1. Pets
One (1) small pet may be permitted only with the prior written approval of the Landlord and execution of a separate Pet Agreement. Any approved pet must comply with all terms of that Pet Agreement, including but not limited to pet-related fees, behavior standards, and full responsibility for any property damage or nuisance caused by the pet. No additional or replacement pets are allowed without new written approval.
2. Utilities
Tenant shall be solely responsible for payment of all electricity and water utilities serving the Premises.
Tenant must establish utility service accounts in their name with PG&E (electricity) and San Jose Water Company (water) effective from the first day of tenancy. If services are not transferred and confirmed within three (3) calendar days of move-in, Landlord reserves the right to arrange continuation of service and bill Tenant for any associated charges, deposits, or administrative costs as permitted by California law.
Tenant shall not intentionally or negligently cause interruption of utility services.
3. Property Inspections
Landlord may conduct periodic property inspections, including inspections every six (6) months, through a licensed or certified inspection company, for the purpose of assessing property condition, safety, and maintenance compliance.
All inspections shall be conducted with at least twenty-four (24) hours' written notice to Tenant and in strict compliance with California Civil Code 1954, except in emergencies or as otherwise permitted by law.
4. Damage and Maintenance Responsibility
Tenant shall be responsible for maintaining the Premises in good condition and shall be liable for any damage to the property caused by Tenant, occupants, guests, or pets, excluding normal wear and tear.
In the event of damage, Tenant shall promptly repair the damage to Landlord's reasonable satisfaction or reimburse Landlord for the reasonable cost of repair. Failure to do so may constitute a material breach of the Lease and may result in legal action, including possible termination of tenancy, subject to applicable California law and due process requirements.
Intentional damage, negligence, or misuse of the property shall be considered serious violations of the Lease.
5. Subletting and Assignment Strictly Prohibited
Subletting, assignment, Airbnb, short-term rental, or any transfer of possession or occupancy of the Premises, whether in whole or in part, is strictly prohibited under all circumstances. No exceptions, approvals, waivers, or permissions shall be granted by the Landlord.
Any attempt to sublet, assign, license, or otherwise permit any third party to occupy the property without the Landlord's execution of a direct lease agreement with that party shall constitute a material breach of this Lease and grounds for issuance of a Notice to Perform or Quit or Notice to Terminate Tenancy, and may result in legal action, including eviction, in accordance with California law.
6. Gatherings, Parties, and Conduct Strict Limitation
Only normal, private family and close friend gatherings that do not create excessive noise, do not disturb neighbors, and do not violate any local, state, or federal law are permitted.
All other parties or events are strictly prohibited, including but not limited to:
Social parties, celebrations, or recreational events beyond ordinary family or friend visits.
Loud, disruptive, or amplified music or noise of any kind.
Gatherings promoted publicly or on social media.
Commercial, ticketed, or for-profit events.
Any gathering involving illegal activity, unsafe behavior, or uncontrolled crowds.
Any gathering that results in neighbor complaints, law enforcement involvement, or violation of San Jose Municipal Code or California law shall be considered a material breach of the Lease.
Violation of this section may result in issuance of a Notice to Perform or Quit or Notice to Terminate Tenancy and may lead to legal action, including eviction, in accordance with California law and due process requirements.
7. Eviction and Legal Costs
If Tenant violates any term of this Lease or this Addendum, including but not limited to the prohibition on subletting or assignment, Landlord may initiate legal proceedings to enforce the Lease or recover possession of the Premises.
In any legal action or proceeding arising out of the tenancy, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs, as awarded by a court of competent jurisdiction, in accordance with California Civil Code 1717 and Code of Civil Procedure 1032.
8. Enforcement
Failure by Landlord to enforce any provision of this Addendum shall not be deemed a waiver of Landlord's right to enforce such provision at any future time. All remedies shall be cumulative and exercised in accordance with California law.
