right to advertise the Property on the internet, as well as show the Property to prospective tenants with twenty-four hours prior written or verbal notification to the Tenant.
19. ABANDONMENT If Tenant leaves and abandons the Property before the end of the lease term, Tenant relinquishes all right to use and occupy any part of the Property.
20. NO SMOKING.
Please note that this Property is a non-smoking unit. Tenant will be billed $1,000.00 if there is any smoke of any kind in the Property. Further, the use of marijuana in the Property is strictly prohibited.
21. MISCELLANEOUS.
1. This Lease shall be binding upon and shall inure to the benefit of the parties and their respective successors and permitted assigns.
2. The failure of Landlord to enforce a term or provision of this Lease shall not be deemed a waiver of Landlord's insistence on the strict performance of that or any other term of this Lease at any time in the future.
3. This Lease represents the entire agreement of the parties and supersedes all prior written and verbal understandings, discussions and representations between the parties regarding the subject matter of this Lease.
4. Any modification of this Lease must be in writing and signed by both parties.
5. Paragraph headings in this Lease are for reference purposes only and do not affect the interpretation of this Lease .
6. If any term or provision of this Lease is ruled to be illegal or unenforceable, the remaining provisions shall remain in full force and effect, with the illegal or unenforceable provision being treated as if it were never part of this Lease.
7. This Lese may be executed in one or more counterparts, each of which shall be deemed an original, but all of which taken together shall constitute one in the same document.
