RESIDENTIAL LEASE AGREEMENT
1. Term, Rent, Security Deposit, & Utility Details
Lease Term & Duration (Month-to-Month): This Agreement shall operate as a month-to-month tenancy, beginning on the commencement date specified below. The Tenant acknowledges and agrees that because this property is an owner-occupied residential building with 4 or fewer units, it is classified as "nonrestricted property" under NH RSA 540:1-a, I. This Lease shall automatically renew each month unless either the Landlord or the Tenant provides the other party with a strict thirty (30) days' prior written notice of their intent to terminate the tenancy without cause, in accordance with New Hampshire law (RSA 540:3, II).
Rent Due Date, Late Fees & Payment Methods: Monthly rent is strictly due in advance on or before the 1st day of each calendar month. Rent must be paid via cash, money order, or an electronic payment application to be mutually agreed upon by the Landlord and Tenant. If rent is not received in full by 11:59 PM on the 15th day of the month, a one-time late fee of $75.00 shall be immediately assessed. The imposition of late fees does not constitute an extension of the rent due date or a waiver of the Landlord's right to demand immediate payment. If rent remains unpaid, the Landlord reserves the right to serve a statutory 7-Day Notice to Quit for non-payment of rent at any time after the 1st of the month, as permitted by New Hampshire law (RSA 540:2).
Monthly Rent: $1,625
Security Deposit & NH Statutory Disclosures (RSA 540-A):
o Holding of Funds: The Security Deposit of $1,625 shall be held in trust at a New Hampshire financial institution and will not be commingled with the Landlord's personal funds.
o The Landlord shall provide a written receipt specifying the bank name and account number within the statutorily required timeframe.
o Interest Accrual: For any tenancy lasting one (1) year or longer, the Landlord shall pay interest at the regular savings account rate paid by the holding institution upon termination of the tenancy.
o Return and Deductions: Within thirty (30) days after the Tenant vacates and surrenders keys, the Landlord shall return the full deposit plus interest, minus any itemized, documented deductions.
Required 5-Day Move-In Notice: The Tenant has five (5) days from the date of occupancy to submit a written list to the Landlord detailing any pre-existing damages or defects requiring repair.
Smoking Policy: Smoking is strictly prohibited indoors. Outdoor smoking is permitted exclusively if the tenant supplies, maintains, and utilizes proper fire-safe receptacles.
Utilities, Propane & Shared Garage Electricity Restriction: Tenant's responsibility.
Utilities: Tenant is responsible for utilities, which are metered in the tenant's name. (Note: Propane heat/hot water runs roughly $350/month during peak winter months, depending on personal usage). The reserved landlord's garage is connected to the property's electric meter; however, a permanent, automatic monthly rent credit of $25 is factored into the advertised rent to fully cover any baseline garage electricity. The garage will strictly be used for light, intermittent utility purposes (lights and garage door opener only no high-draw appliances or space heaters). The Tenant is strictly required to contact both the electric utility provider and the propane provider on or before their official move-in day to establish their respective direct consumer utility accounts and complete any required application or credit screening processes.
o Propane: The propane tanks are the exclusive property of Bot-L-Gas (8 E Otterson Street, Nashua, NH 03060 ). The Tenant is strictly required to use Bot-L-Gas as their sole propane provider (propane heat/hot water runs roughly $350/month in peak winter depending on usage). The Tenant shall not permit any other provider to fill, service, or alter the tanks.
Shared Garage Electricity & Fixed Rent Credit: Shared Garage Electricity & Fixed Rent Credit: The Tenant acknowledges and agrees that the electrical service for the detached garage (utilized exclusively by the Landlord) is physically connected to the apartment's primary electric meter. Both parties agree that the monthly electrical consumption of the Landlord's seasonal or intermittent usage is reasonably estimated at $25.00 per month. In full satisfaction of this usage, the Landlord shall provide the Tenant with a permanent, fixed monthly rent credit of $25.00, applied automatically on the first (1st) day of every calendar month. The Tenant accepts this fixed credit as a fair and equitable apportionment of the utility cost under RSA 540-A:3. If the Landlord introduces heavy electrical loads to the garage (such as an electric vehicle charger or commercial machinery), both parties agree to re-negotiate this credit in good faith.
