However, a lack of an email address will not be a reason for denial, and alternative arrangements will be made for formal notices and documentation delivery as required by California law. TENANT SCREENING CRITERIA: Our goal is to ensure a great fit for both you and our property. We review all applications in compliance with federal and California fair housing laws, which require an individualized assessment for every applicant. 1. Income Verification: Applicants should provide verifiable monthly income. As a general guideline, we look for income around three times the monthly rent. For applicants with Section 8 or other housing vouchers, the income qualification standard (three times the rent) is calculated based solely on the applicant's portion of the monthly rent, as mandated by California law. Acceptable documentation includes pay stubs, bank statements, tax returns, benefit statements, or other lawful proof of income. 2. Rental History: We will verify your rental history with previous landlords. A history of responsible tenancy, including timely rent payments, is important. 3. Eviction History: Eviction history will be reviewed in accordance with California fair housing laws, which require individualized assessment of the circumstances, timing, and relevance of any prior eviction. Mitigating factors will be considered. 4. Criminal Background Check: A criminal background check will be conducted. Denial will not be based on arrests that did not result in a conviction or on a blanket ban of all criminal records. Instead, we will conduct an individualized assessment considering the nature and severity of the crime, the amount of time that has passed since the offense, and any mitigating circumstances or evidence of rehabilitation, consistent with fair housing guidance. 5. Application Consistency: All applicants 18 years of age or older must complete a separate application. We will apply our criteria consistently to all applicants and process them in a manner that complies with all fair housing laws. ________________________________________ General Conditions Lease Start Date: The lease agreement will begin within a mutually agreed-upon timeframe after the application is approved. The exact move-in date and rent start date will be specified in the lease. Application Processing: We accept and process all applications to select the most qualified applicant based on our established written screening criteria. We reserve the right to review all applications received for a specific period to determine the best fit for the property. Application Fees: For all applicants not selected for tenancy, we will return the entire application screening fee within seven (7) days of selecting an applicant for tenancy or within thirty (30) days of when the application was submitted, whichever occurs first. This refund will be provided regardless of the reason the applicant was not chosen. We will provide an itemized receipt for all processed applications within the required timeframe showing the actual out-of-pocket costs of the screening. Holding Deposits: Once an application is approved and a signed holding deposit agreement and payment are received, the property will be held for the agreed-upon period for the lease to be signed. This holding deposit is considered a form of security deposit under California Civil Code 1950.5. In the event a lease is not executed, the holding deposit will be handled strictly in accordance with California Civil Code requirements, generally requiring the deposit to be refunded within 21 calendar days if a lease isn't signed, minus actual damages or costs incurred if agreed upon in a specific written agreement.
