LOCATION! **Home is centrally located between Orange Beach and Johnson Beach. You are just minutes away from all the pristine beaches and attractions. **This is a non-smoking home. (Renters who smoke inside the home will be charged a $500 fee and will have rental canceled without refund) **Main Renter must be at least 25yrs old VACATION RENTAL AGREEMENT Rental Party: The primary renter must be a minimum of 25 years of age. Occupancy: The property rental is not intended for house parties or group functions, including, but not limited to, graduation, prom, fraternity, sorority, club or similar group parties or functions, which are expressly prohibited. Use of the property for such purposes may result in immediate eviction without refund. Failure to observe this prohibition shall result in immediate eviction. Any reservation obtained under false pretenses will be subject to forfeiture of deposit and/or rental money and the party will not be permitted to check in. Term of the Lease. Lease Duration and Renewal Lease Term: The standard lease duration is [2 months]. Renewal: Leases can be renewed with mutual agreement. Tenants must notify the landlord [30 days] before the lease end date. No refunds will be given for early departures for any reason. Renters are subject to expedited eviction if Renters (1) holds over the possession after the renters tenancy expires; (2) commits a material breach of any provision of this Agreement, including the Rental Rules; (3) fails to pay charges as required by this Agreement; (4) fails to sign the Agreement prior to occupancy; or, (5) has obtained possession of the premises by misrepresentation or fraud. The Renter entering into this Agreement must be 25 years of age or older in order to secure the rental and take possession of the property. Rental Rules: Renter agrees to abide by the Property Rental Rules at all times during their stay and shall cause all members of the rental party and anyone else Renter permits on the Property to abide by the following rules at all times while at the Property. The Property Rental Rules contained on Exhibit A are incorporated into this Agreement by reference. Access: Renter shall allow Owner access to the Property for purposes of repair and inspection. Owner shall exercise this right of access in a reasonable manner. Rental Rate and Fees: Rent and Security Deposit Monthly Rent: $4,800, payable on the 15th of each month. Security Deposit: $1000, due at lease signing. Insurance: We encourage all renters to purchase traveler insurance. Property Security: for the security of both Renter an Owner, the property contains two motion activated video cameras that record the entrance of the house and the back entrance of the property. There are no video cameras within the house. Renter expressly agrees to the video cameras and the recordings they may make. PROPERTY RENTAL RULES Smoking is not permitted in the house or garage. Smoking is permitted outside only and smoking materials must be properly extinguished and then disposed of in trash containers or smoking receptacles, not thrown off decks or disposed outdoors. Failure to observe this prohibition shall result in immediate eviction and charged the additional cleaning fee of $500. Pet policy: There will be a pet fee of $200 per pet. There is a limit of 50lbs per pet. Please make sure to clean up after your pets and pickup any waste in surrounding areas. Please crate or kennel pets if left unattended. Please respect neighboring properties when bringing your pets. Weather: No refunds will be given for weather-related occurrences other than if a government issued evacuation order is in place. No parties. No loud music, noise, etc. will be tolerated for the peace and enjoyment of your neighbors. House parties are absolutely not tolerated, and if suspected, you will be asked to vacate immediately, with no refund. Renter should not create excessive noise at a level that disturbs neighbors; Code-enforced neighborhood quiet hours are from 10:00p.m. 7:00a.m. on Sunday through Thursday and 11:00p.m. to 7:00a.m. Friday and Saturday. Parking: There is garage and driveway parking, one parking spot on the street, and Overflow parking. Garbage: Trash pickup service is every Wednesday so you are more than welcome to dispose of any trash on that day. Please use provided trash bins and place in front of the curb before Wednesday 730am if you would like to use the service. Owner is not responsible for any accidents, injuries or illness that occurs while on the Property or while using amenities such as bikes provided or beach equipment. It is agreed that all Renter are expressly assuming the risk of any harm arising from their use of, or from others whom they invite to use, the Property and amenities. The Owner is not responsible for the loss of personal belongings or valuables of the Renter. Please keep provided bikes, property and all furnishings in good order. Notify Owner immediately of any damage. Renter shall not touch or disconnect any cables or equipment. Should a Renter do so, Owner may, at Owner's sole discretion, make a claim against rental Deposit as actual and/or liquidated damages. Better ask the owners first. Only use appliances for their intended uses. IMPORTANT: Please note that the monthly rent is subject to change based on the time of year. The rent is $4,500 per month from November to March, while April to May is $7,500 per month. June and July have a monthly rent of $12,000, and August to October is $7500.