Winter Heating, Shared Well Infrastructure & Freeze Protection (Statutory Period: September 15 June 15):
The Tenant acknowledges that the Premises shares a well water supply system with the adjacent primary residence, and that the professional well filtration hardware is located in the Landlord's separate basement. To preserve the integrity of this shared plumbing infrastructure and prevent system-wide water disruptions, the Tenant is strictly required to maintain a continuous, uninterrupted interior temperature of no less than 62 F (16.5 C) inside all areas of the leased Premises throughout the entire designated winter heating season (September 15 through June 15). This heating requirement applies strictly at all times, including during periods of tenant travel, vacation, or extended absence. The Tenant shall not turn off the heating system, cut power to the heating units, or lower the thermostat below this 62 F threshold under any circumstances. If the Tenant fails to maintain this minimum temperature or fails to maintain adequate fuel/propane levels resulting in a heating failure, the Tenant shall be held strictly and fully liable for all resulting damages. This includes the actual cost of emergency plumbing repairs, pipe thawing services, and property remediation required both within the leased Premises and any damages cascading to the shared well system or the Landlord's adjacent property. The Landlord remains solely responsible for the standard maintenance and electrical operation of the well filtration system located within the Landlord's personal basement, provided no tenant negligence or heating failure caused the issue.
Water, Sewer & Septic Guidelines:
The Premises relies on private well water equipped with a professional filtration system (located in the Landlord's separate basement and maintained entirely by the Landlord) and a private septic system. The Landlord shall maintain both systems in good working order in accordance with New Hampshire health and habitability standards.
o Septic System Compliance: The Tenant agrees to use only septic-safe products (such as quick-dissolving, septic-safe toilet paper and biodegradable cleaning products). The Tenant shall not flush or dispose of any non-biodegradable items down the toilets or drains. This includes but is not limited to: "flushable" wipes, baby wipes, feminine hygiene products, paper towels, facial tissues, dental floss, cigarettes, coffee grounds, fats, oils, grease, or harsh chemical drain cleaners (like Drano).
o Liability for Damage: In the event of a system backup, blockage, or failure, the Landlord will promptly arrange for professional plumbing diagnostics and remediation. If a licensed professional determines and documents that the system backup or failure was directly caused by the Tenant's disposal of prohibited materials or negligence, the Tenant shall be strictly liable to reimburse the Landlord for the full cost of the diagnostic, clearing, and property remediation within fifteen (15) days of receiving an invoice.
Appliances & Maintenance:
o The stove, microwave, and refrigerator located within the Premises are the property of the Landlord and shall be maintained, repaired, or replaced by the Landlord in accordance with standard habitability requirements.
o Gifted Washer/Dryer Transfer of Ownership: The Premises include standard washer and dryer hookups. The Tenant acknowledges that the existing washing machine and clothes dryer currently located in the unit were left behind by a previous occupant. Upon execution of this Lease, ownership of these laundry units is officially transferred to the Tenant strictly in "as-is" condition, with zero warranties regarding operational status, safety, or longevity.
o Maintenance & Ultimate Disposal: These laundry units are NOT the property of the Landlord. The Landlord assumes zero responsibility for their maintenance, mechanical repair, or eventual replacement. Because the Tenant owns these units, the Tenant is strictly responsible for their eventual disposal and removal from the property if they fail.
o Water Damage Liability: The Tenant is solely responsible for ensuring all utility hoses, venting, and plumbing connections are tightly secured, regularly inspected, and properly maintained. The Tenant assumes full financial liability for any property or structural damage caused by a failure, leak, or malfunction of these laundry appliances, and agrees that any such damage shall be covered under the Tenant's mandatory renter's insurance policy as required by this Agreement.
2. Occupancy, Guests, & Property Restrictions
Winter Care & Snow/Ice Removal:
Landlord's Driveway Responsibility: The Landlord shall be responsible for plowing or clearing the shared driveway and designated shared parking areas. Professional plowing services or Landlord clearing will typically commence only after a winter storm concludes and a minimum accumulation of two (2) inches of snow has occurred. The Tenant is responsible for moving their vehicle(s) promptly upon request to allow for complete and safe clearing of the parking areas. The Landlord assumes no liability for vehicle damage or delays caused by active, ongoing winter weather events.
Tenant's Private Entryway Duties: The Tenant is strictly and solely responsible for the timely clearing, shoveling, and de-icing of all private, non-shared walkways, entryways, private decks, and steps leading exclusively to the leased Premises.
Timeline & Safety Standard: The Tenant must clear all accumulated snow and apply ice-melt/salt to these exclusive areas within twenty-four (24) hours of the conclusion of any winter weather event or snowfall. The Tenant agrees to maintain these paths in a safe condition throughout the winter season to prevent ice accumulation from roof runoff or melting snow.
