This Agreement establishes the conditions under which the Tenant(s) may occupy the lower-level residential unit located at 1945 Neelys Bend Road, Madison, Tennessee. The parties agree to the following terms. 1. Parties and Property Landlord / Property Owner Legal Name: __________________________________ Mailing Address: ______________________________ Telephone: ___________________________________ Email: _______________________________________ Tenant(s) Tenant 1: _____________________________________ Tenant 2: _____________________________________ Additional Adult Tenants: ________________________ Rental Property 1945 Neelys Bend Road, Lower Unit Madison, TN The leased premises consist of approximately 1,050 square feet, including two bedrooms, one bathroom, a kitchen, living areas, and the designated outdoor spaces. The rental includes exclusive use of the following: - Lower-level residential unit and its separate entrance. - Fully fenced backyard. - Screened-in porch with direct access from the residence. - Front deck. - Designated parking area accommodating up to four vehicles. - Designated lawn mower storage area. - Washer and dryer serving the lower unit. The upstairs residence is expressly excluded from this Agreement. The Tenant has no right to occupy, enter, store belongings in, or otherwise use the upstairs unit without the Landlord's written authorization. The downstairs unit has an independent heating and air-conditioning system. The Landlord retains ownership and control of the upstairs residence and may access it without entering the leased premises. Access to the Tenant's exclusive-use areas remains subject to applicable law and the terms of this Agreement. 2. Lease Term The initial lease term shall be six (6) months. The lease begins on the stated start date and expires on the stated expiration date, unless otherwise extended or terminated in accordance with this Agreement and applicable Tennessee law. No automatic renewal is provided by this Agreement. Any extension or renewal must be documented in a new written agreement signed by both parties. 3. Monthly Rent The Tenant agrees to pay: Monthly Rent: $1,900 Rent is due on the 1st calendar day of every month. Payment must be made electronically using the payment method designated by the Landlord. Rent shall be paid without requiring a reminder or demand from the Landlord. Electronic payments are required to the extent permitted by applicable law. Any payment processing fees must be disclosed and handled lawfully. Late Payments Rent is due on the 1st, and the Landlord intends to enforce payment deadlines consistently. Tennessee law provides a five-day grace period, counting the due date as the first day. If rent remains unpaid after the applicable statutory grace period, the Landlord may assess a late fee of 10% of the overdue rent, not to exceed the amount legally permitted. For $1,900 in overdue rent, the maximum late fee would be $190. If the final day of the statutory grace period falls on a Sunday or legal holiday, the statutory extension shall apply. Repeated late payments or nonpayment may result in notices and legal proceedings as permitted by Tennessee law. The Landlord will not impose late fees before the legally permitted date. Justia Law 4. Security Deposit The Tenant shall pay a refundable security deposit of: $1,900 The security deposit is due before occupancy, unless otherwise agreed in writing. The deposit is not advance rent and may not be applied toward the final month's rent without the Landlord's written consent. The Landlord shall maintain the deposit in a separate qualifying account and disclose the location of the account as Tennessee law requires. Security Deposit Account Information The security deposit may be used for legally permitted deductions, including unpaid rent and tenant-caused damage beyond ordinary wear and tear. The Landlord and Tenant shall follow Tennessee's statutory move-out inspection, damage-listing, and deposit-handling procedures. The Landlord may not impose deductions prohibited by law. Justia Law 5. Utilities Included The monthly rent includes the following services: - Electricity. - Water. - Regular household trash collection. - High-speed internet. Normal residential usage of these services is included in the rent. The Tenant agrees to comply with the reasonable-use requirements described below. 