    Trailer newly renovated DESCRIPTON. The Owner in consideration of the rents to be paid and the covenants and agreements to be performed by the Tenant, has DEMISED and LEASED, and does hereby DEMISE and LEASE unto the Tenant the following demised premises situated in the County of RUSSELL, State of KENTUCKY, to wit, 77 Reeder Road, Russell Springs, Kentucky, 42642. 3. TERM AND RENT. The term of this Lease shall be for a term of 12 months starting on October 18, 2021. Early departure and/or breaking the lease will result in the immediate forfeiture of the security deposit listed in Paragraph 6. Upon notice by the Lessee of the need for early termination of the existing Lease, the owner will begin to solicit/market potential Tenants to Lease the property. The current Lessee will continue to fulfill monthly rent obligations as described in Paragraph 4 below until a new Tenant is found for the property or upon expiration of the existing term as described in this paragraph. 4. The rent for said premises for said term shall be the sum of $550.00 per month. 5. It is payable in lawful money of the United States, payable in monthly installments in advance, on the first day of each and every month. The Tenant shall pay additional rent in the amount of $10.00 each day the rent is not received after the 5th of the month it is due, and shall pay a $50.00 service charge for each returned insufficient check. If Tenant moves in after the 15th of the month then rent shall be pro-rated accordingly. 6. SECURITY DEPOSIT. The Tenant herewith deposits with the Owner the sum of $550.00 as security for the full and faithful performance by the Tenant of all the terms and conditions. The sum shall be returned to the Tenant after the time fixed as the expiration of the term, provided the Tenant shall have fully and faithfully carried out the terms, covenants, and conditions on his/her part to be performed. Failure to perform may result in forfeiture of the deposit. The unit must be left as it was the first day of the rental lease. 7. PLACE AND PAYMENT. All payments of rent of other sums to be paid to the Owner (North Oak Properties, LLC) shall be paid at P.O. Box 559, Russell Springs, KY 42642, or such other place as the Owner shall designate in writing from time to time. The Owner reserves the right to evict Tenant in the event that rent is more than 30 days past due. 8. SUBLEASE AND ASSIGNMENT. The Tenant agrees not to assign or transfer this Lease, or any interest therein, or hypothecate or mortgage the same, or sublet said premises or any part thereof without the written consent of said Owner. 9. There is NO SMOKING inside the unit. If there is any evidence of smoking indoors the result in the forfeiture of the security deposit and may be immediate eviction. Smoking is permitted outside with the understanding that cigarette butts will be picked up regularly. 10. FIRE OR CASUALTY. In the event the leased premises are substantially damaged by fire, wind, explosion or other cause beyond the control of the Owner, or if the premises or access thereto are condemned or acquired by properly constituted governmental or other authority, the Owner may, at its option, either terminate this Lease or repair or restore said premises within sixty (60) days. If the premises are so repaired and restored, then this Lease shall remain in full force and effect, but rent shall be proportionately reduced to the extent the premises are uninhabitable during such period of repair and restoration. If the premises are not, or cannot be so repaired or restored within sixty (60) days, the Lease shall terminate, and the Owner shall have no liability to the Tenant or any other person for such termination. 11. LIABILITY. The Owner is not liable to the Tenant for any acts or failure to act by the Owner or its agents or representatives unless otherwise provided by law. The Owner does not provide any insurance for the property of the Tenant. 12. STRUCTURES. The Tenant shall not erect any structures for storage, recreation, or use the roof or grounds for any purpose without the consent in writing of the Owner. No radio, television antenna, or satellite dishes shall be erected on the building without the express consent of the Owner. 13. VACATING PREMISES. At the termination of this Lease, by lapse of time, or otherwise, the Tenant shall yield up immediate possession to the Owner, and return keys to said property to the Owner. 