Assumption of Risk & Indemnification: The Tenant acknowledges that the Landlord does not monitor or clear these private, non-shared entry areas. The Tenant assumes all risks associated with snow and ice accumulation on their exclusive walkways and steps. The Tenant agrees to indemnify, defend, and hold the Landlord harmless from any claims, damages, or injuries (including slip-and-fall claims by the Tenant, their household members, guests, or invitees) arising from the Tenant's failure to properly and timely clear snow and ice from these areas.
Pet Policy & Rules:
Prior Written Consent Required: Pets are strictly prohibited from entering or being kept on the Premises, even temporarily, without the Landlord's prior express written approval. To be considered, the Tenant must provide proof of up-to-date vaccinations, rabies shots, and spay/neuter status for the specific animal.
Execution of Pet Addendum: If an animal is approved by the Landlord, the Tenant must execute a separate, binding Pet Addendum prior to the animal entering the property. The Pet Addendum will outline specific rules regarding waste disposal, leash requirements, and any applicable pet fees or pet rent. Landlord will provide a pet addendum for the tenant to execute.
Homeowners Insurance Limitations: The Tenant agrees that no animal classified as an aggressive breed by the Landlord's homeowner's insurance provider shall be permitted on the property under any circumstances.
Assistance and Service Animals: In accordance with federal law and New Hampshire RSA 354-A, verified Service Animals and Emotional Support Animals (ESAs) are permitted and are exempt from standard pet fees or breed restrictions. However, the Tenant must request reasonable accommodation in advance and provide legitimate, verifiable documentation from a licensed healthcare professional confirming the need for the assistance animal, unless the disability and need are readily apparent. The Tenant remains strictly liable for any physical property damage caused by any animal, including assistance animals.
Mandatory Renters Insurance:
o Minimum Policy Limits: The Tenant is strictly required to procure and continuously maintain a comprehensive Renters Insurance policy throughout the entire duration of the tenancy. The policy must include a minimum of $300,000.00 in Personal Liability coverage to protect against bodily injury and property damage, as well as adequate personal property coverage for the Tenant's belongings.
o Landlord Status & Notification: The policy must explicitly list the Landlord as an "Additional Interested Party" (or "Party of Interest"). The Tenant shall instruct the insurance carrier to provide the Landlord with direct, automated written notice at least ten (10) days prior to any policy cancellation, non-renewal, lapse, or material modification.
o Proof of Coverage & Enforcement: The Tenant must provide the Landlord with a formal Certificate of Insurance confirming the required coverage limits and interested party status on or before the lease commencement date, and prior to receiving keys or occupying the Premises. Failure to maintain this insurance policy continuously shall constitute a material breach of this Lease Agreement and serve as immediate grounds for lease termination under New Hampshire law. The Landlord's homeowner's insurance does not cover the Tenant's personal property or personal liability.
On-Site Landlord Right of Entry:
o Standard Notice Requirements: In accordance with New Hampshire law (RSA 540-A:3, V), the Landlord reserves the right to enter the leased Premises to perform routine maintenance, necessary or agreed-upon repairs, decorations, alterations, or to exhibit the unit to prospective tenants or purchasers. Except in cases of emergency or tenant consent, the Landlord shall provide the Tenant with a minimum of twenty-four (24) hours' prior written or electronic notice (via text message or email).
o Reasonable Hours Constraint: Any such standard entry must occur only during reasonable hours (defined as Monday through Sunday between 8:00 AM and 6:00 PM), unless the Tenant explicitly consents to a different time frame in writing.
o Immediate Emergency Exception: The Tenant acknowledges and agrees that the Landlord reserves the absolute right to enter the Premises immediately and without prior notice in the event of an emergency. Emergencies include but are not limited to: a suspected water or plumbing leak affecting the shared well/septic system, a fire, an active structural failure, or an active heating failure during the designated winter heating season. The Landlord shall notify the Tenant of the emergency entry as soon as practically possible following the event.
