Central Air RENEWAL TERMS: This agreement shall automatically terminate at the end of the term without necessity of any notice. Any renewal or extension of this agreement must be in writing and signed by both parties. SUB-LET: Lessee may not sub-let Property or assigns this lease without written consent of Lessor. No other individual may inhabit the premises without being approved by the lessor and being added to the lease. FIRE: If Property is made uninhabitable by fire not the fault of Lessee, this agreement shall be terminated. HOLD OVER: Lessee shall deliver possession of Property in good order and repair to Lessor upon termination or expiration of this agreement. RIGHT OF ACCESS: Lessor shall have the right of access to Property for inspection and maintenance during reasonable hours. During the last thirty (30) days of occupancy, Lessor may call and show the Property during reasonable hours. The Lessor with give tenant at least 24 hours notice before entering the home, except for an emergency. The landlord must also enter only at reasonable times and in a reasonable manner. A tenant may refuse to admit the landlord if proper notice has not been given or if it is not an emergency, or otherwise unreasonable USE: The Property shall be used for residential purposes only and shall be occupied by two tenants. Property shall be used so as to comply with all state, county and municipal laws and ordinances. Lessee shall not use Property or permit it to be used for any disorderly or unlawful purpose, or for any business purposes. PROPERTY LOSS: Lessor shall not be liable for damage to Lessee's property of any type for any reason or cause whatsoever, except where such is due to Lessor negligence. Lessee should obtain tenant insurance to protect household goods and personal effects as well as liability insurance. INDEMNIFICATION: Lessee releases Lessor from liability for and agrees to indemnify Lessor against all losses incurred by Lessor as a result of a) Lessee's failure to fulfill any condition of this agreement b) Any damage or injury happening in or about Property to Lessee's invitees or licensees or such person's Property c) Lessee's failure to comply with any requirements imposed by any governmental authority; and d) Any judgement, lien or other encumbrance filed against Property as a result of Lessee's action. REMEDIES CUMULATIVE All remedies under this agreement or by law or equity shall be cumulative. If a suit for any breach of this agreement establishes a breach by either Lessee or Lessor, Lessee shall pay to Lessor all Expenses and Lessor shall pay to Lessee all expenses incurred in connection therewith. NOTICES Any notice required by this agreement shall be in writing and shall be deemed to be given if delivered personally or mailed by registered or certified mail. REPAIRS Lessee acknowledges that he has inspected the Property and accepts the condition as is. Lessor will make necessary repairs to Property with reasonable promptness after receipt of written notice or call from Lessee for major deficiencies which create unsafe or untenable conditions. Major repairs shall include: electrical, plumbing, heating, cooling, built-in appliances or structural defects. If any damage, beyond normal wear and tear, is caused by Lessee or his guest or licensees, lessee agrees to pay Lessor the cost of repair with the next rental payment. Lessee may not remodel or structurally change Property or remove any fixture therefrom without written authority from Lessor. ABANDONMENT If Lessee removes or attempts to remove property from the Property other than usual course of continuing occupancy, without having first paid Lessor all monies due, Property may be considered abandoned and Lessor shall have the right, without notice, to store or dispose of property left on the Property by Lessee. Lessor shall also have the right to store or dispose of any of Lessee's property remaining on the Property after the termination of this agreement. Any such property shall be considered Lessor's property and title thereto shall vest in Lessor. RULES AND REGULATIONS a) LOCKS AND KEYS: Lessee is prohibited from adding locks to, changing or in any way altering locks installed on the doors of property without permission of Lessor. Lessee must return all keys before security deposit will be returned. b) NON-OPERATIVE VEHICLES: Non-operative vehicles are not permitted on Property. Any such non-operative vehicles may be removed by Lessor at the expense of Lessee owning same, for storage or public or private sale, at Lessor's option and Lessee owning same shall have no right of recourse against Lessor thereafter. c) STORAGE: No goods or materials of any kind or description which are combustible or would increase fire risk shall be taken or placed in storage areas. Storage in such areas shall be at Lessee's risk and Lessor shall not be responsible for any loss or damage. d) WALLS: No nails, screws or adhesive hangers except standard picture hooks, shade brackets and curtain rod brackets may be placed in walls, woodwork or any part of Property. ** Walls should be left in good condition with no nail holes at the end of the lease. e) HOUSEKEEPING: The Lessee agrees to maintain Property in as good state as he finds it, reasonable wear and tear expected. GOOD HOUSEKEEPING IS EXPECTED OF EVERYONE. The lessee agrees to keep his quarters in a clean and sanitary condition and free of rubbish. f) UTILITIES: Lessee will be responsible for payment electricity and gas. Lessee must provide proof of final paid bills of all utilities before security deposit will be refunded. Water, sewer, snow removal and trash are paid by the lessor. ENTIRE AGREEMENT This agreement and any attached addendums constitute the entire agreement between the parties and no oral statement shall be binding.