5.1 Electricity Usage Policy The property operates on one electricity meter serving both the upstairs and downstairs units. The upstairs unit is currently vacant and is intended to remain unoccupied during the initial lease term. The proposed electricity allowance is: $200 per monthly billing cycle. The parties acknowledge that this allowance must be confirmed and the calculation method completed before this provision can be enforced. Electricity billing procedure 1. The Landlord will receive the electricity provider's monthly bill. 2. The Landlord will account for electricity used by the upstairs unit, the Landlord, or other areas not attributable to the Tenant. 3. If the Tenant's reasonably verifiable electricity charges exceed the agreed allowance, the Tenant may be responsible for the documented excess amount. 4. The Landlord will provide an itemized calculation and supporting bill. 5. Any properly assessed excess charge will be included in the next monthly payment statement. Because there is no separate downstairs meter, the property's total electric bill alone does not establish the Tenant's electricity usage. No excess electricity charge may be imposed based solely on a shared-meter overage without a mutually agreed, reasonable attribution method. The following must be completed in writing before an excess-use charge becomes enforceable: Until this method is established, electricity remains included in the rent without an additional usage surcharge. The Tenant shall not be responsible for electricity consumed by the Landlord or in the upstairs residence. 5.2 Water Conservation Water is included in the monthly rent. The Tenant agrees to use water responsibly and protect the property's septic system. The Tenant shall: - Avoid leaving faucets, showers, or hoses running unnecessarily. - Promptly report leaking pipes, faucets, and running toilets. - Avoid excessive consecutive laundry loads. - Obtain written approval before filling large recreational pools. - Obtain written approval before installing additional water-consuming equipment. - Avoid unnecessarily excessive outdoor water usage. Normal bathing, cooking, cleaning, laundry, and other reasonable household activities are permitted. 6. Septic System Mandatory Protection Rules The property uses a private septic system rather than municipal sewer service. The Tenant acknowledges that improper disposal of materials through plumbing fixtures may cause blockages, backups, environmental damage, and expensive repairs. 6.1 Toilet Restrictions Only human waste and ordinary septic-compatible toilet paper may be flushed. The following materials are strictly prohibited: - Baby wipes or wet wipes, including products labeled "flushable." - Paper towels. - Feminine hygiene products. - Diapers. - Cotton swabs or cotton balls. - Dental floss. - Disposable cleaning products. - Cat litter. - Food waste. - Grease, oils, and fats. - Any other non-flushable materials. The Tenant must avoid flushing excessive quantities of toilet paper at once. 6.2 Kitchen and Drain Restrictions The Tenant shall not dispose of the following through sinks or drains: - Cooking grease or oil. - Coffee grounds. - Food scraps. - Hazardous chemicals. - Paint, solvents, or petroleum products. - Chemical drain-cleaning products that may damage the septic system. The Tenant shall use sink strainers where appropriate. Installing or operating a garbage disposal is prohibited. 6.3 Water Usage and Maintenance The Tenant must promptly report: - Sewage odors. - Slow drains. - Septic backups. - Unusual standing water near the septic system. - Leaking or continuously running plumbing fixtures. The Tenant shall not attempt unauthorized septic repairs. 6.4 Responsibility for Septic Damage The Landlord is responsible for ordinary septic maintenance, routine pumping, system deterioration, and repairs not attributable to Tenant misuse. The Tenant may be responsible for reasonable and documented repair costs if a qualified professional establishes that misuse, negligence, or prohibited materials introduced by the Tenant, occupants, or guests caused the damage. The Tenant is not automatically responsible for septic failures merely because they occur during the tenancy. 7. Lawn Care and Yard Maintenance The Tenant is responsible for routine lawn maintenance in the exclusive-use yard. Responsibilities include: 1. Regularly mowing grass during the growing season. 2. Keeping the lawn reasonably maintained. 3. Generally maintaining grass at no more than six inches, subject to weather and growing conditions. 4. Removing litter, debris, and pet waste. 5. Keeping the backyard, screened-in porch, and front deck reasonably clean. 