Parking, Lawn Use, & Exterior Boundaries: The Landlord grants the Tenant specific, non-exclusive use of designated exterior areas of the property as follows:
o Parking Restrictions & Vehicle Limits: The Tenant is permitted a maximum of (2) personal vehicles on the property. These vehicles must be parked strictly within the designated parking area located directly in front of the apartment entrance. All vehicles kept on the Premises must be currently registered, fully operational, and free of hazardous fluid leaks. Vehicles must be parked so that they do not block the shared driveway, mailbox access, or the Landlord's personal access routes.
o Unauthorized Parking & Towing Enforcement: Parking on lawns, landscaped areas, or blocking shared access routes is strictly prohibited. The Tenant agrees that any vehicle parked in violation of this Agreement, or any unregistered/inoperable vehicle left on the property for more than forty-eight (48) hours without written permission, may be towed away at the vehicle owner's sole expense in accordance with NH RSA 262:40-a.
o Vehicle Maintenance Prohibition & Environmental Protection: Automotive repairs, mechanical overhauls, fluid changes (including oil, coolant, or transmission fluid changes), or any major vehicle maintenance tasks are strictly prohibited anywhere on the property, including the driveway, parking areas, garage exterior, or lawns. Because the property utilizes a shared well water system, the Tenant assumes full financial and legal liability for the complete remediation and clean-up costs of any environmental contamination or property damage resulting from vehicle fluid leaks or prohibited maintenance.
o Lawn & Sitting Areas: The Tenant is granted the non-exclusive right to use the two front lawns, as well as the designated side area of the property, as a private outdoor sitting area. The Tenant may set up standard, weather-resistant outdoor patio furniture in these designated areas, provided the space is kept clean, sanitary, safe, and free of debris.
o Property Maintenance & Mowing Co-op: Because the Landlord maintains the lawns, the Tenant agrees to position outdoor furniture so that it does not obstruct routine landscaping or lawn mowing services. The Tenant may be required to temporarily move furniture upon request for property maintenance
o Prohibited Exterior Storage & Fire Hazards: The Tenant shall not store or accumulate indoor furniture, appliances, tarps, vehicle parts, construction materials, trash bags, or general "visual clutter" in any outdoor areas. To ensure compliance with local Hudson fire safety guidelines and protect the property, open-flame fire pits, campfires, and charcoal grills are strictly prohibited in these areas without the express, prior written consent of the Landlord.
o Trash, Recycling, & Exterior Maintenance: The Tenant is solely responsible for maintaining, cleaning, and sanitizing their designated trash and recycling bins to prevent odors and pest issues. The Tenant is strictly required to transport the bins to the curb on designated collection days and must promptly return the empty bins to their proper storage location away from public view on the same day after collection. No loose bags, uncontained refuse, or hazardous items may be stored outside. The Tenant shall not store any indoor furniture, automotive parts, or general clutter anywhere on the exterior of the property.
o On-Site Landlord Privacy & Strict Boundaries: Because the Landlords reside on-site in the adjacent primary residence, the Tenant agrees to respect the physical boundaries of the Landlord's private living, deck, patio, and yard spaces, which are strictly off-limits to the Tenant and their guests. No personal property, trash, or tenant storage is permitted outside of the designated tenant areas. The Tenant agrees to respect the Landlord's right to quiet enjoyment of their primary residence and shall ensure all guests do the same.
Authorized Occupants: The Premises shall be occupied strictly as a private, single-family residential dwelling solely by the Tenant(s) explicitly named and executing this Lease Agreement.
o Permanent and Overnight Guests: The Tenant has the right to host occasional casual guests. However, to protect the shared well, septic, and propane infrastructure, any guest staying overnight for more than fourteen (14) consecutive days, or more than a total of thirty (30) days in any twelve-month period, shall be considered an unauthorized occupant. To permit any person not named in this Lease to reside at the Premises beyond these limits, the Tenant must obtain the Landlord's prior written consent, and the proposed occupant must successfully pass the Landlord's standard screening and background check at the Tenant's sole expense. Guests are strictly prohibited from using the property address as their permanent mailing address or receiving regular mail/packages at this location.
o Home-Sharing and Subleasing Restrictions: The Tenant shall not sublet the Premises, assign this Lease, or host short-term rental guests (including, but not limited to, platforms such as Airbnb, VRBO, or corporate housing setups) under any circumstances. The Premises shall not be used to operate a commercial business that requires client, customer, or high-volume visitor traffic to the property.
o Conduct of Guests: The Tenant is fully responsible for the conduct, actions, and compliance of all visitors (whether daytime or overnight) while they are on the property. Guests must respect the peace and quiet enjoyment of the neighboring units and the Landlord. Any guest activity that creates a nuisance, generates excessive noise, blocks shared parking areas, damages the property, or violates local ordinances shall be deemed a material breach of this Lease Agreement by the Tenant.
