This home has been lovingly cared for since I purchased it a year and a half ago. Due to a family health matter, I will be relocating up north to assist my father and am seeking someone who will enjoy the home as much as I have. While I plan to return in the future, I'm looking for a responsible tenant who will treat the property with the same care and appreciation. Come see it for yourself you're sure to fall in love with both the home and the neighborhood. 1. Lease Term: 6 months - 1 year Renewal terms require two-month notice 2. Rent Terms: Monthly rent amount: $2300 and utilities. Due the 1st of each month -Accepted payment methods: Zelle, check, or cash Late payment policy: 5 days grace period after the 1st. After the 5 days is up, I will charge an additional $125 per day until rent is settled. 3. Security Deposit: A security deposit of $2300 (same as rent) will be collected at the beginning of the lease and returned at the end of the lease if nothing is damaged/ all lease terms are agreed to. 4. Conditions for return: (if dirty or damages are apparent, I will be charging an additional $500) House must be Deep cleaned and holes in walls must be patched and painted (return it the same way as you got it). Any other damages must be fixed professionally 6. Utilities & Services: All Utilities (electricity, gas, water, trash, internet) must be payed by the tenant. Pulling and spraying weeds must be upkept by tenant. If I get an HOA fee for weeds or anything else, tenant will be responsible for paying the fee. 7. Occupancy Limits: Max number of occupants allowed: 5 residents, 5 guests Guests can stay for no longer than one week. 8. Maintenance & Repairs: Tenant responsibilities: changing filters for A/C once every other month at least, yard care, trash and recycle removal, any utilities that are broken by tenant, not from regular wear and tear. Landlord responsibilities: Repairing any broken utilities from regular wear and tear (A/C, water heater, fridge, washer and dryer, dishwasher, oven, microwave, paying yearly HOA fees, any other features on the house that break from being old and used. Procedure for requesting repairs: Call me and I will get someone on it ASAP. Emergency repair process: Call me and I will get someone on it ASAP. 9. Rules & Restrictions: Smoking policy- No smoking inside, outdoor smoking allowed. Pet policy- Two pets allowed max (any odor or destruction caused by pets will be a $500 cleaning/repair fee). Noise restrictions- If neighbors call me about a noise complaint you get two strikes, after second strike I will charge $100 every time they call, if the cops get called on the house for noise complaints, I will charge $500. Use of property- residential only, no subletting without approval 10. Alterations: Tenant can make changes to the property with my approval. 11. Entry & Inspection: Landlord's right to access- If there are any reasons for entry, I will give you a 48-hour notice before coming down to look at the house. 12. Termination & Move-Out: Notice required to end lease is 30 60 days Cleaning expectations- (if dirty or damages are apparent, I will be charging an additional $500) House must be Deep cleaned and holes in walls must be patched and painted (return it the same way as you got it). Any other damages must be fixed professionally Final inspection process: I will be doing a thorough walk through of the house, any damages or unapproved changes on the house will be charged to the tenant directly who will have 10 days to fix the problems or pay for them to be fixed. Abandonment clause: If the Tenant vacates the Premises before the end of the Lease Term without written notice and without the Landlord's express written permission, and the Premises are left unoccupied for 30 days without payment of rent or prior notification to the Landlord, the Premises shall be considered abandoned. In such event, the Landlord may: Re-enter and take possession of the Premises without further notice; Re-rent the Premises and apply any rent received toward the balance owed under this Lease; Remove and store any of the Tenant's personal property left behind, with reasonable storage charges to be paid by the Tenant; Dispose of property deemed to have nominal or no value, in accordance with applicable state or local laws; Pursue any and all legal remedies available, including but not limited to recovery of unpaid rent, damages, and costs incurred due to abandonment. This clause shall be enforced in accordance with the applicable laws of the State of Arizona, and nothing herein shall limit the Landlord's rights under those laws. 13. Subletting / Assignment: Tenant shall not assign this Lease or sublet any portion of the Premises without the prior written consent of the Landlord. Any request to sublet must include: The proposed subtenant's full legal name and contact information Duration of the sublease Reason for subletting Subtenant's proof of income or employment Consent shall not be unreasonably withheld. If approved, Tenant remains fully responsible for all obligations under this Lease, including rent payments and damages, during the sublease period. Approval process if allowed 14. Insurance: Landlord insurance (what it covers): Dwelling, personal property, loss of use, service line coverage, back-up of sewer or drain 10%, personal liability, damage to property of others. Tenant is required to have renters insurance. 15. Legal Disclosures: $2300 security deposit is refundable at the end if house is returned in original condition. All utilities are to be paid by tenant and are non-refundable. Anything the tenants break they are responsible for fixing. This is also non-refundable. 16. Default & Eviction: What constitutes default: non-payment, and lease violations. Eviction process and timeline: 30 days after non-payment or lease violations. Fees or penalties for breaking the lease: $500 or the amount that it costs to fix everything if that exceeds the $500 amount. 17. Governing Law: This Lease Agreement shall be governed by, and construed in accordance with, the laws of the State of Arizona, including the Arizona Residential Landlord and Tenant Act (A.R.S. Title 33, Chapter 10). Any legal actions or proceedings arising under this Lease shall be brought in the appropriate court located in the county where the rental property is situated, and both parties consent to the jurisdiction of such courts. 18.
