Term The Lease shall commence on the agreed start date and end on the agreed termination date, unless extended in writing by both parties or terminated with at least thirty (30) days' written notice by either party. 2. Holdover If Tenant remains in possession after expiration of the Lease with Landlord's consent, the tenancy will convert to month-to-month, subject to the terms of this Lease, unless a new lease is signed. 3. Rent Payment Tenant shall pay monthly rent in the agreed amount, due in advance on the first (1st) day of each calendar month. Rent may be paid via electronic deposit, Zelle, or other method designated by Landlord. Late Charges: If rent is not received by the fifth (5th) day of the month, a $50 late charge will apply, plus $10 per day thereafter until paid. Returned Checks: Returned payments must be redeemed by cashier's check, certified check, or money order. Tenant will be charged $50 handling plus a $50 late charge and $10 per day until payment is made. Rent Increases: Rent shall not increase during the initial term. After expiration, Landlord may reasonably increase rent with thirty (30) days' written notice. If rent is not received by the tenth (10th) of the month and no prior arrangements are made, Landlord may issue an eviction notice. 4. Utilities and Fines Tenant shall pay all utilities, including electricity, gas, water, trash, telephone, and cable. Tenant shall also be responsible for any fines (e.g., HOA violations or municipal penalties) caused by Tenant. 5. Security Deposit Tenant shall pay a security deposit equal to one month's rent at lease signing. The deposit will be held by Landlord as security against damages, unpaid rent, or failure to leave the Premises clean, normal wear and tear excepted. Deposit cannot be used for last month's rent. Refunds, less lawful deductions, will be returned within sixty (60) days after termination and inspection. Deductions may be made for: unpaid rent, unreturned keys, damages beyond normal wear, cleaning, and prorated painting/carpet/drapery if tenancy is less than two years. Charges: $5 per unreturned key, $75 for lock replacement. 6. Occupants The Premises shall be occupied only by the Tenant(s) named in the Lease and their immediate family members. 7. Assignment and Subletting Tenant may not assign, sublet, or transfer the Premises without Landlord's prior written consent. 8. Locks and Right of Entry No locks may be added or changed without Landlord's written consent. Landlord may enter with 24-hour notice for inspections, repairs, or showings, or immediately in case of emergency. 9. Premises Condition Tenant accepts the Premises in good condition unless otherwise noted. Any defects must be reported within three (3) days of move-in; otherwise, the property is deemed accepted as safe and in good condition. 10. Alterations Tenant shall not make alterations, improvements, or painting without Landlord's written consent. 11. Maintenance Tenant shall maintain the Premises, perform minor repairs, and promptly notify Landlord of issues. Tenant is responsible for pest control and for damages caused by negligence or misuse. Adhesive hooks are prohibited; only small picture hooks with nails are allowed. Tenant shall not pour grease, food, or debris into drains or toilets. Tenant is responsible for sewer cleaning costs due to clogs caused by misuse. Tenant must not overload electrical circuits. 12. Repairs Repairs over $50 require Landlord's written approval. Landlord is not responsible for unauthorized repairs. Tenant is liable for damages caused by negligence of Tenant or guests. 13. Grounds Maintenance Tenant is responsible for lawn, landscaping, and snow removal, including watering, mowing, and weed/debris removal. Tenant shall be liable for damages due to neglect. 14. Rules and Regulations Tenant shall comply with all HOA and Landlord rules. No vehicle repairs allowed on the premises. Vehicles must be maintained; flat tires must be repaired within 72 hours. Unauthorized vehicles may be towed at Tenant's expense. No large trucks, trailers, or boats may be parked on the property. Tenants must respect neighbors; excessive noise may result in eviction. Waterbeds require prior approval and Tenant assumes liability for damages. 15. Pets No pets are allowed without Landlord's approval. If approved, a Pet Agreement must be signed. Maximum of three (3) pets. 16. Smoking and Marijuana Smoking of any kind (cigarettes, cigars, vaping, etc.) is prohibited inside the Premises. Marijuana use or cultivation is strictly prohibited. 17. General Agreements Tenant releases Landlord from liability for loss, injury, or damage to person or property except as required by law. Tenant is encouraged to obtain renter's insurance. Guests may not stay longer than seven (7) consecutive days without approval. Heavy furniture or items that may damage the structure are not permitted. 18. Notice to Vacate Tenant must provide thirty (30) days' written notice of intent to vacate. Notice must begin on the first (1st) of the month. If given after the first, Tenant is responsible for the following month's rent. Rent will not be prorated upon move-out. Abandoned belongings may be stored at $20/day at Tenant's expense. 19. Surrender At lease expiration, Tenant shall return the Premises in good condition, reasonable wear and tear excepted, and return all keys to Landlord. 20. Attorneys' Fees In case of legal action, the prevailing party shall be entitled to reasonable attorneys' fees and court costs. 21. Collection Fees Tenant shall be responsible for collection costs, including attorneys' fees, associated with recovery of unpaid amounts (typically 40% of balance owed). 22. Additional Provisions Appliances provided: refrigerator, dishwasher, oven/range, and A/C. Replacement fees: $100 per trash/recycle bin, $50 per mailbox key, $50 per water timer key. Tenant responsible for maintenance trip charges caused by negligence. Washer and dryer are Tenant's responsibility. 23. Entire Agreement This Lease constitutes the entire agreement between Landlord and Tenant and may only be modified in writing, signed by both parties.
