The resident agrees that the premises are to be utilized only for the principal and primary residence of the resident and any occupants. Subject to applicable law, the resident may not use the premises to operate a business or commercial enterprise without the landlord's prior written consent, nor will the resident utilize the premises for any purpose or in any manner violate applicable law or the covenants, conditions, or rules of any applicable homeowner's association ("HOA Governing Documents"). Resident hereby represents and warrants to Landlord that Resident (a) will review and comply with all applicable HOA Governing Documents and other instruments of record; (b) shall provide prompt written notice to Landlord if it receives any notice of violation of any HOA Governing Documents or other applicable law; and (c) shall reimburse Landlord for any fines or charges imposed by any HOA or municipality as a result of Resident's violation or failure to comply with any applicable HOA Governing Documents or other applicable law. Any such fines or charges shall be considered additional rent and paid with the resident's next monthly rent payment.
Resident represents warrants and covenants that all persons residing at the premises are identified as residents or occupiers within this lease. All occupants over eighteen (18) are required to complete an application and are subject to the same approval process as the resident. Persons unnamed as residents or occupiers are not allowed to reside in the premises and must not stay in the premises for more than seven (7) consecutive days and no more than thirty (30) days in a calendar year, without the landlord's prior written consent.
Payments by third parties may be accepted, at the landlord's sole discretion, for the benefit of the resident; however, acceptance of any payment will not create a tenancy between the landlord and the third party or otherwise be deemed consent or convey any rights to such third party.
The resident must properly use, operate, and safeguard the premises, including, if applicable, any landscaping, furniture, furnishings, and appliances, and all mechanical, electrical, gas, and plumbing fixtures. Resident's maintenance obligations shall include, without limitation, following all maintenance recommendations of the landlord and any manufacturer recommendations for appliances, equipment, plumbing, and other fixtures. and furnishings, maintaining the Premises in a clean, sanitary condition, keeping all drains clear and free of hair, obstructions, and any foreign matter and repair and maintenance of any related drain and sink backups or blockages, promptly removing any standing water, excess moisture, or damp conditions at the Premises to prevent mold growth or other damage, regularly changing and cleaning all vents, filters, and fans located in the Premises (including the appliances and heating, ventilating, and any cooling systems), replacing light bulbs, checking and maintaining all smoke and carbon monoxide detectors and replacing batteries as needed, properly ventilating kitchen and bathrooms, routine insect and pest control, and maintenance of exterior landscaping as set forth in the Landscaping Addendum.
Failure to report necessary repairs could result in the resident being charged for the repairs if additional damage occurs due to resident neglect or not reporting the repair promptly. The costs of repairing or clearing stoppages in waste pipes or drains caused by the resident's negligence or improper usage are the responsibility of the resident. Charges incurred by the landlord due to unreported or neglected repairs will be charged back to the resident.
No animals (including mammals, reptiles, birds, fish, rodents, and insects) are permitted on the property or premises without prior written consent of the landlord. The landlord reserves the right to refuse authorization, in its sole and absolute discretion, including the right to categorically prohibit all animals of a certain breed, size, or other factors. Should the landlord consent to the request to have an animal, conditions of acceptance will be identified in the Animal Addendum attached to this lease. If permitted by the landlord, the resident must pay the monthly pet charge and any pet fees. No pet deposit or pet rent will be due for an approved service, assistant, or companion animal, but the resident must notify the landlord of such a requirement, and the landlord may require additional documentation from the resident and a written statement from a qualified professional verifying the need for the service, assistant, or companion animal. Stray or wild animals must not be kept or fed on the premises. If the landlord learns that the resident has added additional pets or has "visiting" pets that have not been pre-approved by the landlord, then the resident must pay, within seven (7) days of the landlord's demand, an additional $500 fee per pet. If the resident fails to pay the additional pet fee on time, it will be considered a default event under these terms.
Parking is only permitted in the driveway, garage, or assigned spaces. The driveway, garage, and/or parking spaces are to be only used for parking properly licensed and operable motor vehicles, except as otherwise prohibited by applicable law or any homeowner's association.
Upon moving out, the resident must (a) give the landlord all copies of all keys or opening devices to the premises, including garage, storage, and common areas; (b) vacate and surrender the premises to the landlord, empty of all persons and personal belongings; (c) vacate any/all parking and/or storage space; (d) professionally clean and leave the premises in as good or better condition as the condition on the commencement date, excepting normal wear and tear; (e) remove all debris; and (f) provide Landlord and the U.S. Postal Service with each resident's forwarding address. All alterations/improvements made by or caused to be made by the resident, with or without the landlord's consent, become the property of the landlord upon termination of this lease. The landlord may charge the resident for restoration of the premises to the original condition they were in before any alterations or improvements.
The landlord shall not be liable for personal injury or for damage to or loss of the resident's personal property (furniture, jewelry, clothing, etc.) from fire, flood, water leaks, sewer backup, snow, smoke, explosions, interruption of utilities, theft, acts of God, or any other event. Resident understands that Landlord's insurance for these risks does not cover Resident, any of Resident's personal property, or any family members, guests, or invitees or their personal property and that Resident and its family members, guests, and invitees are not considered co-insured of the Landlord.
The landlord shall have the right to enter the premises with notice when practical, without notice in the event of an emergency, or at any reasonable time to examine, inspect, repair, show, or for any other legitimate or necessary purpose which the landlord determines in its sole discretion. The landlord may enter, regardless of whether the resident is present, by duplicate key or other means when necessary or in the event of an emergency. The resident will be assessed an inspection rescheduling fee if they refuse to let the landlord or agent into the property after being informed to conduct an inspection. Resident agrees that the landlord shall have the right to show the premises to prospective residents at reasonable times for sixty (60) days before the expiration of the tenancy, based upon either the landlord's or the resident's written notice to vacate. Reasonable times are defined as being between the hours of 9:00 am and 7:00 pm, including weekdays, weekends, and holidays. The resident agrees to keep the premises in a clean and showable condition during the 60 days of the notice to vacate. During these 60 days, the landlord may install a key box on the premises to show prospective residents the premises. The landlord retains the right to place on the premises a sign advertising the premises for rent or for sale during the term of the resident's tenancy. The landlord shall, whenever practical, give the resident twenty-four hours prior notice of intention to enter the premises to show the premises to prospective residents.
No smoking of any substance, including but not limited to tobacco, marijuana, or e-cigarettes, is allowed inside the home or on any portion of the premises. If smoking does occur at the premises, (a) the resident shall be in default of this lease; (b) the resident shall be responsible for all damage caused by the smoking, including stains, burns, odors, and removal of debris; (c) the resident, guests, and all others may be required to leave the premises; and (d) the resident acknowledges that to remove odor caused by smoking, the landlord may need to replace carpet and drapes and paint the entire home regardless of when these items were last cleaned, replaced, or repainted, and such replacement, repainting, and cleaning will be performed at the resident's sole cost and expense.
Prior written notice, with the provision of timely rent payment, is required if the resident intends to be absent for an extended period. The resident must give the landlord written notice of the intention to remain if the premises appear to be unoccupied for fifteen (15) days while rent is due and unpaid or for such other period specified by applicable law. Under applicable law, the landlord may take immediate possession of the premises, store, dispose of, or otherwise handle the resident's personal property as soon as the premises are deemed abandoned. The resident herein gives the landlord specific authority, at the resident's expense and without limitation of the landlord's other remedies, to dispose of abandoned personal property in any manner the landlord chooses that does not violate applicable law, with no recourse whatsoever on the part of the resident.
