USE OF PREMISES: During the term of the Lease, the premises shall be used by the Tenant with the following: a. The premises will be used solely for the purpose of a residence by a single family. For purposes of this Lease, a family shall mean and individual, or two or more persons related by blood or marriage or a group of not more than five persons not related by blood or marriage. In no event, however, shall more than eight (5) persons live together in the dwelling unit. b. Premises shall not be used for any activity or purpose that would result in an increase in the premium for the insurance on the property or the cancellation or termination of such insurance. c. Premises shall not be used for any activity or purpose that is in violation of any state, rule, ordinance, regulation, permit or other requirement of any government authority having jurisdiction over the premises. d. Premises shall not be used for any activity or purpose that is generally regarded as obnoxious or offensive or a source of nuisance, danger or hazard to any person or property. e. Care will be exercised by the Tenant in making of noise and the use of musical instruments, radios, televisions, amplifiers, and other sources of noise so that occupants of neighboring premises shall not be unreasonably disturbed or annoyed. f. Tenant shall not post, hang, place or display signs, advertisements, posters, apparel, laundry, decorations, or other material on or from the exterior of the dwelling unit on the premises herein described. 4. DEFAULT: in the event that there is a breach of any term or condition of this Lease agreement, then in said event, the Landlord shall have the right to terminate this Lease by giving the Tenant Personally, or leaving at the leased premises, a written notice to quit and vacate the premises and this Lease shall terminate upon the expiration of the applicable period of time provided by law. The Landlord, at the expiration of said period of time, shall thereupon be entitled to immediate possession of said premises and may utilize any remedy provided by law for the restitution of possession and the recovery of delinquent rent. In the event that the Landlord shall find it necessary to expend any monies in legally enforcing any provisions of this Lease, Tenant agrees to be liable for such expenditures a s allowed by law, together with reasonable attorney's fees and court costs. 5. SURRENDER: The Tenant will, upon termination of this Lease surrender the premises and all fixtures and equipment of the Landlord therein in as good or in the same repair and condition as the commencement of the tenancy, reasonable wear and tear excepted. The Tenant shall, at the time of vacating the premises, clean said premises including stove and refrigerator, and remove trash from the premises. Upon vacating the premises, the Tenant shall promptly deliver keys to the premises to the Landlord. 6. SUBLET: Parties acknowledge tenant will place member in the house through formal lease agreement. Tenant remains accountable to landlord for lease obligations. Landlord shall not look to subtenants or contact relate to lease obligations without expressed agreement with tenants. 7. INSPECTION: The Landlord shall have the right to inspect and make repairs to the property and to the fixtures, appliances, furnishings, facilities, and features thereof during the rental period. Landlord agrees to provide 24 hour notice to tenant for any non-emergency inspections or repairs. 8. RESPONSIBILITY: The Tenant shall be responsible for any damage inflicted upon the premises during the term of this Lease, whether caused by the Tennant, Tennant's family members, Tenant's guests or pets of the Tenant. 9. DESTRUCTION: If the premises are rendered unrentable by reason of fire or unavoidable accidents, this Lease shall immediately terminate and the Tenant shall be entitled to a refund from the Landlord for rent hereunder for the period after the day of the fire or unavoidable accident. 10. HOLD HARMLESS: The Landlord will be held free and harmless by tenant from any and all loss, claim or damage by reason of any accident, injury or damage to any personal property occurring anywhere on or about the Lease premises which is within the exclusive control of the Tenant. 11. WAIVER: Any waiver of any of any term or condition of this lease shall not be deemed a waiver of this Lease Agreement or any subsequent breach of any term or condition contained herein. Acquiescence in breach of any term or condition of this lease shall not operate as a waiver of such default even though such acquiescence continues for an extended period of time. 12. ALTERATIONS: The Tenant will not remodel or make any structural changes, alterations, or additions to the premises; will not paper, paint, or decorate, nor install, attach, remove of exchange appliances or equipment such as air conditioning, heating, refrigerating or cooking units, radio or television antennas nor drive nails or other devices into the walls or woodwork; nor change the existing locks to the premises. 