Lease-Rental Agreement Terms of agreement: The term of agreement shall commence on 12/20/2024 and end on 1/1/2026 unless terminated sooner as herein provided. This agreement will automatically renew on a month to month basis, unless either party gives written notice of termination at least thirty days before the end of the initial lease term ends. If the tenancy reverts to a month to month tenancy, a 30-day written notice of termination must be given by either party. If tenant cancels this agreement before the term has expired the following is required. (a) A written thirty-day notice of termination. (b) All rents and charges paid through the date of termination. (c) Payment of an amount equal to one and one-half months rent as a termination fee. (d) Premises shall be in good and clean condition with no damage, ordinary wear and tear accepted. (e) Security deposit cannot be used for the termination fee. The premises is to be occupied by no more than 4 total persons. Tenant shall have a maximum of 3 vehicles parked in the parking lot. Rent and Fees: Rent shall be $2195.00 per month payable in advance on or before the 25 day of each prior calendar month to the owner, at the specified address. It is not the owner's responsibility to pick up the rent. The rental month shall begin on a day determined by both tenant and owner. The owner prefers digital payments via VENMO. Security deposit shall be $2500.00 The security deposit shall secure the performance of the tenants obligations set forth in this contract. Owner may, but shall not be obligated to apply all or portions of said deposit on account of tenant's obligations hereunder. Any balance remaining upon termination shall be returned to tenant within thirty days from the date possession of premises is returned to owner. Providing that tenant provided a forwarding address to owner. Tenant understands that $500.00 of the security deposit is nonrefundable. This amount will go towards having the carpets cleaned after apartment is vacated, and any light touch up painting needed. Tenant shall not have the right to apply the security deposit in payment of any months rent. Tenant understands that the owner can and will pursue tenant for any damages to the unit that exceed the security deposit. A late fee of $100.00 will be charged to any tenant who does not make full monthly payment with 5 days of the determined due date. Utilities: The Tenant will be responsible for the following utilities: electricity, natural gas, water, garbage, sewer, internet. The Owner will be responsible for the HOA payment. Tenant will not be permitted to move in until the gas and power have been transferred into the tenant's name. Condition of Premises: Tenant accepts premises as being in good order and repair, unless otherwise indicated within 15 days of moving in reported to the landlord with a photo and description of the damage. Tenant agrees to maintain premises In a clean and orderly manner including but not limited to frequent mopping, vacuuming, cleaning of appliances, windows, toilets, showers/tubs, sinks etc. Tenant shall return premises to owner at the end of this agreement in the same general condition as when tenant took possession, reasonable wear and tear accepted. Tenant shall have apartment cleaned and made ready for the next tenant upon vacating the apartment. If the Owner has to do any cleaning there will be a $50.00 per hour cleaning charge. Repairs: Owner shall be responsible for the maintenance of the building. Tenant is responsible to notify landlord of needed repairs. Tenant shall be liable for costs of repairs that have not been reported in a reasonable time to stop property damage. Any damage caused by the negligence, carelessness, accident or abuse of Tenant and/or Tenant's guests will be paid for by the Tenant. Tenant agrees to reimburse Owner for all such costs within ten days of the repair. Pets: Tenant may not keep a pet of any kind on or near the premises without the prior written consent of Owner. For any violation of the provision, in addition to Owner's other remedies, Owner may charge and collect the sum of$50.00 per day, per violation. All costs of cleaning and damage or loss suffered on account of a pet violation shall be promptly paid to Owner by Tenant. Violation of this provision will allow Owner to commence eviction on the basis of nuisance without any further notice or opportunity to cure. Smoking: Smoking is strictly prohibited on the premises. Tenant agrees to not smoke in or on the premises and accepts this contract as a non smoking contract. No smoking applies to all guests and visitors as well as all tenants. Entry and Inspections: With a 24-hour notice, tenant agrees to