6. Promptly reporting damaged fencing, fallen trees, or other hazards. Lawn Mower and Supplies The Landlord will provide: - A lawn mower. - A designated storage area for the mower. The Tenant will provide: - Gasoline. - Oil and ordinary operating consumables. - Other agreed supplies needed for routine mowing. The Tenant must operate the mower safely and in accordance with the manufacturer's instructions. The mower must be returned to its designated storage location after use. The Landlord is responsible for normal wear-and-tear repairs and replacement when required. The Tenant may be responsible for documented damage resulting from negligence or misuse. The Landlord remains responsible for major landscaping, structural hazards, significant tree work, and repairs that cannot lawfully be shifted to the Tenant. 8. HVAC Operation and Filter Replacement The downstairs unit has an independent heating and air-conditioning system. The Landlord will provide compatible HVAC filters at no additional cost. The Tenant shall replace the HVAC filter at least once every three months using the filters supplied by the Landlord. The Tenant must report: - Inadequate heating or cooling. - Unusual equipment noises. - Water leaks. - Restricted airflow. - Mechanical malfunctions. The Tenant shall not modify or tamper with HVAC equipment. The Landlord remains responsible for ordinary servicing and repairs. The Tenant may be responsible for damage proven to result from negligent misuse or failure to perform the agreed filter replacement, as permitted by law. 9. Appliances and Laundry The following appliances are included: - Refrigerator. - Stove and oven. - Microwave. - Dishwasher. - Washer. - Dryer. The washer and dryer are exclusively for the downstairs Tenant's use. The Tenant agrees to operate all appliances properly, follow manufacturer instructions, and promptly report malfunctions. The Landlord shall maintain landlord-provided appliances as required by this Agreement and applicable law. The Tenant may be responsible for damage caused by misuse or negligence. 10. Parking and Vehicle Rules The Tenant may park up to four vehicles in the designated parking area. Parking is limited to authorized, operable vehicles. The following are prohibited: - Parking vehicles in the backyard. - Driving vehicles onto the backyard lawn. - Blocking designated access routes. - Storing abandoned or inoperable vehicles. - Performing major vehicle repairs. - Changing engine oil or transmission fluids on the property. - Disposing of automotive fluids on the property. Minor maintenance, such as changing windshield wipers or checking tire pressure, is permitted. Vehicles must not be driven or parked over the septic tank or drainfield. Towing or removal of unauthorized vehicles must comply with applicable law. 11. Backyard and Heavy Equipment Restrictions Vehicles and heavy equipment are strictly prohibited in the backyard. The Tenant may not: - Drive or park cars, trucks, motorcycles, ATVs, or trailers in the backyard. - Bring tractors, excavators, or heavy machinery into the yard. - Dig or excavate without written approval. - Place heavy equipment or structures over septic-system components. - Plant trees or install permanent landscaping without approval. - Modify grading, drainage, or underground utilities. The Landlord may authorize necessary maintenance equipment when appropriate. The Tenant may be responsible for documented damage caused by unauthorized activities. 12. Outdoor Equipment and Installations Written Landlord approval is required before installing: - Trampolines. - Above-ground or inflatable pools. - Fire pits. - Playground structures. - Temporary sheds. - Large recreational equipment. - Permanent outdoor fixtures. - Equipment requiring digging or ground anchors. Approved equipment must comply with applicable safety requirements. The Tenant shall remove personal installations at move-out and repair damage resulting from their installation or use, beyond ordinary wear and tear. 13. Outdoor Grilling Charcoal and propane grilling is permitted in a safe location in the backyard. The Tenant shall: - Maintain a safe distance from the house, deck, screened-in porch, fencing, and combustible materials. - Follow applicable fire codes and manufacturer requirements. - Never grill inside enclosed areas. - Never leave an operating grill unattended. - Properly extinguish charcoal and safely store propane. The Tenant may be responsible for damage caused by negligent or prohibited grilling activities. 14. Pets Pets are considered on a case-by-case basis. Prior written Landlord approval is required before bringing a pet to reside at the property. Any approved pet shall be identified in a written pet addendum. The Tenant must: - Supervise and reasonably control pets. - Remove pet waste promptly. - Prevent excessive noise or disturbances. - Prevent damage to flooring, doors, fencing, landscaping, and other property. Pet-related charges, if any, must be agreed upon in writing. Service animals and assistance animals shall be addressed in accordance with applicable fair housing laws and are not subject to ordinary pet restrictions where an accommodation is legally required. 