PREMISES. 1. Landlord, in consideration of the lease payments provided in this Lease, leases to Tenant the use of front yard, rear yard, pool & back patio, and driveway at the premises indicated above. Tenant may not park more than Three (3) cars on premises without prior consent of the Landlord.
STORAGE. 2. Tenant shall be entitled to store items of personal property in attic space only during the term of this lease. Landlord shall not be liable for loss of, or damage to, such stored items.
OCCUPANTS. 3. The Premises may not be occupied by more than 8 PERSONS, unless the prior written consent of the Landlord is obtained.
TERM. 4. The initial term of this lease shall be at least 1 YEAR.
UTILITIES AND
SERVICES. 17. Tenant shall be responsible for the following utilities and services in connection with the Premises (and may not disconnect, or have disconnected, any of the utility services without Landlord's permission):
Electricity (for cooking / refrigeration, heating, air conditioning, lighting, etc.)
Internet Service
Cable/Satellite
Garbage collection
Front and back yard landscaping and mulch bed maintenance
Regular grass mowing and general upkeep of both the front, side and back yards.
PROPERTY LOSS. 18. Landlord and Tenant shall each be responsible to maintain appropriate insurance for their respective interests in the Premises and property located on the Premises. Tenant acknowledges that he/she is aware that he/she is responsible for obtaining any desired insurance for fire, theft, liability, etc. on personal possessions, family, and guests. Landlord shall not be liable for damage to Tenant's property for any type or for any reason or cause whatsoever, except where such is due to Landlord's criminal negligence. Tenant must keep fresh batteries in smoke detectors. Tenant shall not tamper with the smoke detectors or make them inoperable.
PETS. 25. Up to three pets permitted inside the house at any time without the prior written consent of the Landlord. Tenant may request approval from Landlord for a pet or pets to reside at the property, in consideration of aforementioned agreement.
REPAIRS 26. Landlord will make necessary repairs to the exterior, or other obligations as set forth below in paragraph 27, with reasonable promptness after receipt of written notice from Tenant. Tenant shall make all necessary repairs to interior, that occur during the period that the Lease is in effect, and keep premises in a safe, clean and sanitary condition Tenant shall make contact with all repair or service people related to its obligations as set out in paragraph 27 below and will be responsible for paying any charges incurred or billed by such service people. Tenant may not remodel, paint or structurally change, nor remove any fixture in, on or around the premises, without written permission from the Landlord. If at the time of any Landlord inspections, it is determined that Tenant has caused any damages to the property, inside or out, Landlord has the right to correct the damages immediately at Tenant's expense. Tenant will be billed immediately for all costs incurred to repair said damages. Tenant must pay the bill within 30 days, unless a written agreement is reached between the Landlord and Tenant which would allow the Tenant to prorate the payments over the remaining term of the lease. Payments made after 60 days will be subject to a 22% per annum finance charge. Tenant may only hire a third party to correct the damages if Landlord approves of said third party. Landlord reserves the right to inspect third party credentials and plans, and has the right to reject said party. Repairs will not be considered complete until Landlord inspects completed job and feels it is satisfactory. If said damages are in the interior and cannot be conveniently repaired due to the Tenant and possessions being in the, Landlord will obtain a third party estimate of the cost to repair the damages and provide said estimate to the Tenant. Tenant will have 15 days to either accept the estimate or provide one from a different third party who is certified and/or licensed to provide the necessary repairs. The agreed upon estimate will then be treated as a bill which the Tenant must pay within 30 days, unless a written agreement is reached between the Landlord and Tenant which would allow the Tenant to prorate the payments over the remaining term of the lease.
MAINTENANCE.
27. Tenant's obligation for maintenance shall include:
Interior of the house, including regular cleaning of appliances and floors.
Regular (quarterly) replacement of air conditioning filters.
The driveway (usual and customary, but not responsible for structural problems or defects).
No trash bags shall be left outside of premises. Trash must be in an approved trash receptacle
Responsible for any plumbing blockages caused by Tenant
Major appliances; the refrigerator and clothes washer & dryer venting.
Landlord's obligation for maintenance shall include:
The roof, outside walls, and other structural parts of the building
The electrical wiring
The heating and air conditioning system.
Plumbing fixtures and dishwashing machine
Leaks within plumbing system
Landlord is not responsible for any of the above items if an expert third party determines that damage or failure was caused by the Tenant or Tenant's guest(s), or caused by the negligence or vandalism of the Tenant or Tenant's guest(s).
No smoking allowed inside the home.