14. RESPONSIBILITY AND CONDITION OF PREMISES. The Tenant is completely responsible for all damages to the Tenant's property, whether caused by the Tenant or his guests, or by any other cause. The Tenant shall leave the property in at least as good condition as when Tenant leased same, normal wear and tear to be taken into consideration. The Owner may enter into the Tenant's property with 1 hour notice. Any improvements to be made by the Tenant shall only be done with the written consent of the Owner, including painting. The Tenant shall do nothing during the term of this Lease to cause the Owner's insurance rates to increase. 15. UTILITIES. The utilities, including electric, water, telephone, internet as well as mowing of yard, will be the responsibility of the Tenant. 16. CUMULATIVE RIGHTS. It is agreed that each and every one of the rights, remedies, and benefits provided by this Lease shall be cumulative and shall not be exclusive of any other of said rights, remedies, and benefits or of any other rights, remedies, and benefits allowed by law. 17. RULES AND REGULATIONS. The Tenant hereby covenants and agrees that he/she, his employees, agents, and visitors, shall comply with all reasonable rules and regulations which the Owner may make from time to time, notice which shall have been given him, which rules and regulations are uniform for all tenants in said property. Owner shall not be liable to Tenant for violation of any said rules and regulations by any of said rules and regulations by any other Tenant of said property. 18. WAIVERS. One or more waivers of any covenant or condition by the Owner shall not be construed as a waiver of a further breach of the same covenant or condition. 19. PETS. Tenant agrees not to keep pets. No animal may be kept on the premises without the written permission of the Owner. A $200-dollar non-refundable charge is required if such permission is granted. The keeping of pets without the express written permission of the Owner, shall constitute grounds for eviction, immediate forfeiture of security deposit in Paragraph 6, and fulfillment of rent for duration of Lease term or until a new tenant occupies the property. 20. BINDING EFFECT. The covenants, conditions, and agreements made and entered into by the parties hereto are declared binding on their respective heirs, successors, representatives, and assigns. 21. MAINTENANCE AND REPAIR. Tenant agrees to maintain the premises and perform minor repairs, such as leaking faucets, light fixtures, etc. The furnace filter must be checked monthly Tenant shall be responsible for failure to make such repairs and shall be liable for damage resulting from such failure. Major repair requirements shall be reported promptly by Tenant to Owner in writing and shall be performed by Owner within a reasonable time and during normal business hours. Tenant shall notify Owner immediately of any emergency repairs. 22. USE OF PREMISES. The tenants will maintain a civil relationship with the other tenants and or neighbors. No loud, raucous gatherings will be allowed at any time and the playing of excessively loud music is prohibited. A period of quiet time is enforced from 9:00 pm until 7:00 AM. This includes an abnormal number of vehicles coming and going. Violation of this section will result in termination of this lease agreement and immediate eviction. 23. SPECIAL PROVISIONS. The inside and outside of this rental premises must be kept clean, neat, orderly, and free from any unnecessary clutter. Failure to maintain the premises in a neat and orderly manner, which includes but is not limited to trash in the yard, maintenance of yard, objects left in yard, etc., is grounds for termination of lease and the forfeiture of the Tenant Security Deposit and payment for the remaining lease term, or until a new Tenant enters into a new lease term with the Owner. Rent must be paid promptly the first of each month. The unit is inspected and treated by a licensed pest control specialist twice a year and/or when a tenant moves out. At such, the subsequent discovery of insect pests will be the financial responsibility of the TENANT. Any expense associated with the elimination of such in the building will be incurred by the TENANT. Be sure to inspect your belongings before moving in. Treat any furniture and clothing from unknown origins as suspect and take the appropriate steps to treat effectively. 24. OPTIONS TO RENEW. This Lease will automatically renew at the end of the lease term, unless the Owner or Tenant gives a thirty (30) day notice, thereof. 25. The Owner is relying on the truthfulness and completeness of the statements contained herein. Any statements found to be untrue on same shall be grounds for the Lease to be voided by the Owner as a Contract based on fraudulent statements.
