RENTER REQUIREMENTS Renter(s)/Tenant(s) must be twenty-five (25) years of age to rent this home and provide proof of age via government-issued identification. Any monies received by for occupancy of vacation property indicated the acceptance of the terms of our vacation rental agreement in full. All policies are strictly enforced. It is the responsibility of all guests and members of their party to be familiar with all policies pertaining to rental. For legal and accounting purposes, the person placing the reservation must be the same as the credit/debit cardholder. This person is considered to be the guest. All other persons involved with the rental are considered to be the guest's invitees, and all discussion regarding reservation, cancellation, and damage policies will be discussed with the guest, not the guest's invitees. PAYMENT If the Renter(s)/Tenant(s) reserved through a booking site (i.e. HomeAway/VRBO, Airbnb, Booking.com, FlipKey, TripAdvisor) please follow payment terms as directed. If reserved directly through Empty Spaces, please make payments by credit card or personal check (payable to Empty Spaces, LLC). An advance payment equal to twenty-five (25) percent of the total reservation is required at the time of reservation. The advance payment will be applied toward the total cost. The advance payment is not a damage deposit. The BALANCE OF THE RESERVATION is due fourteen (14) days before your arrival date. Regardless of the method of booking, the payment method must come from and match the Renter/Tenant's name on the reservation and not a third party. Third-party payments will be rejected and the reservation will be canceled unless corrected. CANCELLATION POLICY Renter(s)/Tenant(s) bookings canceled at least 14 days before the start of the stay (2:59 pm in the property's timezone) will receive a full refund. Bookings canceled at least 7 days before the start of the stay (2:59 pm in the property's timezone) will receive 50% refund. Bookings canceled under 7 days before the start of the stay will not receive a refund. 'Full refunds' will be only what was paid to and received by Empty Spaces. If the Renter(s)/Tenant(s) reserved through a third party booking site (i.e., VRBO, Airbnb, Booking.com, FlipKey, TripAdvisor., etc.), the fee(s) these sites charge the guest may not be refundable. Empty Spaces is not responsible for those fees. Please review those site's cancellation policies. Cancellation or early departure does not warrant any refund of rent. No refunds will be given for storms. Nor do we do not issue refunds due to road conditions. POOL HEAT Pool heat is NOT included. Pool heat carries an additional fee. MAXIMUM OCCUPANCY The maximum number of guests is limited to the occupancy as advertised in the property listing. CONFIRMED RESERVATIONS Renter(s)/Tenant(s) reservation is deemed confirmed only after a signed Rental Agreement hs been signed along with the required payment. ASSIGNMENT AND SUBLETTING Renter(s)/Tenant(s) shall not assign this Agreement, or sub-let or grant any license to use the premises or any part thereof. No third party reservations, the Renter(s)/Tenant(s) must accompany any other guest(s) while renting the home. Any reservation obtained under false pretenses will be subject to forfeiture of advance payment, deposit, and rental money, and the party will not be permitted to check-in. ARRIVAL TIME Check-in is at the stated time on your check-in email. Early arrival may be arranged, pending other reservations and the housekeeping schedule. Your prompt departure is appreciated so we can prepare the vacation rental for any incoming guests. A late departure may be arranged, pending other reservations and the housekeeping schedule. ACKNOWLEDGEMENT OF PREMISES On the day of arrival, the Renter(s)/Tenant(s) must notify the leasing company of any undocumented, existing damage within two (2) hours of checking in or otherwise acknowledges that said premises are in good and satisfactory order unless otherwise specified herein. Renter(s)/Tenant(s) takes premises in its AS-IS condition. Renter(s)/Tenant(s) agrees not to damage the premises through any act of omission and to be responsible for any damages sustained through the acts or omissions of Renter(s)/Tenant(s), Renter(s)/Tenant(s) family or Renter(s)/Tenant(s) invitees, licensees, and/or guests. If such damages are incurred, Renter(s)/Tenant(s) is required to pay for any resulting repairs at the same time and in addition any lost rent revenue as a result of such damages. DAMAGE PROTECTION AND RESERVATION DEPOSIT Renter(s)/Tenant(s) who reserve on Airbnb will be responsible for damages, per Airbnb's Host Guarantee. For all other channels, a