Utilities
Tenant is responsible for all utilities, including water, electricity, gas, cable, internet, and any other services required for the property. Tenant must establish accounts in their name prior to move-in and maintain continuous service during the lease term.
Pool Maintenance
For 2025, the pool will remain closed as we are getting close to the end of pool season. In 2026, the landlord will hire professional pool maintenance services during the summer season (Memorial Day through Labor Day), based on the seasonal cost and the tenants must pay the opening, upkeep and closing fees in order to use the pool. Tenants may opt to keep the pool closed if preferred. Tenants assume all risks and liabilities associated with the use of the pool, including but not limited to injuries, damages, or losses involving children, adults, pets, or visitors. The landlord shall not be held liable for any accidents, injuries, or damages occurring in or around the pool area, which are the sole responsibility of the tenants. Tenants are responsible for ensuring all users of the pool comply with safety guidelines and local regulations.
Lawn Care
Tenants are responsible for hiring and maintaining lawn care services, including mowing, edging, and general upkeep. Tenants must also collect fallen branches and place them at the curb for the City of Nashville's quarterly pickup service. Failure to maintain the lawn as outlined may result in lease violations, potentially leading to termination of the tenancy or additional charges for landlord-arranged maintenance.
Property Maintenance and Repairs
Tenants are responsible for maintaining the property in a clean and sanitary condition, including regular upkeep of interior and exterior areas not covered by landlord-provided services. Tenants must promptly report any damage, defects, or needed repairs to the landlord in writing. Failure to report issues that lead to further damage may result in tenants being held liable for repair costs. Minor repairs (e.g., replacing light bulbs, air filters, or smoke detector batteries) are the tenant's responsibility unless caused by normal wear and tear.
Property Damage
Tenants are liable for any damage to the property caused by themselves, their guests, or pets, beyond normal wear and tear. This includes but is not limited to damage to walls, floors, fixtures, appliances, or landscaping. Tenants must reimburse the landlord for repair costs within 30 days of receiving an invoice or risk forfeiture of the security deposit and potential additional charges.
Unauthorized Occupants
Only individuals listed on the lease agreement are permitted to reside in the property. Tenants must obtain written permission from the landlord for any additional occupants or long-term guests (staying longer than 14 consecutive days). Unauthorized occupants may result in lease violations, fines, or termination of the tenancy.
General Liability
Tenants assume full responsibility for any injuries, damages, or losses occurring on the property during their tenancy, whether to themselves, their guests, pets, or personal property, except where directly caused by the landlord's gross negligence. The landlord shall not be liable for any injuries, damages, or losses due to tenant negligence, misuse of the property, or failure to adhere to lease terms or local regulations. Tenants are strongly encouraged to obtain renter's insurance to cover personal property and liability.
Alterations and Modifications
Tenants may not make alterations, improvements, or modifications to the property (e.g., painting, installing fixtures, or altering landscaping) without prior written consent from the landlord. Any unauthorized alterations must be restored to the original condition at the tenant's expense, or the landlord may deduct restoration costs from the security deposit.
Compliance with Laws and Regulations
Tenants must comply with all local, state, and federal laws, as well as any homeowner association (HOA) rules, if applicable. This includes proper waste disposal, noise ordinances, and parking regulations. Violations may result in fines or lease termination, and tenants are responsible for any penalties incurred.
Pets
Pets are permitted only with prior written approval from the landlord and payment of any applicable pet deposit or fees. Tenants are responsible for any damage or disturbances caused by pets, including cleaning costs for odors, stains, or shedding. Tenants must ensure pets are controlled and comply with local leash laws and ordinances.
Smoking and Illegal Activities
Smoking of any kind (including tobacco, vaping, or other substances) is strictly prohibited inside the property. Any evidence of smoking may result in additional cleaning fees or forfeiture of the security deposit. Illegal activities on the property, including but not limited to drug use or production, are grounds for immediate lease termination and eviction.
Early Termination and Abandonment
If tenants vacate or abandon the property before the lease term ends without fulfilling lease obligations, they remain liable for rent and other charges until the lease expires or the property is re-rented, whichever occurs first. The landlord may pursue legal remedies to recover unpaid amounts.
Indemnification
Tenants agree to indemnify and hold harmless the landlord, their agents, and representatives from any claims, lawsuits, or damages arising from the tenant's use of the property, including but not limited to personal injuries, property damage, or violations of lease terms, except where caused by the landlord's gross negligence.
Security Deposit
The security deposit will be held in accordance with Tennessee state law and may be used to cover unpaid rent, damages beyond normal wear and tear, or other lease violations. Tenants will receive an itemized list of deductions, if any, within the timeframe required by law after the lease ends.