15. Smoking and Vaping Smoking and vaping are prohibited anywhere on the property. This includes: - The interior residence. - Screened-in porch. - Front deck. - Backyard. - Parking area. - Other property grounds. The prohibition applies to the Tenant, occupants, and guests. The Tenant may be responsible for documented damage or remediation costs resulting from violations, as permitted by law. 16. Quiet Hours and Noise The following quiet hours apply: Sunday through Thursday: 10:00 PM 8:00 AM. Friday and Saturday: Midnight 8:00 AM the following morning. During quiet hours, the Tenant and guests must avoid excessive noise, loud music, and other unreasonable disturbances. Outside quiet hours, noise must still comply with applicable ordinances and must not unreasonably disturb neighbors. Reasonable gatherings are permitted, subject to these requirements. 17. Occupancy and Guests The property is intended for residential use. The parties propose a maximum occupancy of five residents, subject to applicable occupancy codes and fair housing laws. All adult residents must be identified in the Agreement. Additional individuals intending to establish permanent residency must be disclosed and approved where legally permitted. Occasional overnight guests are permitted without requiring approval solely because they stay more than seven nights. The Tenant is responsible for the conduct of guests. Subletting, assigning the lease, or offering the property through Airbnb or similar short-term rental services is prohibited without prior written Landlord approval. No occupancy restriction in this Agreement shall override applicable law. 18. Alterations and Modifications The Tenant must obtain written approval before: - Painting walls. - Mounting televisions. - Installing shelving. - Drilling large holes. - Installing fixtures. - Modifying plumbing or electrical systems. - Making structural alterations. - Installing permanent outdoor equipment. Ordinary picture hanging using small nails or appropriate hooks is permitted, provided damage is minimized. Unauthorized modifications may require lawful restoration at the Tenant's expense. 19. Locks, Keys, and Security The Tenant shall not, without prior written authorization: - Replace or rekey locks. - Install additional deadbolts. - Install smart locks or electronic locking systems. - Install security chains. - Duplicate or distribute keys or access codes to unauthorized individuals. - Modify existing security hardware. Any legally required security accommodation remains permitted. The Tenant must immediately notify the Landlord of lost keys or compromised access codes. Reasonable replacement or rekeying costs attributable to the Tenant may be charged as permitted by law. All keys and access devices must be returned when possession is surrendered. 20. Security Cameras Existing security cameras are associated with the upstairs unit. They are not provided as a security-monitoring service for the downstairs Tenant. No cameras shall be operated inside the leased dwelling. Any existing or future cameras must comply with applicable privacy laws, including restrictions on recording private spaces and protected communications. The Tenant may not damage or tamper with lawful security equipment. The Landlord shall disclose the locations and relevant recording functions of any landlord-operated cameras that capture the Tenant's exclusive-use areas. 21. Trash and Waste Disposal Regular household trash collection is included in rent. The Tenant will have dedicated trash bins. The Tenant is responsible for: - Properly bagging household waste. - Placing bins at the designated pickup location. - Returning bins after collection. - Keeping bins and surrounding areas sanitary. - Preventing trash accumulation. - Arranging and paying for disposal of oversized items not accepted by the regular service. Trash must be secured to discourage pests and wildlife. 