property damage protection insurance policy may be included in your stay. Renter(s)/Tenant(s) are responsible for any damage(s) not covered by or that exceed the damage protection insurance. Renter(s)/Tenant(s) that refuse to purchase property damage protection insurance, may be asked to pay a refundable security deposit of five hundred ($500) dollars. The security deposit must be received before fourteen (14) days of the check-in date. The security deposit is NOT applied toward rent and is fully refundable within fourteen (14) days of departure, provided the following provisions are met: No damage is done to the home or its contents, beyond normal wear and tear. No charges are incurred due to contraband, animals, unpaid pool heat, if applicable, collection of rents or services rendered during the stay. All debris, rubbish, and discards are placed in garbage toters provided and soiled dishes are cleaned. All keys and garage remotes, if applicable, are returned and the home's doors and windows are left locked. All charges accrued during the stay are paid prior to departure. No personal property is missing or damaged. No early check-in or late check-out, unless otherwise agreed in writing. The Renter(s)/Tenant(s) are not evicted by the owner(s)(or representative of the owner(s)), the local law enforcement, or the security company employed by the association. The strict observance of the home's instructions. DISTURBANCES AND VIOLATION OF LAWS Renter(s)/Tenant(s), guests and invitees shall not use the premises for any unlawful purpose and shall comply fully with all applicable federal, state and local laws and ordinances, including laws prohibiting the use, possession or sale of illegal drugs. Nor shall Renter(s)/Tenant(s), guests and invitees use the premises in a manner offensive to others, create a nuisance by annoying, disturbing, inconveniencing or interfering with the quiet enjoyment of any other renter or nearby residents. Renter(s)/Tenant(s) agrees to immediately inform the leasing company and the appropriate authorities upon obtaining actual knowledge of any illegal acts on or upon the leased premises. This is a NON-SMOKING property (including all tobacco and marijuana products). If it is found that smoking has taken place inside the property, the Renter(s)/Tenant(s) will forfeit their security deposit and may be charged damages. Smoking tobacco products is allowed outside. Please pick up all cigarette butts and clean any ash from the property or additional cleaning fees may be charged. To ensure our guests' legal compliance with Lake Havasu City code 9.30.050 and our no parties policy, the backyard areas of our homes utilize smart home noise sensors to monitor ambient noise levels. Please note that Sunday - Thursday from 10:00 p.m. to 7:00 a.m., noise levels should not exceed 45 dB, and from 7:00 a.m. to 10:00 p.m., noise levels should not exceed 55 dB. Friday - Saturday (weekends) and Holidays from 12:00 a.m. to 7:00 a.m., noise levels should not exceed 45 dB, and from 7:00 a.m. to 12:00 a.m. noise levels should not exceed 65 dB. For reference, 40-50dB is equivalent to a quiet conversation, 50-60dB is equivalent to normal conversation or background music, and 60-70dB is equivalent to normal music volume or a car driving by. Please be advised that these devices do not record sounds, but rather monitor ambient noise levels in the backyard and notify reservations if legal sound levels are exceeded. Guests are not permitted to unplug, move, or otherwise tamper with these sensors. ANIMALS This is an animal conscientious property. With written pre-approval and a two hundred and fifty dollars ($250+tax) animal fee, up to two dogs only are permitted in the rental home. The Renter(s)/Tenant(s) is/are required to keep the dog(s) off all furniture and carpeted/rugged areas, be crated if left alone in the home and remove feces from the property. Failure to do so may result in additional charges. If it is found that an animal has been inside the property without written pre-approval, the Renter(s)/Tenant(s) will forfeit their security deposit and may be charged damages of up to five hundred dollars ($500). We respect service animals. NO SHOE POLICY We ask that the Renter(s)/Tenant(s) and their guests remove shoes while in the home. Stains, dirt, and discoloration will be cause for carpet cleaning costs to be deducted from your deposit. SMOKING/VAPING/MARIJUANA This rental home is a NON-SMOKING/NON-VAPING property (including all tobacco and marijuana products). If it is found that smoking/vaping has taken place inside the property, the Renter(s)/Tenant(s) will be charged damages up to five hundred dollars ($500). Smoking/vaping