Late Fees: In Virginia, late fees cannot exceed the lesser of 10% of the remaining rent balance owed & due by the tenant or 10% of the periodic rent amount. The late fee charge must be included in the written lease agreement. However, if you are going to charge the Lessee for bounced checks, that fee cannot exceed $50. Security Deposits: In Virginia, the security deposit cannot exceed the cost of two months of rent. The security deposit must be returned within 45 days of the Lessee vacating the Premises. Storing Deposits: In Virginia, if the cost of renter's insurance and the security deposit exceed two month's rent, then you cannot require the tenant to submit a security deposit and get renters insurance.