22. Pest Control The Landlord will arrange and pay for routine pest control. The Tenant must: - Maintain reasonable cleanliness. - Properly store food. - Remove trash regularly. - Promptly report pest activity. - Cooperate with lawful pest control access and preparation instructions. Additional documented treatment costs directly caused by Tenant negligence may be assessed where permitted by law. 23. Internet Service and Network Security High-speed internet is included in the rent. The Tenant may use the service for ordinary residential activities, including remote work, gaming, streaming, and video calls. The following are prohibited: - Illegal activity. - Unauthorized modification of network equipment. - Reselling internet access. - Commercial redistribution of the connection. - Sharing access credentials outside the household without permission. - Tampering with routers, modems, or related equipment. The Landlord will maintain the agreed internet service and make reasonable efforts to resolve outages. The Landlord does not guarantee uninterrupted connectivity or a particular speed at every moment. This provision does not waive remedies that may apply under law or any separate written service guarantee. 24. General Property Maintenance The Tenant agrees to maintain the leased premises in a reasonably clean, safe, and sanitary condition. The Tenant must: 1. Properly dispose of household waste. 2. Avoid deliberate or negligent property damage. 3. Use plumbing, electrical systems, and appliances appropriately. 4. Promptly notify the Landlord of maintenance problems. 5. Keep assigned outdoor spaces reasonably maintained. 6. Avoid conduct that unreasonably disturbs neighbors. 7. Ensure guests comply with the property's rules. The Landlord remains responsible for maintaining the property in a fit and habitable condition, as required by Tennessee law. The parties may agree to specific tenant maintenance tasks in good faith, but those agreements do not eliminate the Landlord's statutory obligations. Justia Law 25. Maintenance Reporting and Tenant-Caused Damage The Tenant must promptly report: - Water leaks. - Running toilets. - Plumbing blockages. - Septic-system problems. - Electrical malfunctions. - HVAC problems. - Appliance failures. - Structural damage. - Safety hazards. - Significant pest activity. Emergency maintenance contact: For an emergency involving immediate danger, the Tenant should contact the appropriate emergency service before notifying the Landlord. The Tenant may be responsible for actual, reasonable, documented damage resulting from negligence, misuse, or failure to report a known problem when that failure causes additional damage. The Tenant is not responsible for ordinary wear and tear, preexisting defects, or repairs legally assigned to the Landlord. 26. Smoke Detectors and Safety Equipment The Landlord shall provide and maintain legally required smoke detectors, carbon monoxide detectors where applicable, and other required safety equipment. The Tenant must: - Replace user-serviceable batteries when needed, unless prohibited by the device design or applicable law. - Promptly report malfunctioning equipment. - Avoid tampering with, disconnecting, or disabling safety equipment. - Cooperate with reasonable safety inspections. The Landlord is responsible for legally required repairs and replacements. 27. Property Inspections and Landlord Entry The Landlord may request routine property inspections approximately once every three months. The Landlord will provide at least 24 hours' advance written notice and will seek the Tenant's consent for routine inspections and maintenance visits. Inspections may cover: - Plumbing and septic-related conditions. - HVAC filters and equipment. - Smoke detectors. - Appliances. - General property condition. - Lawn care and assigned outdoor spaces. - Visible damage or safety hazards. Inspections will be scheduled at reasonable times. The 24-hour notice provision does not independently authorize nonemergency entry without consent. Under Tennessee law, tenants generally may not unreasonably withhold consent for legitimate inspection and maintenance purposes. The Landlord may enter without consent in emergencies and other circumstances specifically permitted by law. During the final 30 days of the tenancy, the Landlord may show the premises to prospective tenants after providing at least 24 hours' notice, as authorized by this Agreement and Tennessee Code 66-28-403. Justia Law The Landlord shall not abuse the right of access or use it to harass the Tenant. 28. Move-Out Condition and Cleaning Upon termination of the lease, the Tenant must: 1. Remove personal belongings. 2. Remove trash and abandoned personal items. 3. Leave the residence reasonably clean and sanitary. 4. Clean kitchen appliances and bathroom fixtures. 5. Leave floors and living areas reasonably clean. 6. Remove personal equipment from the yard. 7. Leave the screened-in porch and front deck clean. 8. Return all keys and access devices. 9. Provide a forwarding address. 