products are allowed outside. Please pick up all cigarette butts and clean any ash from the property or additional cleaning fees may be charged. NO DAILY HOUSEKEEPING SERVICE Rates include a one-time linen & towel setup. While linens and bath towels are included with the rental, daily maid service is not. However, such service is available at an additional cost. We do not permit bath towels or linens to be taken from the home or used outdoors. Pool towels are provided if a pool/spa is available at your reserved property. LOST AND FOUND POLICY We are not responsible for any item left behind by a guest. However, any item, with the exception of perishable items, left behind by our guests and found after departure by management will be collected and stored for collection by the owner for up to thirty (30) days. If you discover that you have left behind something of value to you, please call us immediately and we will try to assist you in locating your lost item. We would be happy to return your lost item(s) for a packaging, postage, and handling fee. We are not responsible for any item lost or misdirected during shipment by the shipper. PLUMBING The mineral content in the water can be high. The sewer system is very effective; however, it will clog up if improper material is flushed. DO NOT FLUSH feminine hygiene products and/or toilet/baby wipes, etc. ONLY small amounts of toilet paper should be flushed. If it is found that feminine products have been flushed and clog the sewer system, Renter(s)/Tenant(s) may be charged damages of up to five hundred dollars ($500). STORM POLICY/ROAD CONDITIONS No refunds will be given for storms. We do not issue refunds due to road conditions. EMERGENCIES/ MAINTENANCE In the event of a problem accessing the rental or if there are problems with the condition or functionality of the rental property, please immediately contact Empty Spaces' office or representative at 888-40-ESVRM. RIGHT OF ENTRY Guest(s) agree that Empty Spaces LLC reserves the right to enter the rental property at any time to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements as we may deem appropriate. SECURITY & SAFETY RISKS Always lock doors and windows when you leave the rental. When you rent the rental property, you assume responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave the rental. Empty Spaces does not assume any responsibility for injuries resulting from your failure to use due caution. Children must be supervised at all times. Candles are not allowed due to fire hazard. This home has an exterior doorbell camera for safety. Any attempt at disabling, redirecting, or obscuring the camera is prohibited and will be treated as intentional damage to the property and you will be charged fines for restitution. ARIZONA POOL DISCLOSURE Arizona legislature has passed a law requiring occupants of "dwellings with pools," and persons having a pool installed, receive this safety message about steps to prevent drownings and the legal responsibilities of pool ownership. This law aims to impede children's access to their pools. 4.107 Swimming Pools A. Location 1. Residential Districts In any residential district, private swimming pools shall be located in the side or rear yards and shall not be any closer than 3 feet from any property line and may not be located within any recorded easement except with the written approval of the easement holder. In the case of a corner lot, a pool may not be located closer than 5 feet to the street side property line. Minimum width of yards for pools adjacent to an alley, an alley easement, a street, or an existing building shall not be less than the depth of the pool adjacent thereto unless approved in writing by the Building Inspections Department and in no case shall the yards be reduced to less than 3 feet in the side or rear yard, or 3 feet in the street side yard. B. Enclosures and Gates 1. Enclosures All swimming pools shall be enclosed by walls of a single-family residential building or by a solid wall or a chain link or wrought iron fence not less than 5 feet nor more than 6 feet in height. If the design or the material of the fence or gate is such that there are openings, such openings shall be of a size to prohibit a spherical object 4 inches in diameter from passing through or under the fence or gate. Enclosures and Gates 2. Gates All gates shall be substantially the same height as the wall or the fence and shall be self-closing and self-latching and be constructed in such a manner as to prevent uninvited access. Arizona Revised Statutes 36 1681(E). 