Without the prior, express, and written consent of the Landlord, the Tenant will not assign this Lease, or sublet or grant any concession or license to use the Property or any part of the Property. A consent by the Landlord to one assignment, subletting, concession, or license, will not be deemed to be a consent to any subsequent assignment, subletting, concession, or license. Additional Clauses 37. Laundry (washing machine and dryer) in the middle garage is available to tenants during daylight hours only. 38. Quiet Hours: In coordination with Kauai County Ordinances, it is asked that the tenants keep noise levels low (45 dBA) between 10pm - 7am. 39. Zero Tolerance for Harassment, Domestic Violence, or Conflict with Neighbors: Not all of the surrounding neighbors are kind, considerate or agreeable. If tenants think their interactions with any of the surrounding neighbors will lead to conflict or escalate to a situation that requires mediation, the tenant will cease interactions. Tenants will NOT feed or touch the animals (i.e., goats, sheep, roosters, dogs, etc.) of the adjacent neighbors. 41. Energy Consumption: The house is powered by an off-grid solar energy system with battery storage. Tenant agrees to use electricity mindfully, avoiding excessive or unnecessary consumption, especially during periods of low solar input such as night time and/or cloudy days. High-energy appliances (e.g., electric heaters, air conditioners, high speed blenders, and non-essential appliances with high amperage) must be used sparingly, and within system capacity. 42. To ensure solar energy system sustainability, Tenant shall: (1) Operate laundry machine and dryer during daylight hours only. (2) Operate high-powered appliances (high speed blenders, microwaves, hair dryers, etc.) during daylight hours and avoid use at night. (3) Reduce non-essential energy use on cloudy or rainy days to prevent system depletion. If there have been multiple days of darkness and rain, please check in about the battery levels. If the battery level hits 0%, all power stops. This means food in the refrigerators will begin to go to waste, and any electrical appliances, outlets, lights, fans, etc. will not work. 43. Landlord reserves the right to provide additional guidance on energy usage to maintain system efficiency. Noncompliance that leads to system failure may result in tenant liability for damages or service disruptions. Damage to Property 44. If the Property should be damaged other than by the Tenant's negligence or willful act or that of the Tenant's employee, family, agent, or visitor and the Landlord decides not to rebuild or repair the Property, the Landlord may end this Lease by giving appropriate notice. Maintenance 45. The Tenant will, at its sole expense, keep and maintain the Property and appurtenances in good and sanitary condition and repair during the term of this Lease and any renewal of this Lease. 46. Major maintenance and repair of the Property involving anticipated or actual costs in excess of $100.00 per incident not due to the Tenant's misuse, waste, or neglect or that of the Tenant's employee, family, agent, or visitor, will be the responsibility of the Landlord or the Landlord's assigns. Care and Use of Property 47. The Tenant will promptly notify the Landlord of any damage, or of any situation that may significantly interfere with the normal use of the Property or to any furnishings supplied by the Landlord. 48. The Parties will comply with standards of health, sanitation, fire, housing and safety as required by law. 50.
