This applicant was interested in an apartment I was leasing. I have never represented him as a Realtor. He was aware the earnest money was non-refundable (as are most earnest deposits). This is the existing process I have used for over 10 years. Once a deposit is made, the apartment is held for the applicant, I am unable to offer it to another person. After he applied for the apartment, the landlord was unwilling to let him out of his existing lease. The applicant then backed out of renting my apartment upon realizing there would be a fee for breaking his lease and at that time forfeited his earnest money. It is unfortunate but this happens from time to time. I now require applicants sign a separate form so that they are aware of this fee.
