Update Mr. Howe filed a formal complaint with the National Association of REALTORS®, alleging that I violated their Code of Ethics. A hearing was held to review the matter. The sole basis of Mr. Howe’s complaint was what he claimed his agent told him. However, during the hearing, his agent—whom he had called as a witness—testified that she never made the statements he alleged. I provided complete documentation, including the contract Mr. Howe voluntarily signed and confirmed he understood under oath. Following a thorough review, the panel found no violation of the Code of Ethics. . . . . . Thanks for your review, Kevin. There seems to be a misunderstanding. I informed your agent that the buyer MAY have a buyer for their home. If they had secured a buyer, there would have been a different addendum to the contract. In fact, the addendum to this contract states that they must secure a buyer by a certain date. Also, there was an offer made on their property immediately after listing, and it never came together. I, however, can only speak of conversations I was personally involved in, so I cannot comment on what was said between you and your agent. You and I never spoke about this. In addition, I can't help but think this is in some way retaliatory after your unsuccessful attempt to void the voluntary legal binding contract between my client and yourself.
