Notwithstanding any statement to the contrary contained in this Agreement, Purchaser acknowledges and agrees the Property is being sold AS IS, WHERE IS, AND WITH ALL FAULTS AND SELLER MAKES NO WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, OR ARISING BY OPERATION OF LAW, INCLUDING, BUT IN NO WAY LIMITED TO, ANY WARRANTY OF QUALITY, CONDITION, HABITABILITY, MERCHANTABILITY, SUITABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE PROPERTY, ANY IMPROVEMENTS LOCATED THEREON OR ANY CONDITIONS RELATED THERETO. Purchaser accepts the Property in such condition as of the date of title transfer. Purchaser acknowledges that the condition of the Property may include both patent and latent defects and without limitation: structural instability; major systems defects, including but not limited to those involving the electrical, mechanical, plumbing systems; basement moisture; leaks or flooding; or problems with the roof, sewers, septic systems, and foundation. Seller, its Real Estate Broker, its officers, employees, and agents have made no representations to the Purchaser concerning the condition of the Property. Further Purchaser acknowledges that Purchaser is relying solely upon, and as of the expiration of the Inspection Period will have conducted, its own, independent inspection, investigation, and analysis of the Property as it deems necessary or appropriate in so acquiring the Property from Seller. The terms of this provision shall not merge into the conveyance documents but instead shall survive the closing and the delivery of the conveyance documents.