allow owner the right of entry at any time for the purposes of inspection, inspecting repairs, or to show to prospective tenants. When repairs are ordered, it is understood that permission is given to enter and repair P.roperty with a reasonable notice to tenant. Owner has the right to enter the apartment in the case of emergency. Illegal Activity: Tenant may be evicted from the premises without further notice or opportunity to cure for any illegal activity conducted by Tenant or guest. Lead Warning Disclosure Statement: Housing built before 1978 may contain lead-based paint. Lead from paint, paint chips, and dust can pose health hazards if not managed properly. Lead exposure is especially harmful to young children and pregnant women. At this time, Owner has no knowledge of lead-based paint and/or lead-based paint hazards in the premises. Signing of this contract indicates that Owner has supplied a federally approved pamphlet called, "Protect Your Family from Lead in Your Home" to Tenant and that both parties have reviewed the above Lead-Warning Statement and to the best of their knowledge, the information provided is true and accurate. Limited Liability: Owner will not be liable for any damages or losses to person or property caused by any tenant or any other person including, but not limited to any theft, burglary, assault, vandalism or other crimes. Owner shall not be liable for personal injury or for damage to or loss of Tenant's personal property (furniture, jewelry, clothing, etc.) or Tenant from fire, flood, water leaks, theft, rain, hail, ice snow, smoke, structural problems, explosions, interruptions of utilities, power surges, or acts of God. Owner strongly recommends that tenant secure renters insurance to protect against all of the above occurrences. Default by Tenant: The following events shall constitute events of default A. Failure to pay any rent including first month or any other sums due and owing by Tenant to Owner pursuant to any terms of this agreement. B. Failure to perform all or any part of this agreement or a violation of this agreement or any of the rules and regulations adopted by the Owner. C. Tenant's abandonment of the premises - abandonment is hereby agreed to mean Tenant's absence from the premises for fifteen (15) consecutive days without first notifying Owner and with the rent unpaid and no reasonable evidence that the Tenant is occupying the premises other than items of personal belongings left in said premises. Assignment and Subletting: Tenant shall not assign or sublet any portion of the premises without prior written consent by the Owner. Legal and Attorney Fees: In the event of the owner prevailing in any legal action brought by either party to enforce the terms hereof or relating to the premises, Owner shall be entitled to all cost incurred in connection with such action, including reasonable attorney fees. Snow Removal: Tenant is responsible for removal of snow on all walkways and driveways. Tenant must remove any snow in a reasonable time for safety reasons. General Rules: 1. No auto repair on premises. 2. No waterbeds allowed . 3. Tenant's belongings must not be left on any walkways or in the yard for safety purposes. 4. No wires, cables, or satellite equipment will be installed without prior written consent by Owner. 5. Tenant and Tenant's guests shall have due regard for the comfort and enjoyment of other Tenants in the building. Musical instruments, radio, television, etc. shall be played during reasonable hours, at a reasonable volume. 6. Tenants will be responsible for all damage to concrete caused by excessive oil leak problems from the Tenant's vehicles . 7. Pictures may be hung on the walls with small nails only. Any necessary repairs due to holes found in the walls that are bigger than a small nail hole will be charged to the Tenant. 8. No painting, staining, or wallpapering shall be done without prior written consent by Owner. 9. Tenants shall conduct themselves in and around the premises in an orderly, personable manner and not in any threatening, hostile, boisterous, rowdy or otherwise obnoxious manner that would tend to disrupt the peaceful enjoyment of the Tenant's neighbors. 10. Tenant is responsible for any plumbing stoppages caused by something the Tenant put down the drain. Do not put any grease, food, peelings, or other materials down the drains. 11. Tenant must maintain heat sufficient to prevent freezing problems, whether occupied or unoccupied. Never tum the thermostat below 60 degrees. 12. Tenant must use stainless steel washer water lines hoses to avoid leaks and flooding. 13. Tenant is responsible to replace all light bulbs or smoke detector batteries as necessary.
