LEASE TERMS AND CONDITIONS
1. Joint and Several Liability
Each Lessee is jointly and severally liable for the payment of rent and the performance of all other terms of this Lease.
2. Security Deposit
Lessee has deposited with Lessor the sum stated above as a security deposit to secure the faithful performance of all provisions of this Lease. The Lessor will return the security deposit, less any amount applied to damages, with interest as required by law, and shall provide a full accounting within thirty (30) days after the Premises are vacated. The security deposit shall not be treated as advance rent and may not be applied by the Lessee toward rent during the lease term.
3. Possession
Lessee shall be permitted to take possession of the Premises at the commencement of the Lease. If Lessor cannot deliver possession at that time, rent shall be abated until the Premises are available for occupancy. If possession is not available within ten (10) days of the start of the Lease term, Lessee may terminate this Lease upon written notice. Lessor shall not be liable for consequential damages arising from delayed possession.
4. Condition of Premises
Lessee has examined the Premises and is satisfied with its physical condition, including heating, plumbing, and smoke detectors. Acceptance of possession constitutes conclusive evidence that the Premises were received in good order and repair. No promises regarding condition, repairs, alterations, or decoration have been made unless expressly stated in this Lease or an attached rider signed by both parties.
5. Limitation of Liability
Lessee agrees to indemnify and hold Lessor harmless from any liability, loss, or damage arising from nuisances or conduct caused by Lessee, household members, or guests due to negligence, illegal, or improper conduct. Lessee shall not permit nuisances, offensive use, damage, or interference with the rights, comfort, safety, or enjoyment of others.
6. Lessee to Maintain
Lessee shall keep the Premises and all fixtures and appliances clean, healthy, and in good working order, and shall comply with applicable ordinances at Lessee's expense. Upon termination, the Premises shall be returned in as clean and good condition as at commencement, reasonable wear and tear excepted. Lessee is responsible for repairs resulting from neglect or misuse, including broken glass or fixtures, and shall not permit waste or misuse of utilities.
7. Use of Premises
The Premises shall be used solely for residential purposes and occupied only by persons listed in this Lease and the rental application. Lessee shall not engage in activities increasing insurance rates, allow trash accumulation, throw objects from windows, hang items from windows, or overload porches or decks. No pets are permitted without prior written approval, except legally required service animals with proper notice. Porches may not be used for cooking, sleeping, or storage.
8. Appliances
Lessee shall not install air conditioning units, heating or cooling equipment, dishwashers, washers, dryers, or other appliances without prior written consent. All approved appliances must be maintained by Lessee and removed at lease end. Lessee is responsible for any damage caused.
9. Disturbance
Lessee shall not disturb other tenants and shall maintain reasonable volume levels at all times. Between 10:00 p.m. and 7:00 a.m., sound must not be audible outside the Premises.
10. Access to Premises
Lessee shall permit Lessor access between 8:00 a.m. and 8:00 p.m. for inspections, repairs, improvements, showings, court orders, or end-of-lease inspections. In emergencies, Lessor may enter without notice. Denial of access constitutes a breach of this Lease.
11. Sublet or Assignment
Lessee shall not sublet or assign this Lease without prior written permission, which shall not be unreasonably withheld in accordance with applicable law.
12. Holding Over
If Lessee remains in possession after lease termination, Lessor may recover double the monthly rent plus damages resulting from the holdover.
13. Liability for Rent
Lessee remains responsible for rent through the lease term despite abandonment, breach, or eviction, subject to mitigation required by law. Lessor shall make a good faith effort to re-let the Premises. Lessee remains responsible for unpaid rent, advertising costs, and reasonable attorney's fees.
14. Binding Effect
Violation of any provision allows Lessor to terminate this Lease upon legal notice. Assignments bind assignees as if they signed the Lease.
15. Attorney's Fees
If the Landlord is the prevailing party in litigation arising from this tenancy, reasonable attorney's fees may be awarded as permitted by law.
16. Remedies Cumulative
All remedies are cumulative and in addition to those provided by law.
17. Fire or Casualty
If the Premises becomes uninhabitable due to fire or casualty, the parties shall have rights as provided by law. Lessor's good faith insurance recovery efforts constitute diligence.