10. Surrender possession by the agreed termination date. Professional cleaning is not automatically required. The property should be returned in a condition reasonably comparable to move-in, allowing for normal wear and tear. Any damage assessment or security deposit deduction must comply with Tennessee law. The parties will follow applicable procedures for the Tenant's opportunity to participate in a move-out inspection and review an itemized damage listing. Justia Law 29. Lease Renewal The initial lease term is six months. Tenant's Renewal Request A Tenant wishing to renew must submit a written renewal request at least 30 calendar days before the lease expires. The request may be delivered through an agreed written communication method. Submitting a request does not guarantee renewal. Landlord Approval Renewal is subject to mutual agreement. The Landlord is not obligated to offer another lease except where otherwise required by law. Any renewal must be documented in a new written agreement signed by both parties. No Automatic Renewal This Agreement does not provide for automatic renewal. If the parties do not execute a new lease, the Tenant is expected to surrender possession at expiration, subject to applicable notice, holdover, and tenancy laws. Acceptance of rent after expiration may create legal consequences under Tennessee law, regardless of the parties' stated intent. 30. Landlord's Right to Increase Rent The Landlord reserves the right to propose a new rental rate when the existing lease expires. The Landlord may determine the proposed renewal rate based on factors including: - Market rental conditions. - Property operating costs. - Electricity and utility expenses. - Property taxes. - Insurance costs. - Maintenance expenses. - Other lawful business considerations. The Landlord will communicate any proposed renewal rate in writing at least 30 calendar days before the current lease expires. The Tenant may accept the proposed terms by entering into a new written lease or decline renewal. The monthly rent will not increase during the existing six-month fixed term unless both parties lawfully agree otherwise in writing. Nothing in this provision authorizes discriminatory, retaliatory, or otherwise unlawful rent increases. 31. Early Lease Termination The Tenant agrees to fulfill the entire six-month lease term. Vacating early does not automatically release the Tenant from contractual obligations. If the Tenant leaves before the lease expires: 1. The Tenant must provide written notice. 2. The Tenant may remain responsible for unpaid rent and other lawful charges. 3. The Landlord will comply with any applicable duty to mitigate damages. 4. Rent received from a replacement tenant will be credited appropriately. 5. The Landlord will not collect duplicate rent for the same period. 6. Any security deposit deductions must comply with applicable law. The Tenant will not automatically owe an unconditional lump sum equal to every remaining month's rent. Any early termination rights provided by law, including qualifying military-service protections, remain unaffected. 32. Lease Violations and Enforcement The Tenant must comply with the terms of this Agreement. Material violations may include: - Nonpayment of rent. - Serious or repeated septic-system misuse. - Significant property damage. - Failure to perform agreed maintenance obligations. - Prohibited smoking. - Unauthorized alterations. - Serious disturbances. - Other substantial breaches of the Agreement. The Landlord may issue written notices identifying violations and requiring correction where applicable. Termination notices, cure periods, repeat-violation procedures, and eviction proceedings shall comply with Tennessee law. Under Tennessee Code 66-28-505, the applicable process depends on the nature of the breach, including whether it can be remedied. Justia Law The Landlord may not unlawfully remove the Tenant, change the locks to exclude the Tenant, or disconnect utilities to force the Tenant to leave. Enforcement will proceed through lawful procedures. 33. Renters Insurance Renters insurance is strongly recommended but is not mandatory under the parties' presently agreed terms. The Tenant is encouraged to obtain coverage for: - Personal belongings. - Personal liability. - Accidental property damage. - Temporary living expenses following a covered loss. The Landlord's property insurance does not necessarily cover the Tenant's belongings or personal liability. Any future requirement for insurance must be agreed upon in writing or otherwise lawfully established. 34. Furnishings The property is rented unfurnished. Certain optional furniture items may be made available at the Tenant's request. Any furniture provided will be identified in a separate written inventory or addendum, specifying which items belong to the Landlord. The Tenant shall take reasonable care of any Landlord-owned furniture accepted for use.
