Smoking: Smoking, vaping, or e-cigarettes of any kind are strictly prohibited inside the 217 unit (even with open windows). It is also banned within all common indoor areas, hallways, or elevators. Smoking is ONLY allowed on the roof deck of the property, during the open hours of the communal roof deck. Violation of this rule will result in a partial loss of security deposit for the cleaning fees needed to remove smoke smell and grime from bedroom carpets, walls, and all other living spaces. If the unit is rented furnished, the repair or replacement of furniture in the unit will also be deducted from the security deposit.
Parking: If there are issues with the private parking spot that are not the fault of the tenant, such as breakdown of the space or damage to the set of spaces, that exceed 8 consecutive days, the landlord is not responsible to provide alternate parking for tenant(s), but will not collect the additional parking fees. This rate will not be prorated before 8 days, but if the repairs or issues take longer than 8 consecutive days, the tenant will not be required to pay the parking fee that is part of the rent, and will be reimbursed up to $100 of that month. If the tenant accidentally damages the parking space due any negligence, including but not limited to an overweight or too tall vehicle, poor driving, or misuse of the system, the tenant is responsible to pay for any associated repairs and the landlord will not reimburse for lost parking time.
Injury, Vandalism, Theft, and Building Rules: The property has many security cameras onsite, in addition to the locker system for packages and mail. However, theft of packages and mail is not the responsibility of the landlord and the landlord is under no obligation to reimburse, report, or otherwise compensate for theft. Injury or vandalism of body or belongings outside or around the unit/property (unit/property is defined as within the walls of 1511 Jefferson St, Oakland, CA) is not the responsibility of the landlord. The landlord also requires that the tenant secures renters insurance to cover incidents that may occur. The building requires all tenants within to adhere to the quiet hour policies after 10pm, requesting no loud music or partying after the posted quiet hours in the building. Tenants use the roof deck to their own discretion and safety, and are not allowed on the roof past 10pm per building rules.
Lost Key or Lockout: Tenant(s) will be provided a fob for access to the building, and keys for the unit. If either of these items are lost, or a tenant gets locked out, a fee of $75 per lockout incident and per lost item (key, fob, etc) will be needed to replace them, given that building management needs to create a new key and access fob.
Lease Terms: The lease is for a maximum of 12 months, with move out expected upon completion of the lease, unless otherwise negotiated or extended with the landlord through written communication that the renter will go month-to-month or sign another 12 month lease. Last month's rent is due at signing, along with a refundable security deposit at the value of 1 month of rent. Rent is due the 1st day of every month, and is considered late if it is not paid by the 5th day of the month. After the 5th day of nonpayment, the tenant will incur a late fee of $50. The tenant then has 3 days to pay or to quit, and they will be served a notice accordingly.
Oakland Applicants: All applicants will go through the lifetime sex offenders screening requirement to rent this unit. By applying to this unit, you acknowledge that you will be screened for this requirement. If you wish to not be screened for the lifetime sex offenders list, either do not apply or withdraw your application.
Repairs and Landlord Entry: Landlord is required to give the tenant 24 hour advance notice of entry for repairs, unless otherwise coordinated and requested by the tenant for an urgent repair.