13. SECURITY DEPOSIT: The Tenant shall deposit with the Landlord the same of $5000 which sum does not exceed two months rent, which is to be paid as collateral security and applied on any rent that may remain due and owing at the expiration of this Agreement, any extension thereof or holding over period or applied to any damages to the premises caused by the Tenant, his family, guests, or pets or other damages suffered by the landlord as a result of a breach of any covenant or provision of this Lease. The Tenant may not utilize the security deposit as rent and shall not apply the said security deposit shall have been utilized by the Landlord in accordance with the terms hereof or applicable law, the Tenant shall upon delivery of notice of same, immediately deposit with the Landlord the amount so applied by the Landlord so that the Landlord shall have the full deposit on hand at all times during the term of this Lease. The Landlord acknowledges receipt of aforesaid deposit which shall be made within thirty (30) days after receipt of said funds in a banking or savings system with the State of Maryland and which account shall be devoted exclusively to security deposits. Upon written request from the Tenant, the Landlord shall promptly provide Tenant with a written list of damages. Said request must be made within fifteen (15) days of the Tenant's occupancy. The Landlord shall provide the Tenant within thirty (30) days after the end of the tenancy by first class mail directed to the last know n address of the tenant, a written list of any damages to premises together with a statement of cost actually incurred. Within forty-five (45) days after the end of the tenancy, the Landlord shall return the deposit to the Tenant together with simple interest which shall have accrued in the amount of three percent (3%) per annum less any damages rightfully withheld. Interest shall accrue at six (6) month intervals from the day tenant gives Landlord the said security deposit of fifty dollars ($50.00) or more. In the event of a sale of the property upon which this premise is situated or the transfer o r assessment by the Landlord of this Lease, the Landlord shall have the right to transfer the security deposit the transferee and the Landlord shall be considered released from all liability for the return of the security deposit and the Tenant shall look solely to the new Landlord for the return of his security deposit. It is agreed that the foregoing shall apply to evert transfer or assignment made of the security deposit to t a new Landlord. In the event of any rightful or permitted assignment of this Lease by the Tenant to any assignee of sublease, the security deposit shall be deemed to be held by the Landlord as a deposit made by the assignee and the Landlord shall have no further liability with respect to return such security deposit to the assignee. Tenant has the right to be present at time of inspection to determine if any damages have been done to the premises if Tenant notifies Landlord by certified mail within fifteen (15) days prior to Tenant's date of moving or Tenant's intention to move, date of moving and new address. Upon receipt of notice, Landlord shall notify Tenant by certified mail of time and date when premises are to be inspected. The inspection date shall occur within five (5) days before or five (5) days after date of moving as designated in Tenant's notice. 14. UTILITIES: The Tenant shall pay all gas, electric, water, telephone, sewer, refuse collection, fuel charges, and other utilities (such as cable television) for the premises as an when the same shall become due and make all required deposits thereof. 15. APPLIANCES: The Tenant shall not be entitled to any refund for inoperative appliances or air conditioners. The Landlord, however, upon being notified of any malfunction, will make every reasonable effort to have such appliance or air conditioner promptly repaired. 16. INSURANCE: it shall be the responsibility of the Tenant to obtain an insurance policy which provides public liability coverage for the premises and also to provide for the protection of the tenant's property. 17. MAINTENANCE: The Tenant shall keep the grass cut, trimmed and maintained and shall generally maintain the grounds in good condition. The Tenant shall furnish his own electric light bulbs and fuses and at his own expense replace faucet washers as needed. The Tenants shall keep in a state of good repair, maintenance, and cleanliness all parts of the premises including equipment therein and shall promptly report any defect to the Landlord. Any repairs made necessary due to negligent acts of commission or omission of the Tenant, his family, guests or pets shall be paid for by the Tenant, and the Tenant shall not order repairs on or about the premises without the prior written consent of the Landlord. takes care of property.
