1. Lease Duration
The initial lease term shall be 12 months, commencing on the date specified in the lease agreement. Renewal options may be available at the end of the lease term, subject to mutual agreement. Tenant will be notified of renewal terms at least 30 days prior to the expiration of the lease term.
2. Rent Payment
Rent is due on the 1st day of each month. A grace period of 5 days will be granted. If rent is not received by the 6th day of the month, a late fee of 5% of the monthly rent will be applied. Rent not received by the 6th of the month may be subject to additional penalties as specified in the lease.
3. Security Deposit
A security deposit of $3,500 is required upon execution of the lease. This deposit will be returned to the tenant at the conclusion of the lease term, less any deductions for damages, unpaid rent, or other lease violations. The deposit will be returned within 30 days after the lease term ends, accompanied by an itemized statement of deductions (if any).
4. Use of Premises
The property shall be used exclusively for residential purposes. Commercial or business activities are strictly prohibited unless expressly permitted by the landlord in writing.
5. Pets
Pets are permitted on the property only with prior written approval from the landlord. A pet deposit of $500 is required. Breed restrictions may apply. The total number of pets permitted on the premises shall not exceed three (3).
6. Utilities
Tenant is responsible for the payment of all utilities, including but not limited to water, electricity, gas, trash, and internet, unless otherwise specified in the lease agreement.
7. Insurance
Tenant is required to obtain renter's insurance, covering personal property and liability. Proof of insurance, with a minimum liability coverage of $100,000, must be provided to the landlord before taking possession of the property.
8. Alterations
Tenant shall not make any alterations, modifications, or improvements to the property, including but not limited to painting, installing fixtures, or structural changes, without prior written consent from the landlord.
9. Maintenance and Repairs
Tenant is responsible for routine maintenance and upkeep of the property, including regular cleaning and minor repairs. The tenant must promptly report any damages or issues requiring repairs. Major repairs (e.g., HVAC systems, plumbing, structural repairs) shall be the responsibility of the landlord.
10. Parking
Tenant is granted the use of a two-car tandem garage for parking. Tenant is prohibited from parking in fire lanes or any areas not designated for parking. Unauthorized parking may result in fines or towing at the tenant's expense.
11. Move-In/Move-Out Procedures
A move-in checklist will be completed at the time of occupancy, documenting the property's condition. Upon move-out, a similar checklist will be used to assess any damages or cleaning requirements. Failure to return the property in the same condition may result in deductions from the security deposit.
12. Quiet Enjoyment
Tenant agrees to respect the rights of neighbors and to maintain a peaceful and quiet environment. The tenant shall not engage in loud parties, disruptive behavior, or any activity that may interfere with the quiet enjoyment of other residents.
13. Subleasing
Subleasing of the property is prohibited unless written consent is provided by the landlord. Any unauthorized sublease will be considered a breach of the lease agreement.
14. Community Rules
Tenant agrees to comply with any and all rules and regulations of the community association, if applicable, including those related to noise, the use of common areas (e.g., pool, hot tub), and proper disposal of trash. Any violations of these rules may result in penalties or eviction.
15. Access to Property
The landlord or their representative may enter the property with at least 24 hours' written notice for inspections, maintenance, or repairs. In the case of an emergency, the landlord may enter without prior notice.
16. Eviction Clause
Failure to pay rent, violation of lease terms, or engagement in illegal activities on the premises may result in eviction proceedings in accordance with applicable local, state, and federal laws.
17. Rent Increases
The landlord reserves the right to increase rent at the expiration of the lease term or upon renewal. The tenant will be provided with at least 30 days' written notice of any rent increase.
18. Early Termination
In the event the tenant wishes to terminate the lease early, a minimum of 30 days' written notice must be provided. Early termination may result in penalties, including forfeiture of the security deposit, depending on the circumstances.
19. Indemnification
The tenant agrees to indemnify, defend, and hold the landlord harmless from any and all claims, damages, losses, and expenses arising from the tenant's use of the property, including any claims resulting from the tenant's negligence or wrongful acts.
20. Move-Out Cleaning
Upon move-out, the tenant is responsible for ensuring the property is left in a clean and orderly condition, including carpets, appliances, and common areas. Failure to meet the move-out cleaning standards may result in deductions from the security deposit.
21. Force Majeure
Neither party shall be liable for failure to perform their obligations under this lease agreement due to circumstances beyond their control, including but not limited to natural disasters, acts of God, government regulations, or any other unforeseeable events.
22. Property Inspections
The landlord may conduct property inspections no more than twice per year, with at least 24 hours' written notice. In the case of an emergency or if repairs are requested by the tenant, the landlord may enter without prior notice.
23. Lost or Damaged Keys and Remote Devices
The Tenant acknowledges and agrees that in the event the following items are lost, damaged, or not returned upon the termination of the lease, the Tenant shall be responsible for the associated replacement costs as outlined below:
* Swimming Pool Key: In the event that the swimming pool key is lost, the Tenant agrees to pay a replacement fee of $150 for each lost key.
* Garage Door Remote: In the event that the garage door remote is lost, the Tenant agrees to pay a replacement fee of $50 for each lost remote.
These fees are due immediately upon notification of loss or damage and may be deducted from the Tenant's security deposit if not paid separately.
24. Wildfire Safety and Responsibilities
* Wildfire Preparedness: Tenant agrees to adhere to all local fire safety regulations and recommendations related to wildfire prevention. This includes, but is not limited to, maintaining defensible space around the property by keeping brush and vegetation cleared and reporting any fire hazards to the landlord or local authorities.
* Emergency Evacuation: Tenant agrees to comply with any evacuation orders issued by local authorities in the event of a wildfire or related emergency. Tenant acknowledges that during wildfire season or under certain conditions, evacuation may be required with little notice, and they will follow all emergency procedures to ensure their safety and the safety of others.
* Liability for Wildfire-Related Damage: The tenant agrees to hold the landlord harmless from any liability for damages, injuries, or losses resulting from a wildfire, including evacuation costs, loss of personal property, or relocation expenses. Wildfire-related damages to the property are subject to the terms of the insurance coverage carried by both parties.
