One (1) year, renewable 3 months before the lease end date.
RENT: TENANTS agrees to pay the monthly rent in advance in the amount of $1485 on the 1st day
of each month. Late payment is a breach of lease. TENANTS agree to pay to the LANDLORD any charges incurred by them as a result of a check written by them being returned by the bank unpaid. A late fee of 10% of the rent will be due to LANDLORD by TENANTS.
PETS: No dog is allowed. Cat is allowed. Other pets could be considered. There is a pet fee of $30 a month.
SECURITY DEPOSIT: Upon signing this lease, TENANTS will give LANDLORD a $1485 security deposit for the faithful performance by TENANTS for the provisions of the lease, to be returned to TENANTS at the end of the tenancy less any sums required to repair damages to the apartment beyond ordinary wear and tear.
UTILITIES: All utilities are included, heating, cooling, water, sewage and WiFi.
ASSIGNMENTS/SUBLETTING: TENANTS shall not assign this lease or sublet the premises or any part thereof. Any unauthorized transfer of interest by the TENANTS shall be a breach of this agreement.
FIXTURES AND ALTERATIONS: TENANTS must obtain prior consent from LANDLORD before painting, installing fixtures, making alterations, additions or improvements and if permission granted, same shall become LANDLORD's property and shall remain on the premises at the termination of the tenancy.
KEYS AND LOCKS: Digital Key Lock. Upon occupation, LANDLORD will give, and TENANTS will acknowledge receiving numeric password to the lock. LANDLORD will administer password. TENANTS can request password to be changed with their own number combination. TENANTS will also be provided with a physical key in case the digital lock failed to operate. TENANTs are responsible for ensuring that the batteries are replaced when needed.
Yard. TENANTS has rights to enjoy the yard. TENTANTS are responsible for cutting the grass and maintain the yard and driveway clean and free of trash.
USE OF PREMISES: TENANTS shall maintain the premises in a clean and sanitary condition and not disturb surrounding residents or the peaceful and quiet enjoyment of the premises or surrounding premises. Premises are to be used and occupied by the TENANTS for only residential, non-business, private housing purposes only. No loud music or parties allowed except on a special occasion during weekend and consent must be given by the LANDLORD.
SECURITY CAMERAS: LANDLORD may install cameras outside and around the premises for security purpose.
SMOKING: Smoking of any kind is NOT permitted anywhere inside the house by TENANTS, guests or invitees. TENANTS understand that smoking inside the building shall be considered a material default under this lease agreement. The premise is surrounded by trees and dried leaves, as such TENANTS are cautioned on fire hazard due to smoking. In the event the premises are damaged in any way due to smoking on the premises, TENANTS will be fully responsible for eradication of smoke related odors and repair of any damage due to the smoking. TENANTS agree that smoke related damages will in no way be considered ordinary wear and tear.
RISK OF LOSS: All TENANTS' personal property shall be at the risk of the TENANTS, and LANDLORD shall not be liable for any damage to said personal property of the TENANTS arising from criminal acts, fire, storm, flood, rain or wind damage, acts of negligence of any person whomsoever, or from the bursting or leaking of water pipes. LANDLORD shall not be responsible for the loss of any food in the event of a refrigerator or freezer failure, defect or electrical failure.
GARBAGE. TENANTS are responsible for disposing of trash and place them at the curb according to the county trash collection instructions and schedule.
VEHICLES: Vehicle(s) must be currently licensed, owned by TENANTS, registered, operational and properly parked on the driveway.
MAINTENANCE/INSPECTION: TENANTS agrees that they have fully inspected the premises and accepts the condition of the premises in 'as is' condition with no warranties or promises express or implied. TENANTS shall maintain the premises in good, clean and tenantable condition throughout the tenancy, keep all plumbing fixtures in good repair, use all electrical, light bulbs, plumbing, heating, cooling, appliances and other equipment in a reasonable manner, removing all garbage in a clean and sanitary manner. In the event TENANTS or TENANTS'S guests or invitees cause any damage to the premises, LANDLORD may at its option repair same and TENANTS shall pay for the expenses of same on demand or LANDLORD may require TENANTS repair same, all charges incurred as additional rent. TENANTS are responsible for all repairs costing $150 or less. LANDLORD shall be responsible for major repairs exceeding $150.
DANGEROUS MATERIALS: TENANTS shall not keep or have on the premises anything of dangerous, inflammable, explosive, poisonous, or contaminating nature.
SIGNS: TENANTS shall permit no controversial or inflammatory signs or symbols to be visible from the road with the exception of candidate-approved election signs. No commercial signs shall be erected in front of the property. No flag other than the "Stars and Stripes" may be flown. LANDLORD may erect "For Rent" sign during the final 30 days of the tenancy.
VACATING: At the expiration of this agreement or any extension, TENANTS shall peaceably surrender the premises and turn in all keys and any other property owned by LANDLORD leaving the premises in good, clean condition, ordinary wear and tear excepted. TENANTS agree to have the carpeting cleaned professionally upon move-out.
RIGHT OF ENTRY: LANDLORD, upon reasonable notice by telephone, hand-delivery or posting to TENANTS, has the right of entry to the premises for showing, repairs, appraisals, inspections, or any other reason. LANDLORD has immediate right of entry in cases of emergency, or to protect or preserve the premises.
BREACH OF LEASE: If at any time TENANTS are deemed to have breached the lease, LANDLORD may immediately require TENANTS to quit and surrender the apartment.