2 "Pool" means an in ground or above ground swimming pool or other contained body of water eighteen (18) or more inches in depth at any point, wider than eight (8) feet at any point and intended for swimming. By signing below, I understand that the property being rented has a swimming pool and spa. This pool meets all local codes and regulations. I also understand that the swimming pool is NOT enclosed by a fence separating it from the remainder of the backyard. It is also understood that the entrance from the home into the pool area/backyard is a conventional sliding style door and self-closing doors. The sliding doors DO NOT automatically shut, DO NOT automatically lock, and has no sensors on it. It is understood that the screen doors DO self-close with safety latches on the upper part of the doors, which, when closed, will not allow the door to open. This must be manually locked and unlocked for each use, and it is solely up to the operator to ensure it is in a locked position when the door is closed. I, the Renter (s)/Tenant(s), and any other parties associated during the rental period assume all liability and risk when renting this property. I agree to abide by all rental rules and regulations. SWIMMING POOL/SPA GUIDELINES Drowning is a serious threat to young children. Young children also suffer from a high number of near drownings that may lead to permanent or severe disability. Most of these incidents occur in the child's backyard pool. These tragedies must be stopped. SUPERVISION IS THE KEY TO PREVENT DROWNINGS! Never leave children unsupervised in the pool or near the pool area, NOT EVEN FOR A SECOND! Inform guests in the home of the importance of closely watching children around water. At parties, make sure someone is always watching the children around the pool. Do not count on barriers to keep children from reaching the pool. NO BARRIER IS GUARANTEED! Obstacles only slow a child's access to the pool. NEVER LEAVE CHILDREN UNDER EIGHTEEN (18) UNSUPERVISED IN THE POOL OR NEAR THE POOL AREA IN CASE OF AN EMERGENCY - ACT IMMEDIATELY 1. SHOUT for help 2. PULL the child out of the water 3. TAKE the child to the phone and DIAL 911 for help. 4. CHECK airway and breathing. If needed, start CPR immediately. CPR can save lives and prevent serious injury. DOs Do attend a CPR class. All family members and babysitters should know CPR. For the nearest class, contact your local fire department. Do post 911 (or the local emergency number) on all phones. Do learn water rescue. Keep lifesaving equipment mounted near the pool, especially if you cannot swim. Do lock passageways (such as animal doors) leading to the pool. Do inspect latches and gates regularly. Please keep them in working order. Do set a good example. Insist on safety around the pool. DON'Ts Do not, under any circumstances, modify or disable the self-closing doors to the rear yard. These are designed to self-close as a safety measure but are not guaranteed. Do not keep toys, tricycles, or other playthings in the spa area. Remove items that a child could use to climb the barrier. Do not be distracted by phone calls, doorbells, or chores while children are in the pool. Your full attention should be on the children. Do not rely on swimming lessons or "floaties" to protect your children. Do not dive or jump into the pool. AGENCY RELATION Empty Spaces, LLC represents the Owner (s) of the property in this transaction. ATTORNEYS' FEES Should it become necessary to employ an attorney to enforce any of the conditions or covenants hereof, including the collection of rentals or gaining possession of the premises, Renter (s)/Tenant(s) agrees to pay all expenses so incurred, including reasonable attorney fees, costs related to any action that may be taken by the Owner, and an annual compounded interest rate of eighteen (18) percent on any outstanding balances. GOVERNING LAW The laws of the state in which the property is located shall govern this Rental Agreement. INDEMNIFICATION & HOLD HARMLESS No failure of Empty Spaces LLC to enforce any term hereof shall be deemed a waiver, nor shall any acceptance of partial payment of rent be deemed a waiver of Empty Spaces LLC's right to the full amount thereof or affect any notice or legal eviction proceedings in the theretofore given or commenced under state law. The home is privately owned; the Owner (s) and Empty Spaces, LLC is not responsible for any accidents, injuries, or illness that occurs while on the premises or its facilities. The Homeowner(s) and/or Empty Spaces, LLC is not responsible for the loss of personal belongings or valuables of the Renter(s)/Tenant(s) or the Renter(s)/Tenant(s) guests. By accepting this reservation, it is agreed that the Renter(s)/Tenant(s) and their guest(s) are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.