18. Security Gates or Bars
Installation of metal gates or bars is prohibited. Lessor may require removal at Lessee's expense and may terminate the Lease for noncompliance. Window guards will be installed as required by law upon written request for households with children under ten (10).
19. Mechanic's Liens
Lessee shall not permit liens against the Premises. Any such lien constitutes a breach and must be cured within ten (10) days or Lessor may terminate the Lease and recover costs.
20. Rules and Regulations
Lessee agrees to comply with all Rules and Regulations attached to or established under this Lease. Violations constitute a material breach.
21. Subordination of Lease
This Lease is subordinate to existing and future mortgages. Recording this Lease by Lessee constitutes a breach.
22. Severability
If any provision is invalid or unenforceable, the remainder of the Lease remains in effect.
23. Utilities
Unless otherwise agreed, Lessee shall pay all utilities serving the Premises, including gas, electricity, water, sewer, telephone, internet, and cable, if separately metered.
24. Rental Payments
Rent payments may be made online, by mail, or by any lawful method accepted by Lessor, subject to applicable late charges.
25. Dishonored Checks
A $15 fee will be charged for any dishonored check, in addition to rent and late charges. Lessor may waive this fee at discretion.
26. Continuous Occupancy and Extended Absence
Lessee shall not leave the Premises vacant for more than twenty-one (21) days without advance notice. Unauthorized guests may not stay longer than seven (7) consecutive days.
27. Event of Default
Failure to perform any obligation constitutes default. Lessor's failure to enforce does not waive the default.
28. Safety Devices
Lessee shall test and maintain smoke, burglar, and carbon monoxide detectors and replace batteries. Lessor warrants devices are operational at move-in. Lessee must report defects promptly.
29. Modification
No modification or waiver is valid unless in writing and signed by all parties.
30. Alterations and Improvements
No alterations, painting, fixture changes, or landscaping modifications are permitted without written consent.
31. Surrender of Possession
Upon termination, Lessee shall vacate, return keys, and leave the Premises clean and in good condition.
32. Anti-Discrimination
The Premises are offered in compliance with all applicable fair housing and anti-discrimination laws.
33. Notice of Termination
Lessee must provide sixty (60) days' written notice of intent to vacate. Failure to do so results in rent owed for the notice period.
34. Heat, Cold, and Hot Water
Lessor shall provide heat, cold, and hot water as required by law. Where utilities are separately metered, Lessee is responsible for operating costs.
35. Required Move-In Checklist
Lessee must complete and return the move-in checklist within seventy-two (72) hours of occupancy.
36. Easement
Lessor retains the right to display "For Sale" or "For Rent" signage in common areas or on the exterior within sixty (60) days of lease expiration.
37. Governing Law
This Lease is governed by the laws of the Commonwealth of Massachusetts.
38. Smoking Prohibition
The Premises and building are smoke-free. Smoking of tobacco or marijuana is prohibited in all interior areas and common grounds.
39. Utility Clause Water Submetering
Tenant is responsible for gas, electric, and water/sewer usage for the unit. Water usage is submetered and billed monthly at applicable municipal rates.
40. Rent
Rent is due on the second (2nd) day of each month, in advance. Timely payment is of the essence. Failure to pay may result in legal action.
41. Late Charges
Rent received more than thirty (30) days after the due date incurs a late charge of ten percent (10%). Dishonored payments incur additional bank charges.
42. Month-to-Month Tenancy
After lease expiration, tenancy may continue month-to-month at Lessor's discretion. Either party may terminate with thirty (30) days' written notice.
RULES AND REGULATIONS
Lessee agrees to comply with all building rules, including but not limited to restrictions on locks, hazardous materials, heavy furniture, hallway use, noise, signage, garbage disposal, barbequing, snow removal, pets, laundry use, lockouts, storage, and guest conduct. Violations may result in lease termination.
LEAD-BASED PAINT DISCLOSURE
Housing built before 1978 may contain lead-based paint. Lessor has no knowledge of lead-based paint or hazards and has no related records. Lessee acknowledges receipt of required disclosures.
